The City Council of the City of Newport Beach met in regular
session in the City Council Chambers of the City of Newport Beach at 7:30
o'clock P. M. on abcve date, with Mayor Hilmer in the Chair.
The roll was called showing the full Council present.
REPORTS OF HEADS OF DEPARTMENTS '
The report of the City Treasurer was read and on motion
of Councilman Ellsworth, seconded by Councilman Claire and carried,
the report, was accepted, the reading of reports of other Heads of
Departments dispensed with and all the reports ordered filed.
REPORTS OF STANDING COMMITTEES
Councilman Gordon, Chairman of the Police Committee
submitted a report of the extra help employed in that Department
during the month of September and also a report dealing with the
dog situation showing the amount of revenue received.from dog
licenses and pound fees and the expense incurred in administering
the same. On motion of Councilman Claire, seconded by Councilman
Garfield and carried, the reports were accepted and ordered filed.
Street Superintendent Patterson advised that, the extra
help report for that Department was not made up for submission
at this meeting.
The City Clerk by instructions given at a former meeting
reported on the petitions filed respecting,certain games, as to the
number of property - owners, voters, non - property - owners and non - voters
contained in the various petitions, and on motion of Councilman
Ellsworth, seconded by Councilman Garfield and carried, the report
was accepted and ordered filed..
On motion of Councilman Claire, seconded by Councilman
Garfield and carried, the report of the City Clerk and the petitions
in connection therewith were ordered filed for future information.
COMMUNICATIONS
The application of Dr. S. 0. Chambers for permission to
construct a pleasure pier fronting on Lot 297, Lido Isle Tract, was
on motion of Councilman Claire, seconded by Councilman Gordon and
carried, referred to the City Engineer for report.

The application of Wm. J. Brown for a permit to install
underground tanks for hazardous fluids, at Brown's Boat Works via
Oporto and Central Avenue, was on motion of Councilman Claire,
seconded by Councilman Garfield and carried, allowed subject to the
approval of the Fire Chief.
Claude A. Pullen, Chairman of the Parks and Beautification
Committee presented a letter to the Council in which was outlined
certain suggestions as to the manner in which the Committee should
function, and on motion of Councilman Gordon, seconded by Councilman
Claire and carrie&, the letter was ordered filed.

' and Improvement.Club and the Corona del Mar Property Owners Association
presented a letter to -the Council asking that a survey be made of the
dead trees needing replacing in that district; the matter of weeds
on the curbs and lots in the Corona del Mar section and also mentioned
that some money was due the Garden and Improvement Club. Mr. Noonan
a resident of> Corona del Mar addressed the Council regarding the
matters. Councilman Claire suggested that the matter of removing
the weeds might be accomplished through the SERA organization;
reference was made to Ordinance No. 191 known as the Weed Ordinance.
On motion of Councilman Gordon, seconded by Councilman Claire and
carried, the various matters contai.ned'in the communication of Mrs.
Williams, were referred to the Street Committee for report.
E. J. Louis of the Newport Bay Investment Company, in a
communication to the Council suggested that a four day celebration
be planned commencing on September 25, 1935 in commemoration of
the discovery of the Pacific Ocean by Vasco Nunez de Balboa. On
motion of Councilman Claire, seconded by Councilman Garfield and .
carried, the matter was referred to the Chamber of Commerce.
George C. Hiner's application for a renewal of his lease
for the Live Bait concession on the Newport pier and the application
of Andrew J. Lenox for permission to bid on same, were on motion of
Councilman Claire, seconded by Councilman Gordon and carried, laid
on the Table until the next meeting of the Council.
A petition presented by Harry E. Rider and bearing in
excess of 250 names asked that the City Council not publish in
' any newspaper the delinquent tax list for the current year. The
matter was discussed at length and on motion of Councilman Ellsworth,
seconded by Councilman Garfield and carried, the question was referred
to the Finance Committee with the suggestion that.the action of the
State Legislature on the subject be awaited.
J. S. Brown, Chairman of the Fireworks Committee of the
Balboa Island Water Carnival Association, in a letter to the Council
asked that the bill for fireworks amounting to $147.21 due Pensick
& Gordon Inc., and authorized by the City Council on May 21, 1934
be allowed. A letter from Pensick & Gordon Inc., regarding the
same was also read, and on motion of Councilman Gordon, seconded by
Mayor Hilmer and carried, the matter was referred to the Advertising
Committee for report at the next meeting.
UNFINISHED BUSINESS
The petition and request of Valdemar Sorensen for permission
to sell both Live and Salted Bait on the Balboa pier was brought
up for re- consideration and after considerable discussion, it was
moved by Councilman Claire, seconded by Councilman Garfield and
carried, that the City Attorney be instructed to amend the existing
agreement between the City and Mr. Sorensen to permit the latter to
sell both Live and Salted bait, with the exception of clams, crabs
or other shell fish bait. On motion of Councilman Ellsworth, seconded
by Councilman Garfield and carried, the Sorensen petition was ordered
filed.
C. W. Hutchins addressed the Council regarding certain
games heretofore played in the City and objected to the same being
referred to as gambling games.
NEW BUSINESS
The monthly demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire, seconded by Councilman
Garfield and carried, allowed and warrants ordered drawn for same.
City Attorney Thompson presented a communication concerning
the crop of Lima beans produced by the tenants on City owned land
stating that a renewal of the lease on same was desired by the tenants,

and on motion by Councilman Claire that Resolution No. 855 be adopted
authorizing the Mayor and City Clerk to execute on behalf of the City
of Newport Beach a lease in favor of D. A. Bear and Harvey Bear for
the above mentioned land of approximately 34 acres, was duly seconded
by Councilman Gordon and passed by the following roll call vote,
to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
Water Superintendent Patterson advised the Council that
some action should be taken in connection with the future water supply
for the City, and on motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, the Water Cogmittee and the Water Superintendent
were instructed to make a report on the same for presentation to the
City Council later.
Councilman Ellsworth introduced and moved that the City
Attorney be instructed to prepare an amendment to Ordinance No. 359,
known as the "Dog Ordinance" Whereby the present license charge on
dogs be reduced to One- Dollar each for all dogs and that a similar
license fee be charged for all cats. The motion was seconded by
Councilman Gordon and the amended Ordinance passed to the second
reading.
The renewal of the Public Liability and Property Damage
automobile insurance was presented by Lew H. Wallace in a communication
to the Council. The matter was discussed and the Council addressed by
L. W. Briggs who asked that the granting of the insurance be held in
abeyance pending the presenting of rates from companies represented
by him. On motion of Councilman Gordon, seconded by Councilman
Garfield and carried, the policies written by Mr. Wallace were accepted,
the premium on same being withheld for thirty days, awaiting other
bids on same.
On motion of Councilman Garfield, seconded by Councilman
Gordon and carried, the City Attorney was instructed to investigate
charges for insurance made by the various insurance companies and
report on same at the next meeting of the Council.
An insurance policy on the Neon signs operated by the City
was presented by Harry H. Williamson, and on motion of Councilman.
Claire, seconded by Councilman Gordon and carried, the policy was
accepted, the demand for the premium allowed and a warrant ordered
drawn for same.
City Engineer Patterson presented the matter of acquiring
by the City of Newport Beach certain parcels of land owned by the
Title Insurance and Trust Company for the purpose of providing the
necessary rights of way-for the dredging and improvement of Newport
Harbor in accordance with the plans and specifications approved by
the United States of America; the description of said lands and the
price to be paid together with,the method of payment, all as described
in Resolution No. 856. Considerable discussion was had concerning the
matter, whereupon Councilman Claire moved the adoption of said Resolution
No. 856 which was duly seconded by Councilman Ellsworth and passed by
the following roll call vote, to -wit:
AYES: Councilmen Claire, Ellsworth, Garfield.
NOES: Councilmen Gordon, Hilmer.
ABSENT: Councilmen None.

a motion to adjourn to 7:30 P. M. October 22, 1934 was made by

The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the City of Newport
Beach at 7:30 P. M. on above date with Mayor Hilmer presiding.
The roll was called showing the full Council present.
REPORTS OF STANDING COMbkITTEES
Councilman Ellsworth of the Street Committee advised that
no report was ready on the various matters concerning Corona del Bear
which were referred to that Committee.
REPORTS OF SPECIAL COLLITTEES
Councilman Garfield of the Advertising Committee advised that
the report relating to the payment for fireworks in connection with
the Balboa.Island dater Carnival Association would be postponed for
one.week.
City Attorney Thompson to whom the.matter of automobile
insurance rates was referred at a previous meeting, reported on same.
Mrs. Anna Hawkins Lane presented a bid for the insurance covering
the City owned automobiles, Lew H. Wallace addressing the Council in
behalf of his bid for the same. On motion of Councilman Claire,
seconded by Councilman Gordon and carried, the matter of the automobile
' insurance was referred to the City Attorney and the City Engineer for.
report at the next meeting.
On motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, the regular order of business was suspended in
order to allow Mr. Monroe to take up the matter of the proceedings
pertaining to the construction of a bulkhead in Tract 515.
The Clerk reported that this was the time and place fixed
for the hearing of protests or objections against the work, the district
or the grades described in Resolution of Intention No. 554.in the
matter of the construction of a wooden bulkhead and appurtenances and
appurtenant work adjacent to the easterly line of Block P of Tract
No. 515, adopted by the City Council of said City on the 24th day of
S6.ptember, 1934•
The Clerk also reported that the affidavits in proof of the
publication of the Resolution of Intention and of the posting of the
Notice of Improvement, as required by law, have been made and are on
'file in the office of the City Clerk.
The Mayor, being the presiding officer of the City Council,
then announced that pursuant to the provisions of Section 9 of the
"Special Assessment Investigation, Limitation and Majority Protest Act
Of 1931 ", the first order of the hearing would be the reading of the
Engineer's written report on the said project, presented to the City
Council August 13, 1934 under the provisions of the "Special Assessment
Investigation, Limitation and Majority Protest Act of 1931 ", (except
as to the map, plat or diagram and the assessed valuations and true
valuations and the assessments and estimated assessments upon individual
parcels of land), before protests or objections would be considered.
Whereupon the Clerk read the said written report so defined
by the Mayor.
The Mayor then inquired of the Clerk whether any written
protests or objections against the work or the assessment district had
been filed with h'im'in said mentioned matter. The Clerk reported that
one written protest had been filed with him prior to the time set for
the hearing, by James E. Harvey, protesting against the proposed
improvement and against the assessment district.
