Newport Beach, January 7, 1935.
The City Council of the city of Newport Beach net in regular
session in the City Council Clambers of the city of Newport Beach at
7:30 o'clock P. M. on above date with Mayor Hilmer in the Chair.
The roll was called showing the full Council -present.
REPORTS OF HEADS OF DEPARTMENTS
The report of the City 'Treasurer was read and on motion of
Councilman Ellsworth, seconded by Councilman Gordon and carried, the
same was approved, the reading of the reports of other Heads of
Departments dispensed with and all the reports ordered filed.
In order to allow Capt. Brown of Brown's Boat Service to
address the Council it was moved by Councilman Ellsworth, seconded by
Councilman Gordon and carried, that the regular order of business be
suspended.
Captain Brown addressed the Council regarding the need of
better fire equipment for fighting fires occuring on water craft,
stressing the need of more efficient chemical apparatus. On motion
of Councilman Claire, seconded by Councilman Garfield and carried,
the matter was referred to the Fire Committee for investigation and
report at the next meeting of the Council.
On motion of Councilman Ellsworth, seconded by Councilman
Garfield and carried, the regular order of business was resumed.

City Engineer Patterson presented the report of the extra
help employed and the rate of oay therefor in the Engineering and
Street Departments for the month of December 1934. On motion of
Councilman Claire, seconded by Councilman Garfield and carried., the
report was accepted and ordered filed.
COMMUNICATIONS
Oscar L. Walling presented an application for aft exempt
Veteran's vending license and on motion of Councilman Claire, seconded
by Councilman Gordon and. carried, the same was allowed.
K. C. Burdick's application for a license to operate a
wholesale fish market at 515 - 30th Street, was on motion of Councilman
Claire, seconded by Councilman Gordon and carried, allowed subject to
the an_nroval of the Health Officer.
Councilman Gordon presented on behalf of L. A. Cox, a written
protest against the operation of rock bunkers built on the premises of
the Bay District Lumber Company, the protest alleging that the bunkers
are unsightly, unsanitary and the loading of same creating a traffic
hazard on Santa Ana Avenue, besides blocking Tenth Street. The matter
was gone into by the Council, and on motion of Councilman Claire,
seconded by Councilman Garfield and carried, the same was referred to
the Chief of Police and the City Engineer for investigation as to the
various -phases of the protest.

F. C. Brookings, Secretary of the Planning Commission
presented. a report regarding the application of the Balboa Yacht
Club for permission to construct a thirty foot vier fronting on Lot
12, Block 4, Section 5, Balboa Isla.nd., the Commission advising that
the matter was being returned to the Council with no action being
taken due to the Balboa Yacht Club having withdrawn their application.
On motion of Councilman Claire, seconded by Councilman Garfield and
carried, the report was ordered filed.
F. C. Brookings, Secretary of the Planning Commission
presented a recommendation by that body that corrective measures be
taken to improve traffic conditions at the corner of Park and Agate
Avenues on Balboa Island in order that the larger cars and trucks
be enabled to make the turn with less difficulty, the improvement to
be made with as little loss of parking space as possible. On motion
of Councilman Claire, seconded by Councilman Gordon and carried., the
matter was referred to the City Engineer for report.
Clifford Hunt presented. an a.pvlication for permission to
use the Council Chamber on Thursday nights for the formation and
meetings of a Townsend Old Age Revolving Pension Club. On motion of
Councilman Claire, seconded by Councilman Garfield. and carried, the
same was .allowed until further notice.
A letter from Sarah B. Newcomb regarding Tidelands Location
No. 267, in which an offer to sell the same to the City of New port
Beach was read, and on motion of Councilman Claire, seconded by
Councilman Gordon and carried, the matter was referred to the City
Attorney.
UNFINISHED BUSINESS
City Attorney Thomoson reported on the Delinquent Tax Ordinance,
advising that final passage of same should be deferred until after the
expiration of the existing moratorium, citing the possibility of same
being invalidated thereby. The Ordinance was presented for the first
reading being designated. Ordinance No. 429 and on motion of Councilman
Claire, seconded by Councilman Gord.on and carried, was passed to the
second reading.
NEW BUSINESS
The monthly demands having been duly audited by the Finance
Committee., were on motion of Councilman Claire, seconded by Councilman
Gordon and carried, allowed and warrants ordered drawn for same.
City Engineer Patterson presented the matter of an extension
of time for the use of a temporary road over property owned by the
Southern Pacific Company at the westerly City limits, whereupon
Councilman Gordon moved that a Resolution be passed authorizing the
Mayor and City Clerk to execute on behalf of the city of Newport Beach
an Agreement between the Southern Pacific Company and the City of Newport
Beach for an extension to May 29, 1935 for the use of a temporary
highc:,ay upon and across a certain parcel of land situated in the vicinity
of Gamewell Station. The motion was duly seconded by Councilman Garfield
a.nd. the Resolution was adopted by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmar.
NOES: Councilmen None.
ABSENT: Councilmen None.

The matter of leasing a certain 93 acres of land owned
by the City of Newport Beach was brought up, Harry C. Fulton an
applicant for the lease addressing the Council in relation thereto,
the use of water for irrigation and kind of crops to be raised. thereon
being discussed.

Councilman Claire moved that Resolution No. 866 authorizing
the Mayor and City Clerk to execute on behalf of the City of Newport
Beach a lease in favor of Harry C. Fulton for a period of nine months,
commencing as of March 1st, 1935 and ending on December 1st, 1935
for the sum of $750.00 for the term. The motion was duly seconded
by Councilman Gordon and the resolution adopted by the following roll
call vote, to —wit:.
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.

There being no further business to come before the Council
a motion to adjourn to 7:30 o'clock P. M. January 21st, 1935 was made
by Councilman Claire, seconded by Councilman Ellsworth and carried.

The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the city of Newport
Beach at 7:30 o'clock P. M. on above date with Mayor Hilmer in the Chair.
The roll was called showing the full Council present.
Mayor Hilmer brought un the matter of SERA clerical help
including a draftsman for the City Planning Commission, also requesting
an appropriation of $25.00 for stationery and other incidentals needed
by the Commission. On motion of Councilman Claire, seconded by
Councilman Garfield and carried, the appropriation was granted.
On motion of Councilman Claire, seconded by Councilman
Gordon, a Resolution was passed authorizing the Mayor to make application
to the SERA organization for assistance in drafting and preparing maps
and other data in connection with the Planning Commission.
The letter from L. A. Cox laid over from a previous meeting,
in which complaint was made against the construction and operation of
rock bunkers situated on the premises of the Bay District Lumber
Company, was considered, Chief of Police Hodgkinson to whom the question
of the existence of a traffic hazard due to the loading of the bunkers
was.referred, reported that inasmuch as the bunkers were not yet in
use and no unloading of rock had yet taken-place it would not be
possible to determine to what extent it would be dangerous to traffic,
suggesting however, that a flagman might be needed during the unloading
of rock into the bunkers.
City Engineer Patterson presented a report regarding the
claim by L. A. Cox that Tenth Street was being permanently blocked by
the bunkers, a survey showing that the bunkers are located 14 feet
southerly of the southerly line of Tenth Street and do not block said
street as contended.
On motion of Councilman Gordon, seconded by Councilman Garfield
and carrieq., the Chief of Police was instructed to interview the owners
of the rock bunkers regarding the possible danger to traffic in the
operation thereof.
