Gordon and carried the City Attorney was instructed to draft an
ordinance providing that no license fees be collected on cats or
dogs requiring that owners of dogs procure tags for same from the City.
Mayor Hilmer advised the Council that Harbor Master Bouchey
was in need of a desk for his office and on motion of Councilman
Claire, seconded by Councilman Ellsworth and carried, the purchase of
same was authorized.
The term of Mrs. Margaret Burlingame as a member of the
Library Board having expired, Mayor Hilmer re- appointed her for the
ensuing term and on motion of Councilman Claire, seconded by Council-
man Gordon and carried, the appointment was confirmed.
The controversy concerning the sale of smoked fish on the
beach was brought up in the Council, Mrs. Irene Hall speaking on
behalf of the beach contingent; A. J. Miller a smoked fish dealer of
202 Highland Avenue, addressing the Council in his own behalf as
opposing certain methods employed by the smoked fish dealers operating
on the beach. On motion of Councilman Ellsworth, seconded by Mayor
Hilmer and carried, the question was referred to the Police Committee
and the Chief of Police with power to act in the adjustment of the
matter.
ADJUURNMENT
On motion of Councilman Ellsworth, seconded by Councilman
Claire and carried, an adjournment was taken to 7:30 p. m. October
29, 1934.

The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the City of Newport
Beach at 7:30 p, m, on above date, with Mayor Hilmer in the Chair.
The roll was called showing the full Council present.

REPORTS OF STANDING 00kaITTEES
Councilman Gordon, Chairman of the Police Committee,
submitted a report in connection with certain so- called gambling
games, a matter Laid on the Table from the meeting of September 3,
1934. The report was read and it was moved by Councilman Gordon,
seconded by Councilman Garfield and accepted by the following roll
call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
Councilman Claire, Chairman of the Finance Committee, to
which Committee the matter of the publishing of the delinquent tax
list was referred, advised that the question be held in abeyance
pending the State Legislature's action concerning the same, stating
as
that there would be ample time in which to enact the necessary ordinance
in order to be effective for the current year. The Mayor and City
Attorney also discussed the matter and Councilman Claire moved that the
City Attorney be instructed to prepare an ordinance amending that
portion of Ordinance No. 15 and amendments thereto pertaining to the
publication of delinquent'tax lists. The motion was duly seconded by
Councilman Gordon and carried.
The matter of a disputed bill against the City for fireworks
ordered in connection with Balboa Island Water Carnival Association
events held on May 29th and 30th last, was brought up by Councilman
Gordon of the Advertising Committee to which the question had been
' referred at a previous meeting of the Council, stating the City did
not order the purchase of the fireworks along with the appropriation
of Three - Hundred Dollars granted the Balboa Island Water Carnival
Association for Advertising, Trophies and Fireworks distributed as
follows: $150.00 for Fireworks; $100 for Advertising and $50.00 for
Trophies.
Councilman Ellsworth who was a member of the Advertising
Committee at that time also submitted a request addressed to the City
Attorney for an opinion as to the legality of the City of Newport Beach
paying the bill for the fireworks. The question was discussed at
length by Mayor Hilmer, City Attorney Thompson and others.
On motion of Councilman Ellsworth, seconded by Councilman
Garfield and carried, a recess was taken in order to allow Councilman
Gordon to preparea written report relating to the fireworks matter,
which on resuming of business by the Council, was read after which
further discussion was had by the members of the Council, J. A. Beek,
and J. S. Brown of the Water Carnival Association participating in same.
On motion of Councilman Claire, seconded by Councilman Ellsworth and
carried, all reports in connection with the fireworks bill were ordered
filed.
Councilman Ellsworth of the Street Committee, to which several
matters submitted by an organization from the Ccrona del Mar district
had been referred at a previous meeting, requested that same be laid
over, more time being required for the report.
Councilman Gordon brought up the question of the collection
of rentals on privately owned piers, the City Attorney advising that
the Resolution respecting same had not yet been drafted.
COkLUNICATINNS
Logan Jackson, Sheriff of Orange County, in a letter to the
City Council extended an invitation to the members for their attendance
at the Martin Airport in Santa Ana at 3:00 P. M. November 4th on the
occasion of the official visit of Sheriff Eugene W. Biscailuz of Los
Angeles County and the Aero Squadron of Los Angeles County. On motion
of Councilman Claire, seconded by Councilman Gordon and carried, the
letter was ordered filed.

City Attorney Thompson requested one more week in which to
.render his report on the subject of autorsobile insurance on'City -owned
cars.
The quitclaim deed from the Title Insurance and Trust Company
in connection with Resolution No. 856 -tras presented, the adoption of
the resolution being moved by Councilman Claire, seconded by Councilman
Gordon and was passed by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.

Ordinance No. 423 pertaining to the prevention of Radio
Interference having been approved by the City Electrician, came up for
final passage, the motion for same being made by Councilman Claire,
seconded by Councilman Ellsworth and adopted by the following roll call
vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.

Ordinance No. 424, dedicating certain described real
property by the City of Newport Beach to the public for street purposes
was presented, the adoption'of which was moved by Councilman Claire,
seconded by Councilman Garfield and passed by the following roll call
vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
In the matter of the petition and application of George E.
Hiner for a renewal of his license for the live bait concession on the
Newport pier, and the request of Andrew Lenox for the same to be put
up for bids was considered, Councilman Gordon moving that the City
Attorney give an opinion in writing as to the legality of any citizen
requesting that bids be advertised for in connection with the granting
of a lease or concession on City -owned property, or of granting the
same without'asking for bids, the motion was seconded by Mayor Hilmer
and carried.
At the request of Mayor Hilmer that the Council confirm the
purchase by the City Engineer of sewer pipe and the removing of the
Boy Scout building in connection with the extension of Bay Avenue, a
motion was made by Councilman Garfield,'seconded by Councilman Gordon
and carried, that the same be approved.
City Attorney Thompson presented for final passage the
Emergency Ordinance No. 425 relating to the Tax loratorium and in
conformity with the State Law. A motion for the adoption of the ordinance
was made by Councilman Claire, seconded by Councilman Garfield and the
measure was passed by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
The Dog License Ordinance No. 426 establishing regulations
for the licensing of doge repealing Ordinance No. 359 and all other
ordinances in conflict therewith was presented for final passage. The
adoption of the ordinance was moved by Councilman Gordon, seconded by
Councilman Garfield and passed by the following roll call vote, to -wit: '
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
City Attorney Thompson presented an ordinance known as the
"Ambulance Chasing" ordinance which was designated Ordinance No. 427,
and on motion of Councilman Claire, seconded by Councilman Garfield and
carried, passed to the second reading.
City Engineer Patterson presented a report on the water
situation, explaining to the members of the Council the serious condition
in relation thereto as exists at the present time, suggesting that a
Water Committee be appointed consisting of the members of the City Council
and Citizens, whereupon Mayor Hilmer appointed H. L. Sherman to serve
on the Citizens contingent of the Committee. On motion of Councilman
Ellsworth, seconded by Councilman Garfield and carried, the appointment
was confirmed.
Councilman Ellsworth brought up the question of granting an
exclusive privilege for the Live Bait Boat business operating from the
Newport pier whereby good service and accomodations would be available
the year around for persons desiring recreation of that nature, suggesting
that a Committee be appointed consisting of Council members and the City
Attorney to formulate some plan in connection therewith; Councilman
Ellsworth moved'that the Mayor name such a Committee for the purpose,
the motion was seconded by Councilman Gordon and carried, whereupon
Mayor Hilmer appointed the following as a Committee to confer-with City
Attorney Thompson: Councilman Paul B. Ellsworth, Chairman; Councilman

Lloyd Claire and Councilman Irvin George Gordon.
City "Engineer Patterson suggested and advised that the Board
of Supervisors of Orange County be consulted in an effort to secure
their cooperation and the services of Engineer Elliott, an authority
on water matters, and who is now acting for the County of Orange and
other groups within the County. On motion of Councilman Ellsworth,
seconded by Councilman Gordon and carried, Water Superintendent Patterson
was authorized to contact and consult the Board of Supervisors regarding
the services of Mr. Elliott.
ADJOURNMENT

There being no further business to come before the Council,
a motion to.adjourn Sine Die was made by Councilman Ellsworth, seconded
by Councilman Garfield and carried.

session in.the City Council Chambers of the City of Newport Beach at

The report of the City Treasurer was read and on motion of
Councilman Claire, seconded by Councilman Gordon and carried, the report
was accepted, the reading of the reports of other Heads of Departments
dispensed with, and all the reports ordered filed.

COkkUNICATIONS
The application of the Balboa Island Yacht Club for permission
to construct a pier for the use of its Club membdrs, was on motion of
Councilman Claire, seconded by Councilman Gordon and carried, referred
to the City Engineer for report and approval.
The application of C. R. Olsen, Commodore of the Corsair Boat
Club for permission to hold a race for outboard motor boats in the North
Channel on- November 1$, 1934, was on motion of Councilman Garfield,
seconded by Councilman Claire and carried, granted.
The letter of vera Foden, concerning the proposed 'Cat and Dog'
license ordinance, was on motion of Councilman Claire, seconded by
Councilman Garfield and carried, ordered filed.
The letter of Jonathan Kirkpatrick praising the work of John
Siegel in assisting the residents of the Seashore Colony Tract during the
' high tides and the damage in connection therewith, was on motion of
Councilman Gordon, seconded by Councilman Garfield and carried, ordered
filed.
Jonathan Kirkpatrick's letter relating to the rer•ission of taxes
in Block 36 on account of the damage due to the high tides, was on motion
of Councilman Claire, seconded by Councilman Gordon and carried, referred
to the City Assessor with instructions to notify the applicant that.
nothing could be done in the matter this year.
