Newport Beach, August 6, 1934.
The. City Council of the City of Newport Beach met in regular
session in the City Council Chambers of the City of Newport Beach at
7:30 o'clock p. m on above date with Mayor Hilmer presiding.
The roll was called showing the full Council present.
The minutes of the previous meeting of July 2nd were approved
and signed by members of the Council.
REPORTS OF HEADS OF DEPARTMENTS
The report of the City Treasurer was read and on motion of
Councilman Claire, seconded by Councilman Garfield and carried,the same
was accepted, the reading of the other reports of Heads of Departments
d&spensed with, and all the reports ordered filed.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS
Chief of Police Hodgkinson presented a report relating to a
complaint filed in his office against Luke Ozene of the fishing boat
'Dora M.' by G. A. Turner and others. The report and complaint was
read and on motion of Councilman Garfield, seconded by Councilman Claire
and carried, the same was ordered filed.
On motion of Councilman Claire, seconded by Councilman Garfield
and carried, the regular order of business was suspended to allow
Dr. K. H. Sutherland, County Health Officer to address the Council in
regard to the enforcement of the City Dog License Ordinance, due to the
prevalance of rabies, and to prevent further spread of the same, which
met with the approval of the Council.
On motion of Councilman Claire, seconded by Councilman Garfield
and carried, the regular.order of business was resumed.
The application of Preston Humason for a permit to conduct a
restaurant at 109 Main Street, Balboa, was on motion of Councilman Claire,
seconded by Councilman Garfield and carried, allowed subject to the
approval of the Health Officer.
The application of Edwin Beisel to stage a 'Clowning Act' for
the business men of Newport was refused owing to a conflicting ordinance,
and on motion of Councilman Claire, seconded by Councilman Garfield and
carried, the City Clerk was instructed to notify the applicant of the
action taken.
The application of Alvin C. Bridges for a veteran's exempt
license to make and sell photographs was on motion of Councilman Claire,
seconded by Councilman Garfield and carried, laid on the Table for
filing of further credentials by the applicant.
Mrs. W. I. ' 'Williams, President of the Garden & Improvement
Club of Corona del Mar applied for permission to hold a Street Dance
on the pavement at the top of the Old Hill Road in that section,
inviting the Council to join in the festivities, and on motion of
Councilman Garfield, seconded by Councilman Claire and carried, the
request was granted subject to the approval of the Police Department.
Mrs, W. I. Williams, Secretary & Treasurer of the Corona del
Mar Property Owners' Association expressed the thanks of that organization
to the City Council for the help and cooperation extended during the
past year, and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, the communication was ordered.filed.
Dr. L. Ludlow Haight in a communication to the Council reported
undermining of the sidewalk at the corner of Balboa Avenue and Grand
Canal on Balboa Island, whereupon Street Superintendent Patterson
reported that the seawall was too far gone to permit 6f:any repairs
thereto and that there were no available funds to rebuild the structure
there being too much involved. On motion of Councilman Claire, seconded
by Councilman Gordon and carried, the Street Superintendent was instructed
to place warning signs indicating the danger infusing the walk, and the
City Engineer was requested to confer with the property owners affected
regarding a permanent construction of the seawall.
John M. Allen of Balboa Island complained in a letter to the
Council concerning the noise created.by itinerate newspaper peddlers,
and asked that the Council take steps to remedy the situation. The

communication was accompanied by a petition pertaining to the subject
and signed by various business men of Balboa dnd Balboa Island. On
motion of Councilman Claire, seconded by Councilman Ellsworth and
carried, the matter was referred to the Police Department.
A letter addressed to the Council and signed by 'A Patron'
complained of the lack of rest room facilities on the Newport pier
and urged the installation of same. On motion of Councilman Ellsworth,
seconded by Councilman Garfield and carried, the letter was ordered
filed.
A letter from A. B. Jessee, Manager of the local Bank of
America branch thanked the Council for the flowers sent for the . '
opening of the institution and on motion of Councilman Claire, seconded
by Councilman Garfield and carried, the letter was ordered filed.
A letter from the Chairman of the Associated Chambers of
Commerce together with a resolution supporting the Elliott Plan
pertaining to water conservation for Orange County was presented, and
on mettion of Councilman Claire, seconded by Councilman Garfield and
carried, was laid on the Table.
A communication from D. W. Tubbs, Agricultural Commissioner
together with a resolution to conform with the provisions of Chapter
1 of Division 2 of the Agricultural Code, relating to the extermination
of ground squirrels and other animal pests, was read and the Resolution
numbered 835 was adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
On motion of Councilman Claire, seconded by Councilman
Garfield and carried, the letter of D. W. Tubbs was ordered filed.
F. A. Baughan, Secretary of the Southern Caltfbrnia League of
Municipalities, presented a letter relating to the Gasoline Tax . .
situation, and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, the same was ordered filed.
Wm. J. Brown presented an application for permission to moor
a floating slip fronting on the property occupied by Brown's Boat
Service formerly the Crandall Boat Works. Mr. Brown addressed the
Council in connection with the matter. On motion of Councilman
Claire, seconded by Councilman Gordon and carried, the application
was laid on the Table pending the report and approval of the Federal
Government regarding the same.
W. T. Ohowell in a letter to the Council reported on the
activities of the Recreation Grounds conducted under his supervision
and thanked the City Council for the support given him in the matter.
Some complaint was made regarding the rowdyism indulged in by some
of the local people. On motion of Councilman Claire, seconded by
Councilman Ellsworth and carried,.the letter was ordered filed.
The resignation of Harbor Master M. S. Robinson effective
August 31, 1934 was read and on motion of Councilman Gordon, seconded
by Councilman Garfield and carried, the same was accepted.
John Callahan presented an application for the.position of
Harbor Master, setting forth his qualifications and references.
Byron L. Marshall presented an application for the position
of Harbor Master outlining his qualifications for the position and
offered letters of endorsement from his last two employers.
Henry C. Grant presented an application for the position of
Harbor Master in which his qualifications were set.forth.
Thomas E. Bouchey presented an application for the position
of Harbor Master together with letters from various persons and a
petition bearing the signatures of approximately 100 persons endorsing
him for the position.
The application of Harry E. Rider for the position of
Harbor Master, presented at the meeting of May 6th, was read and
placed on file with the other applicants.
On motion of Councilman Ellsworth, seconded by Councilman
Claire and carried, the appointment of Harbor Master was referred
to the Police Committee for recommendation and report.
The Council was addressed by a representative of the
Compton Post of Disabled Veterans in regard to the shooting of fireworks
at a picnic to be held by that organization on August 19th, and on
motion of Councilman-Claire, seconded by Councilman Ellsworth and
carried, permission was granted for the fireworks display, subject to
the supervision of the Fire Chief.

UNFINISHED BUSINESS
On motion of Councilman Gordon, seconded by Councilman Garfield
and carried, the City Engineer was instructed to inform F. W. Stair
regarding the electric light pole of which he had complained of as
obstructing the entrance to his garage on Balboa Island.
Ordinance No. 423 known as the Radio Interference Ordinance
came up for final passage, but owing to the same not, having been approved
by City Electrician Foltz, the same was laid on the Table until the
next meeting of the Council.
City Engineer Patterson reported on the pier application of
' C. A. Neighbors, fronting on Lots h and 2, Block 19, Balboa'Eastside
Addition, and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, the same was granted subjedt to the approval of
the City Engineer.
NEW BUSINESS
On motion of Councilman Claire, seconded by Councilman Gordon
and carried, the monthly demands having been duly audited by the Finance
Committee, were allowed and warrants ordered drawn for same.
The budget of the Newport Harbor Chamber of Commerce in the
sum of $4,680 for the ensuing year was presented, and on motion of
Councilman Claire, seconded by Councilman Garfield and carried, the
same was approved.
Resolution No. 836, being a resolution and order appointing
the City Engineer of the City of Newport Beach, California, to procure
and prepare certain information and report pursuant to the provisions
of the "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931".approved June 6, 1931, as amended, and rescinding
Resolutions Numbers 627 and 626, was introduced and adpptdd by the
following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None:
Resolution No. 937 relating to the leasing by the Government
of the United States from the City of Newport Beach a certain office
building situated on the Washington Street pier for the period of
time as indicated in the lease, was introduced and adopted by the
following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
'An ordinance was introduced, being an ordinance of the
City Council prQfidtag for the levy and collection of five cents on
each One Hundred Dollars of assessed valuation for tax purposes,
providing manner of using such tax and time of collection thereof and
ordering the submission of said Ordinance to the electors of
the City of Newport Beach at a,special election to be held in said
City of Newport Beach on the 20th day of September 1934. The ordinance
was read and considered and the adoption of same was moved by Councilman
Claire, duly seconded by Councilman Gordon and passed to the seoond'reading
by.- the_followii}g.roll. call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
City Engineer Patterson presented the application of the
Edison Company for permission to install a feed line under the Balboa
' Island bridge obviating the hazard presented by its present location
in spanning the North Bay and on motion of Councilman Claire, seconded
by Councilman Ellsworth and carried, the request was granted.
City Engineer, R. L. Patterson, presented plans and specifications
for the improvement of Bay Avenue between 9th Street and 10th Street,
and recommended that said plans and specifications be approved. Whereupon
Councilman Claire moved that said plans and specifications for the
improvement of Bay Avenue between 9th Street and 10th Street be adopted
and filed in the office of the City Clerk, which motion was duly seconded
by Councilman Garfield, and upon roll call carried by the following vote,
to -Wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield and Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.

On motion of Councilman Claire, seconded by Councilman Ellsworth �
the following resolution was unanimously adopted:
RESOLVED, That Herman Hilmer, Mayor of the City of Newport
Beach be and hereby is authorized to enter into such agreements and sign
such papers as are necessary to properly make application to the
Emergency Relief Administrator of California for the improvement of
Bay Avenue between 9th Street and 10th Street in the City of Newport Beach.
I, F. L. Rinehart, hereby affirm that I am the duly elected
Clerk of the City of Newport Beach, and that the above is a true copy
of a portion of the minutes of a regular meeting of the City Council, .
held on August 6th, 1934. /7
ITY CLERK
Street Superintendent Patterson presented the names of extra
men and rate of pay per day employed in the Street Department during
the month of July, and on motion of Councilman Claire, seconded by
Councilman Ellsworth and carried, the same was approved.
Mayor Hilmer brought up the matter of the broken seawall on
the North Bay side of Balboa Island, and on motion of Councilman Claire,
seconded by Councilman Gordon and carried, the City Engineer was requested
to furnish an estimate of the cost of repairing the seawall and also an
estimate of the cost of the work through the medium of the SERA.
ADJOURNMENT
There being no further business to come before the Council a
motion to adjourn to 12 o "clock Noon on August 13, 1934, was made by
Councilman Claire, seconded by Councilman Gordon and carried.
