The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the City of Newport
Beach at 12 o'clock noon on above date with Mayor Hilmer presiding.
The roll was called showing the full Council present.
On motion of Councilman Ellsworth, seconded by Councilman Claire
and carried, the regular order of business was suspended in order to
allow Mrs.,A, G. Burlingame to address the Council in connection with
a proposed increase in the library tax rate. Speaking for the Library
Board Mr. Burlingame opposed the placing of the question of the Library
tax on the ballot at the election called for September 20th, stating
that 92% of the library fund is now expended for salaries and 8% for
books and that it was the wish of the Library Board that no action be
taken at this time, whereupon it was moved by Councilman Garfield, seconded
by Councilman Gordon that the proposed increase of one cent in the
library tax rate be omitted from the ballot, the motion being adopted by
the following roll call vote, to =.,wit:
AYES: Councilmen Gordop,Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
Mrs. Walter V. Combs addressed the'Council regarding an injury
to her son's fott alleged to have been due to a--,defective boardwalk. On
motion of Councilman Gordon, seconded by Councilman Garfield and carried
the matter was referred to the City Attorney for investigation.
On motion of Councilman Ellsworth, seconded by Councilman
Gordon and carried, the regular order of business was resumed.
STANDING COMMITTEES
Councilman Gordon reporting the matter of dog licenses recommended
that J. C. Calhoun be employed for four days per week in connection with
' the collection of dog licenses, and on motion of Councilman Claire,
.seconded by Councilman Gordon and carried, the same was approved.
Councilman Gordon brought up the matter of the appointment of
a Harbor Master to succeed M. S. Robinson whose resignation will be
effective September let. Councilman Gordon reported that he had conducted
an examination both oral and written of the various applicants for the
position in order to determine their repsective qualifications and fitness
for the duties of Harbor Master and as a result of such test he recommended
the appointment of Harry E. Rider.
Councilman Garfield the other member of the Police Committee,
to which the Harbor Master matter had been referred, stated that he had
not understood that a competitive examination was to be held in order to
select a suitable person for the position and that he recommended the
appointment of Thomas E. Bouchey who had been highly endorsed by the
boating fraternity in general for the place.*
On motion of Councilman Claire, •seconded by Councilman Ellsworth
and carried, the report of Councilman Gordon be filed, however, the latter
stated that the document from which he read was merely notes for his
personal use and no report was filed with the Clerk.
It was moved by Councilman Gordon that Harry E. Rider be
appointed as Harbor Master, the motion was seconded by Mayor Hilmer and
was lost by the following roll call vote, to -wit:
AYES, Councilmen Gordon, Hilmer.
NOES: Councilmen Claire, Ellsworth, Garfield.
ABSENT: Councilmen None.
It was moved by Councilman Garfield that Thomas E. Bouchey be
appointed as Harbor Master, the motion was seconded by Councilman Claire
and unanimously carried by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None. •
It was moved by Councilman Claire, seconded by Councilman
Garfield and carried that a telephone be installed in the Harbor Master's
home, same to be used for local calls only.

COMMUNICATIONS
The application of R. R. Gillum for an exempt veteran's
license to sell firewood in the City of Newport Beach, was read. The
application was endorsed by County Health Officer Sutherland as to the
applicant's physical disability and on motion of Councilman Claire,
seconded by Councilman Gordon and carried, the exempt license was
granted.
The letter of Kenneth Fraser's in which he complained of
hazardous conditions alleged to exist on Balboa Island due to
automobile spgeding, was read, whereupon Chief of Police Hodgkinson
addressed the Council regarding a resurvey of the Island'by "the '
Automobile Club with a view of placing more traffic signes. On
motion of Councilman Claire, seconded by Councilman Ellsworth'and
carried, the complaint of Kenneth Fraser's was referred to the
Police Chief.
R. H. Wattson addressed a letter to the Council in which
notice was served that if certain repairs were not made to the sidewalk
fronting on his property, the condition of said walk being such as to
force persons to trespass on his property which the writer stated
would be closed to the public within two weeks. On motion of Councilman
Gordon seconded by Councilman Claire and carried, the matter was laid
on the Table for the next meeting, meanwhile the Street Superintendent
was instructed to post signs warning pedestrians not to use the sidewalk
but use the alley instead.
UNFINISHED BUSINESS
Ordinance No. 423 known as the 'Radio Interference Ordinance'
came up for final passage, and on motion of Councilman Gordon, seconded
by Councilman Claire and carried, the ordinance was laid on the Table
pending a written report on the same from the City Electrician.
NEW BUSINESS
Councilman Claire moved the adoption of Resolution 'No.' 838 ,
being a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH '
CALLING SPECIAL MUNICIPAL ELECTION TO BE HELD IId SAID CITY OF
NEWPORT BEACH ON THURSDAY, THE 20TH DAY OF SEPTEMBER, 1934, FOR
THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID CITY
CERTAIN PROPOSITIONS NUMBERED ONE TO.FIVE, CONSECUTIVELY„ FOR THE
GRANTING TO THE UNITED STATES OF AMERICA CERTAIN TIDELANDS AND
SUBMERGED LANDS, BELONGING TO SAID CITY, FIXING THE PRECINCTS AND
POLLING PLACES FOR THE HOLDING OF SAID ELECTION, AND APPOINTING
OFFICERS FOR SAID ELECTION, AND FIXING THEIR C0UPENSATION.
The motion for adoption wad duly seconded by Councilman
Garfield and the resolution was passed by the following roll call
vote, to -wit:
AYES: Councilman Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
Councilman Claire advised that due to possible confusion on
the part of voters, it would be best to omit the propostition of
voting on the proposed Park Tax rate, and on motion of Councilman
Ellsworth, seconded by Councilman Gordon and carried, the question of
the Park Tax rate was eliminated from the ballot.
Councilman Gordon brought up the question of certain new
games being conducted in the City and asked for a ruling on same from
the City Attorney, the latter advising that said games had been
approved by the Chief of Police. It was moved by Councilman Gordon
seconded by Councilman Claire and carried, that the City Attorney
investigate'the. games in question and submit a written report to
the Council concerning their legality.
ry City Engineer Patterson presented the matter of proceedings
for the building of a bulkhead as a protection to certain property
in Tract 518, Mr. A. S. Monroe also reporting on the subject and
directing the proper proceedure to be takeh therein, whereupon
Councilman Claire moved the adoption of Resolution No. 839, being,

CALIFORNIA, DETERMINING THE NATURE, LOCATION AND EXTENT OF THE PROPOSED
IMPROVEMENT FOR THE CONSTRUCTION OF A WOODEN BULKHEAD AND APPURTENANCES
TO PROTECT CHANNEL ROAD AND OTHER PROPERTY IN SAID CITY; GENERALLY
DEFINING THE BOUNDARIES OR EXTENT OF THE DISTRICT TO BE SPECIALLY
ASSESSED TO PAY THE COST THEREOF; AND DETERMINING THE STATUTE UNDER WHICH
IT IS PROPOSED TO CONDUCT THE PROCEEDINGS, PURSUANT TO THE PROVISIONS
OF SECTION 2 OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND
MAJORITY PROTEST ACT OF 1931 ". The resolution was duly seconded by
Councilman Gordon and passed by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
Water Superintendent Patterson presented the matter of water
conditions and advised the Council that a complete analysis of the City's
water supply should be made, and on motion of Councilman Ellsworth,
seconded by Councilman Garfield and carried, the Water Superintendent
was authorized to expend an amount not exceeding three hundred dollars
for the purpose above mentioned.
ADJOURNMENT
There being no further business to come before the Council
a motion to adjourn Sine Die was made by Councilman Claire, seconded by
Councilman Ellsworth and carried.
