Newport Beach, March 15, 1937.
The City Council of the City of Newport Beach met 'in adjourned
regular session in the City Council Chambers, at the City Hall in the City
of Newoort Beach at 7:30 o'clock P. M. on above date with Mayor Williamson
presiding.
The roll was called and the following answered present: Councilmen
Gordon, Claire, Whitson, Williamson. Absent, Councilman Garfield.
REPORTS OF SPECIAL COMMITTEES
Councilman Gordon reported on the matter of adjusting the bait
concession rental on the Newoort pier with the tenant George Hiner, and
recommended and moved that the City allow said tenant one year's additional
rental for making the necessary repairs to the pier power line plus ten
dollars per month, and that the City Attorney be instructed to draw the
necessary contract in connection therewith. The motion was seconded by
Councilman Claire and carried.
REPORTS OF STANDING COW1MITTEES None.
COMMUNICATIONS
The application of Caroll Kaler and others for licenses to
operate shooting galleries of various types in the Balboa section, were
on motion of Councilman Claire, seconded by Councilman Whitson and
carried, referred to the Chief of Police for investigation and report.
The application of John Beddome for a license to conduct a cafe
and cocktail lounge in the Elliott Building, 22nd Street and Ocean Front,
was on motion of Councilman Claire, seconded by Councilman Whitson and
carried, allowed subject to the approval of the health officer.
The communjcation of J. E. O'Donnell requesting a re- zoning of
Block 10, Seashore Colony Tract in order to hermit the operation of a cafe
and auto court, was on motion of Councilman Whitson, seconded by Council-
man Claire and carried, referred to the Planning Commission.
The letter of J. A. Flaws protesting the proposed re- zoning of
a section in the vicinity of 15th Street in order to permit the operation
of a boat rental pier, was read, and on motion of Councilman Whitson,
seconded by Councilman Claire and carried, referred to the Planning
Commission.
The petition presented by John Vogel and others requesting a
change in the'building restrictions effecting the business district of
Balboa, was on motion of Councilman Claire, seconded by Councilman Whitson
and carried, referred to the City Attorney with instructions to prepare
an amendment to the Building Ordinance.
On motion of Councilman Claire, seconded by Councilman Whitson
and carried, the applications for lidenses to operate shooting galleries
were ordered filed and the City Clerk directed to notify the applicants
that due to the Zoning restrictions the same had been denied.
George Nolan addressed the Council concerning his application
for a. general business license for the Nolan Sales System, and on motion
of Councilman Claire, seconded by Councilman Gordon and carried, the City
Clerk was instructed to inform the applicant as to the proper form to use
in making the application.
The application of Harry Read for a license to operate Dower
skooters -on the public streets, was on.motion of Councilman Claire,
seconded by Councilman Whitson and carried, denied.
The petition presented by Dr. Ho -ard Seager, Chairman of the
Balboa Island Seawall Committee, requesting additional lighting standards
for the Seawall project, was on motion of Councilman Claire, seconded by
Councilman Whitson and carried, referred to the City Engineer with Instruc-
tions to prepare the preliminary report. Dr. Seager addressed the Council
in connection with the matter.
The letter of the Harbor Master in referrence to certain boats
being moved from their regular moorings to slips outside the City limits
for the purpose of evading taxation by the City, was on motion of Council-
man Claire, seconded by Councilman Whitson and carried, ordered filed
and the City Assessor ordered to assess the boats as if still being
within the City limits.

The letter of the Harbor Master requesting the establish-
ment of a "Bone Yard" for old derelict boats, was on motion of Council-
man Claire, seconded by Councilman Whitson and carried, referred to
the Harbor and City Engineer for report as to the cost of moving
said boats. ,
The letter of the Harbor Master regarding the many requests
for receivers for live bait and advised that some regulation should
be provided in relation to same. Robert E. Graff and W. R. Fowler
each addressed the Council.on the necessity of providing live "bait
for sport fishermen. Whereupon it was moved by Councilman Whitson,
seconded by Councilman Claire and carried, that the Harbor Master
take the matter uo with the U. S. District Engineer for approval
of the location for Bait Receivers and after which to report to the
Council.
The resignation of Mrs. Chloe Wilson as a member of the
Library Board was read, and on motion of Councilman Whitson, seconded
by Councilman Gordon and carried, the same was laid on the table.
City Engineer Patterson reported on the request of August
Hansen for an extension of 20th Street northerly to the Bay, and
presented an estimate of the cost of same, and after discussing the
matter, it was moved by Councilman Claire, seconded by Councilman
Whitson and carried, that the Street Superintendent be authorized
to proceed with the work with the exception of the wooden bulkhead,
same to be eliminated.
City Attorney Thompson presented an ordinance, being an
Emergency Ordinance for the prevention of promiscuous drinking of
alcoholic beverages on the public streets and in public places.
Whereupon it was moved by Councilman Claire that an emergency exists
from the fact that the morals of the younger generation are being
corrupted by the drinking of alcoholic liquors openly upon the public
streets and sidewalks and that life and property are endangered from
empty bottles thrown thereon. The motion was duly seconded by Council-
man Whitson and the motion was carried by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
City Attorney Thompson then presented the ordinance, being
an Emergency Ordinance necessitated by the facts set forth above by
more than a two thirds vote of the City Council. The ordinance was
considered, designated Ordinance No. 452, the adoption of which was
moved by Councilman Claire, duly seconded by Councilman Whitson.and
was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
UNFINISHED BUSINESS
The application of E. M. Harvey for permission to construct
a pleasure pier fronting on Lot 33, Tract 742, having been approved
by the City Engineer, was on motion of Councilman Claire, seconded
by Councilmen Whitson and carried, allowed.
The application of Robert E. Graff for permission to construct
floats fronting on a Dortion of Lot H, Tract 919, having been approved
by the City Engineer, was on motion of Councilman Claire, seconded by
Councilman Whitson and carried, allowed.
NEW BUSINESS
Mrs. Margaret Burlingame addressed the Council at length
regarding the Library Board not functioning properly and suggested
that women should comprise a majority of the Library Board.
The demand of the Bay District Lumber Comoany having been
duly audited by the Finance Committee, was on motion of Councilman
Claire, seconded by Councilman Gordon and-carried, allowed and a
warrant ordered drawn for same.

RESOLUTION NO. 1075. Whereas, Francis T. Stanbury and Eleanor
A. Stanbury, husband and wife, have this day offered to the City of
Newport Beach, the sum of $150.00 for Lot 2, Block 140, River Section,
In the city of Newport Beach, as shown on Plop recorded in Book 4, page
25 of Map Books, records of Orange County, California; and
Whereas, the said price is a fair and adequate price as and
for the purchase price of said lot; and
Whereas, the City Council of the City of Newport Beach deem
that it is for the best interests of said City that said property be
sold for the said sum of $150.00; and
Whereas, the price offered is just, fair and adequate and is
' not disproportionate to the real value of the property above described.
Now, Therefore, Be It Resolved: That said Droperty be sold
to the said Francis T. Stanbury and Eleanor A. Stanbury, for the sum
of $150.00, free and clear of all encumbrances, except second Install-
ment of taxes for the fiscal year 1936 -37, and unpaid improvement
assessments of record. Also subject to conditions, restrictions and
reservations of record.
Be it further resolved: That the sum of $25.00 be paid to
Lew H. Wallace, as and for his commission for the negotiating of the
sale of said real property to Francis T. Stanbury and Eleanor A. Stanbury,
his wife, as joint tenants, said sum being a fair and reasonable
commission to be allowed in said sale, and said broker being a licensed
realtor of the city of Newport Beach.
I hereby certify that the above and foregoing Resolution was
duly and regularly passed and adopted by the City Council of the City
of Nevroort Beach at an adjourned regular meeting thereof held on the
15th day of March, 1937, by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.

Councilman Claire moved the adoption of a resolution directing
the City Engineer'to proceed with certain improvements in the City Camp
Grou.nds,and authorizing an appropriation of an amount not to exceed
ten thousand dollars for the project. The resolution, which was desig-
nated Resolution No. 1076, the motion for adoption of same being seconded
by Councilman Whitson and was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
On motion of Councilman Claire, seconded by Councilman Whitson
and m rried, the City Engineer was authorized to employ a Head Carpenter
'to supervise the Camp Ground improvements at a wage of eight dollars per
day.
RESOLUTION NO. 1077. A Quitclaim Deed dated the 11th day of
March, 1937, from Bank of Balboa, a corporation, to the city of Newoort
Beach, a Municipal corporation of the sixth class, remising, releasing
and quitclaiming to the City of Newport Beach all that certain real
property situated in the city of Newport Beach, County of Orange, State
of California, and more particularly described as follows: Lots four
'(4) and five (5) in Block 233, of the Lake Tract, Newport Beach, as shown
on map recorded in Book 4, page 13 of Miscellaneous Maps, Records of
Orange County, California, was presented to the City Council of the city
of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded by
Councilman Whitson and carried, that said quitclaim Deed be accepted, and
that the City Clerk of the city of Newport Beach be instructed to record
the same for`tkiwith with the County Recorder of Orange County, California.
That said motion was carried by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.

Councilman Claire moved the adoption of a resolution, being
a resolution authorizing the Mayor and City Clerk to execute on
behalf of the City of Newport Beach, a contract with E. V. S. Pomeroy
for the purchase of garbage collected by the City. The resolution
was designated Resolution No. 1075, the motion for adoption being
duly seconded by Councilman Whitson and same was passed by the
following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
RESOLUTION NO. 1079. Whereas, William Hamilton and Verna.
Mae Hamilton, husband and wife, "as joint tenants with the right of
survivorship, have this day offered to the city of Newport Beach, the
sum of $155.00 for Lot Eleven (11) in Block 139, of "Canal Section,
Newport Beach. ", as shown on a Map 'recorded in Book 4, page 95 of
Miscellaneous Maps, Records of Orange County, California; and
Whereas, the said price is a fair and adequate price as
and for the purchase price of said lot; and
Whereas, the City Council of the City of Newport Beach
deems that it is for the best interests of said City that said
property be sold for the said sum of $155.00; and
Whereas, the price offered is .just, fair and adequate and is
not disproportionate to the real value of said property above described.
Now, therefore, be it resolved: That said property be sold
to the said William Hamilton a.nd Verna Mae Hamilton, husband and wife,
as joint tenants with the right of survivorship, for the sum of

assessments of record. Also subject to conditions, convenats,
reservations and restrictions of record; and
Be it further resolved: That the sum of$50.00 be paid to
H. 0. Barrett, as and for his commission for the negotiating of the
sale of said real property to William Hamilton and Verna Mae Hamilton,
his wife, as joint tenants, said sum being a fair and reasonable
commission to be allowed in said sale, and said broker being a licensed
realtor of the city of Newport Beach.

Council of the City of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded by
Councilman Whitson and carried, that said Quitclaim Deed be accepted
by said City of Newport Beach, and the Clerk instructed to record the
same forthwith with the County Recorder of the County of Orange, State
of California.
That said motion was carried by the following vote, to -wit:

'RESOLUTION NO. 1090. A Quitclaim deed dated the 6th day of
March, 1937, from Anna Hooten, a. widow, to the City of Newport Beach,
a Municipal corporation of the sixth class, remising, releasing and
quitclaiming to the city of Newport Beach all that certain real
property situated in the city of Newport Beach, County of Orange, State
of California, described as follows: Lots 3, 5 and 7, Block. 734,
Corona Del Mar, as shown on a Mao recorded in Book 3, pages 41 and 42
of Miscellaneous Maps, Records of Orange County, California, was
presented to the City Council of the City of Newport Beach, California.
Whereupon, Councilman Claire made a motion, seconded by
Councilman Whitson and carried, that said Quitclaim Deed by accepted
by said City of Newport Beach, and that the City Clerk be instructed to
record the same forthwith with the County Recorder of Orange County,
California.

RESOLUTION NO. 1091. Whereas, Conant Hurst and Vivian
A. Hurst, his wife, as joint tenants, have this day offered to the
City of Newport Beach the sum of $130.00 for Lot 13, in Block 442,
Corona Del Mar, in the city of Newport Beach, Orange County, California;
and
Whereas, the said price is a fair and adequate price as and
for the purchase price of said lot; and
Whereas, the City Council of the City of Newport Beach
deems that it is for the best interests of said City that said
property be sold for the said sum of $130.00; and '
Whereas, the price offered is Just, fair and adequate and
is not disproportionate to the real value of said property above
described.
Now, Therefore, Be it resolved; That said property be
sold to the said Conant Hurst and Vivian A. Hurst, his wife, as
joint tenants with the right of survivorship for the sum of
$130.00, free and clear of all encumbrances, except second install-
ment of taxes for the fiscal year 1936 -37, and unpaid public
improvement assessments of record. Also subject to conditions,
restrictions and reservations of record; and
Be If further resolved: That the sum of $15.00 be paid
to H. Cardoza Sloan, as and for his commission for the negotiating
of the sale of said real property to Conant Hurst and Vivian A.
Hurst, his wife, as joint tenants, said sum being a fair and
reasonable commission to be allowed in said sale, and said broker
being a licensed rea.ltor of the city of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at an adjourned regular meeting thereof
held on the 15th day of March, 1937, by the following vote,. to -wit:

Nelson Stafford addressed the Council regarding the City
ordinance respecting florists, complaining of certain restrictions
contained therein.

an amendment to the Zoning Ordinance in compliance with commendations
for re- zoning certain.sections of Balboa Island.
