Newport Beach, September 23, 1935•
The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the City of Newport
Beach at 7 :30 o'clock P. M. on above date, with Mayor Hilmer Presiding.
The roll was called showing the full Council present.
REPORTS OF SPECIAL COkILITTEES
The petition of property owners facing 22nd and 23rd Streets
in Blocks 21 and 22 of Newport Beach, requesting that the fire and
business zoning of that section be changed from Zone 1 to Zone 2
restrictions, having been Laid on the Table from the last meeting of
the Council, was brought up. A letter bearing on the subject from
John H. Colton, Engineer of the Board of Fire Underwriters was read,
and on recommendation of the Fire Committee, it was moved by Councilman
Claire, seconded by Councilman Garfield and carried, that the City Attorney
be instructed to prepare the necessary amendment to the Fire and Build-
ing Zoning Ordinance to provide for the extension of Zone No. 2 eastward
to the center line of 22nd Street.
Fire Chief Crocker presented a report on the alleged hazardous
condition on the lots owned by A. C. Stell in Block 132, Corona del Mar,
stating that while the lumber strewn on the premises was Unsightly, no
fire hazard existed. On motion of Councilman Claire, seconded by Council -
man Garfield and carried, the report of the Fire Chief was ordered filed.
Fire Chief Crocker presented a report in connection with the
application of the Union Oil Company for permission to install additional
storage and handling facilities on Lot 3, Block 9, Section 1, Balboa
Island, stating that the matter had been considered at meetings of the
Planning Commission and that on advice from the City Attorney the Zoning
Ordinance affecting that district would need to be amended in order to
permit same. On motion of Councilman Ellsworth, seconded by Councilman
Claire and carried, the report of the Fire Chief was ordered filed.
The Chief ..of Police reported regarding the alleged bill board
nuisance in Corona del Mar, in which he stated that many of the sign
boards have been installed without the necessary permits from the
Building Inspector. It was moved by Councilman Claire, seconded by
Councilman Gordon and carried, that the Chief of Police notify the
owners of the signs illegally installed regarding the requirements of
the City Ordinance.
REPORTS OF STANDING COMMITTEES
Councilman Claire, Chairman of the Finance Committee, reported
on the matter of renewal of fire insurance policies, referred to that
Committee, suggesting a re- appraisal of the insured properties in question
before renewing the insurance policies, the same to be considered at the
next meeting of the Council.
COkk,UNICATIONS
The communication of the Chief of Police regarding the case of
the City of Newport Beach versus H. D. Cowan, of the Cowan Fixture Company
for failure to secure the necessary contractor's license before doing
certain work in Balboa, advised that the case had been tried, the defend-
ant found guilty and that the case had been appealed, a bond having been
posted pending same.
A. H. Dixon's communication concerning the payment by the
City for ambulance calls ordered by the Police Department for injured
persons and asking that a fund ie set aside to care for same, was read.
On motion of Councilman Gordon, seconded by Councilman Garfield and
carried, an amount of fifty dollars per year was appropriated to care
for ambulance calls ordered by the Police Department.
UNFINISHED BUSINESS
The application of Chas. A. Beecher for permission to install
floats fronting on portions of Lots L and M, Tract 919, having been laid
over from a previous meeting, was brought up, Mr. Beecher addressing the
Council concerning the matter. On motion of Councilman Claire, seconded
by Councilman Gordon and carried, permission was granted, subject to the
approval of the War Department.

A quitclaim deed from the City of Newport Beach to Edward D.
Garratt conveying all that real property situated in the City of Newport
Beach, County of Orange, State of California, described as follows:
Lot twenty-five (25), Block seventeen (17), Section Three (3),
Balboa Island, as recorded in Book 7, Page 15, Miscellaneous
Maps, records of Orange,County, California.
was presented. The adoption of a resolution authorizing the Mayor and
'City Clerk to execute the above deed on behalf of the City was moved by
Councilman Claire, seconded by Councilman Gordon and passed by the
following vote, to -wit:
AYES: Councilmen: Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen: None.
ABSENT: Councilmen: None.
I, Frank L. Rinehart, City Clerk of the City of Newport Beach,
do hereby certify that the above resolution was-adopted by the City
Council of the City of Newport Beach at a regular adjourned meeting held
by said City Council on the 23rd day of September 1935, and that the
above is a true extract from the mutes of paid meeting.

records of Orange County, California,
was presented. The adoption of a• resolution authorizing the Mayor and

Councilman Claire, seconded by Councilman Garfield and passed by the
following vote, to -wit:

Council of the City of Newport Beach at a regular adjourned meeting held

Uity ulerx of the City of Newport Beach, Cal,
City Attorney Thompson brought up the matter of certain Ocean
Frontage assessed to Fred E. Keeler and described as follows:
Westerly 20' of Lot 13 -A; Lot 14 -A; Lot-15 -A, and the Easterly
20' of Lot 16 -A, in Section B,
and asked the Council for authorization to defend the suit in court
respecting the above property. On motion of Councilman Claire, seconded
by Councilman Garfield and carried the City Attorney was authorized to
defend the City in the above suit.
City Engineer Patterson advised that the proceedings pertaining
to the Balboa Island seawall were not ready for presentation and asked
'for authority to employ A. S. konroe to assist in the preparation of
the proceedings. On motion of CouAci.lman Gordon, seconded by Councilman
Garfield and carried the City Engineer was authorized to employ Mr. Monroe
on a per diem basis.
City Engineer Patterson brought up the matter of the assessment
of the proposed Balboa Island seawall and explained to the Council the
manner of making the assessments and the probable amount of same.
ADJOURNkEAT
There being no further:business to come before the Council,
on motion of Councilman Ellsworth, seconded by Councilman Gordon and
carried, an adjournment was 'taken to 7:30 o'clock P. M. September 30, 1935•

On motion of Councilman Ellsworth, seconded by Councilman
Garfield and carried, the regular order of business was suspended
in order to consider the report of the City Engineer respecting
certain proposed improvements, to -wit: the construction of a wooden
bulkhead to protect Channel Road and the construction of a concrete
bulkhead and appurtenances around portions of Balboa Island.
Pursuant to instructions given by Resolution No. 912, adopted
September 16th, 1935, the City Engineer presented Plan No. 399, show-
ing the proposed improvement for the construction of a wooden bulkhead
and appurtenances to protect Channel Road and other property in said
City, and also a map of the proposed assessment district, No. 398,
for consideration by the City Council.
Whereupon, Councilman Ellsworth offered and moved the
adoption of Resolution No. 913, entitled:
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA, DETERMINING
THE NATURE, LOCATION AND EXTENT OF THE PROPOSED
IMPROVEMENT FOR THE CONSTRUCTION OF A WOODEN
BULKHEAD AND APPURTENANCES TO PROTECT CHANNEL
ROAD AND OTHER PROPERTY IN SAID CITY, GENERALLY
DEFINING THE BOUNDARIES OR EXTENT OF THE'DISTRICT
TO BE SPECIALLY ASSESSED TO PAYTHE COST THEREOF:
AND DETERMINING THE STATUTE UNDER WHICH IT IS
PROPOSED TO CONDUCT THE PROCEEDINGS, PURSUANT TO
THE PROVISIONS OF SECTION 2 OF THE "SPECIAL
ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931."
which motion was seconded by Councilman Garfield, and upon roll
call the said Resolution was adopted by the following vote, to -wit;
AYES: Councilmen Gordon, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None:.
ABSENT: Councilmen Claire.
The City Engineer then presented the written report prepared
pursuant to the provisions of Sections 2 and 3 of the "Special
Assessment Investigation, Limitation and Majority Protest Act of
1931 ", and after the reading and examination of said report by the
City Council, Councilman Ellsworth offered and moved the adoption
of Resolution No. 914 entitled:
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, APPROVING THE WRITTEN
REPORT OF THE CITY ENGINEER FOR THE CONSTRUCTION
OF A WOODEN BULKHEAD AND APPURTENANCES TO PROTECT
CHANNEL ROAD AND OTHER PROPERTY IN SAID CITY, HERE-
TOFORE ORDERED PREPARED BY RESOLUTION NO. 912,
ADOPTED ON THE 16TH DAY OF SEPTEMBER, 1935; AND
FIXING THE TIME AND PLACE FOR HEARING ON SAID
ENGINEER'S WRITTEN REPORT, UNDER THE PROVISIONS OF
THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931."
