The report of the City Treasurer was read, and on motion
of Councilman Claire, seconded by Councilman Gordon and carried
the report was accepted, the reading of reports of other Heads
of Departments dispensed with, and all the reports ordered filed.

COMMUNICATIONS
The application of Al Anderson for permission to construct
a pier fronting on Block B. Bayside Tract, was on motion of Council-
man Claire, seconded by Councilman Gordon and carried, referred to
the City Engineer.
The application of Paul Whittier to construct a pleasure
pier fronting on Lots 20, 21 and a portion of 22, in Block P, Tract
515, was on motion of Councilman Gordon, seconded by Councilman
Claire and carried, referred to the City Engineer.
The application of R. L. Willets for permission to construct
a pleasure pier fronting on a portion of Block D, Corona. del Mar,
was on motion of Councilman Gordon, seconded by Councilman Claire
and carried, referred to the City Engineer.
The application of Walter W. Ralphe for permission to
construct a pleasure pier fronting on Lot 2, Block 10, Tract 626,
having been approved by the City Engineer, was on motion of
Councilman Claire, seconded by Councilman Whitson and carried,
allowed.
The application of Currie Ice Cream Company for a license
to operate a "Skee Ball" game in the Macculloch Building, 115 Main
St., Balboa, was on motion of Councilman Claire, seconded by Council-
man Whitson and carried, referred to the Chief of Police for report.
The application of Carol Kaler for a license to operate
a "Milk Bottle" game at 107 Palm Street, was on motion of Councilman
Claire, seconded by.Councilman Whitson and carried, allowed subject
to the approval of the Chief of Police.
The appltati -on of H. T. Calhoun for a license to operate
a bakery at 1107 Coast Highway, Corona del Mar, was on motion of
Councilman Claire, seconded by Councilman Whitson and carried, allowed
subject to the approval of the Health Officer.
The request of G. W. Kitzmiller for a transfer of a Real
Estate license from 213 Marine Avenue to 210 Marine Avenue, Balboa
Island, was on motion of Councilman Claire, seconded by Councilman
Whitson and carried, allowed.
The request of Borter & Russell for a transer of Archery
license from Palm & Bay Avenue to the Balboa Pavilion, was on motion
of Councilman Claire, seconded by Councilman Whitson and carried,
allowed.
The application of Borter & Russell for a license to
operate a Rifle Range in the Balboa Pavilion, was on motion of
Councilman Claire, seconded by Councilman Gordon and carried, denied,
due to Zoning restrictions.
The application of W. Paul Butler for a license to operate
a motor glide rental at 610 Bay Avenue, Balboa, was on motion of
Councilman Gordon, seconded by Councilman Claire and carried, referred
to Chief of Police and the City Attorney for report.
The communications of L. W. Briggs, Secretary of the
Planning Commission relating to recommendations of that body against
the re- zoning of certain property lying westerly of 15th Street for
the operation of a boat rental business and in favor of the application
of 0. F. Rehnborg to operate a laboratory at 210•_Marine Avenue, Balboa

Island were presented, and on motion of Councilman Claire, seconded
by Councilman Whitson and carried, the same were ordered filed.
The petition of L. H. Cramer and other plumbers requesting
the appointment of Sam Sinsfather and M. C. Smith on the City Plumbing
Examination Board to succeed J. H. Estus and Roy Shafer, was-presented.
Whereupon Mayor Williamson appointed said Sam Kinsfather and M. C.
Smith to serve on the Plumbing Examination Board, and on motion of
Councilman Claire, seconded,by Councilman Whitson and carried, the
appointments were confirmed.
The letter of Mrs. George Leavitt complaining of the
condition of the alley between Central Avenue and the Ocean Front,
was on motion of Councilman Claire,, seconded by Councilman Whitson
and carried, referred to the Street Committee for report.
The request of Judge W. A. Lenard for a leave of absence
for 30 days, was on motion of Councilman Claire, seconded by Council-
man Gordon and carried, allowed., at full salary.
The request of Fire Chief Crocker for permission to attend
the annual Aquatic Conference of the Southern California Public
Beach Committee, was presented, and on mciion of Councilman Claire,
seconded by Councilman Gordon and carried, ordered filed.
On motion of Councilman Claire, seconded by Councilman
Whitson and carried, the request of E. G. Greeley for renewal of
contract for the City Dump Ground privileges was referred to the
City Attorney with instructions to prepare the necessary articles
of agreement and the Mayor and City Clerk were authorized to execute
same on behalf of the City of Newport Beach. Resolution No. 1110.
UNFINISHED BUSINESS
The resignations of Lottie Summers and Chloe L. Wilson
as members of the Library Board, laid over from a previous meeting,
were on motion of Councilman Claire, seconded by Councilman Whitson
and carried, accepted. Whereupon Mayor Williamson appointed Mrs.
F. King Joslyn to succeed Mrs. Chloe L. Wilson and Mrs, Ida Deakins
to succeed Mrs. Lottie Summers as members of the Library Board.

OF A STEEL SHEET PILE BULKHEAD ADJACENT TO
THE EASTERLY LINE OF BLOCK P OF TRACT NO.
518 IN THE CITY OF NEWPORT BEACH, CALIFORNIA.
HEARING ON PROTESTS UNDER THE
"SPECIAL ASSESSMENT INPESTIGA-
TION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931," AS AMENDED.
Date: April 5th, 1937•
The Clerk reported that this was the time and place fixed
for the hearing on the written report heretofore filed by the
City Engineer and approved by the City Council of 1 he City of
Newport Beach, in accordance with the provisions of the "Special
Assessment Investigation, Limitation and Majority Protest Act.
of 1931," as amended, to -wit: Monday, the 5th day of April, 1937,
being the day, and the Council Chamber in the City Hall of said
City being the place, fixed for said hearing.
The Clerk also reported that on the 25th day of February,
1937, he deposited in the United States mails, the postage pre-
paid, a notice of the time and place of hearing upon said written
report, all in the manner and form required by Section 6 of the
said Act, and that an affidavit in proof of such mailing is now
on file in the office of the City Clerk; and more than thirty (30)
days having elapsed since the date of said mailing, the said City
Council has acquired power to proceed with the hearing in said
matter pursuant to said Act. ,
The Mayor, being the presiding officer of the City Council,
then announced that the first order of the hearing would be the
reading of the sabi written report, except as to the map, plat
or diagram, and the assessed valuations and true valuations of
and assessments and estimated assessments upon the individual
parcels of land, before protests were considered.

Whereupon, the Clerk read the said written report so
defined by the Mayor.
The Mayor then inquired of the Clerk whether any written
protests or objections to the doing of the things proposed in
said written report had been filed with him in said mentioned
matter. The Clerk reported that no written protests had been
filed with him prior to the time set for said hearing.
The Mayor then inquired if any persons who would be
entitled to protest or object to the doing of the things proposed
to be done desired to make oral protests of objections and
stated that such persons would now be heard. No one responded.
After some discussion by the members of the City Council,
and considering the report of the City Engineer, Councilman Claire
offered and moved the adoption of the following resolution,
which said mo ion was seconded by Councilman Whitson and carried
by the roll call as shown in said resolution:
IN THE MATTER OF THE PROPOSED

TRACT NO. 519 IN THE CITY OF
NEWPORT BEACH.
WHEREAS, the City Council of the City of Newport Beach,
California, did on the 23rd day of February, 19379 pursuant
to statute, approve the written report prepared and filed by
the City Engineer of said City, in accordance with the provisions
of that certain Act of the Legislature of the State of California,
known as the "Special Assessment Investigation, Limitation and
Majority Protest Act of 1931," as amended, and did on said date
fix Monday, the 5th day of April, 1937, at the hour of seven
thirty (7:30) o'clock P.M. as the day and hour, and the Council
Chamber in the City Hall in said City of Newport Beach as the
place of hearing on such report; and
WHEREAS, the City Clerk of the said City of Newport Beach
thereafter deposited in the United States mails, with postage
prepaid, a notice of the time and place of hearing upon said
report, all in the time, manner and form required by said Act;
NOW, THEREFORE, BE IT RESOLVED, that the City Council
ofthe City of Newport Beach hereby finds and determines as
follows:
(1) That protests in writing have not been filed by the
owners (as defined in the "Improvement Act of 1911 ") of a
majority of the area of the lands to be assessed within the
proposed assessment district, as said district is defined in
said written report.
(2) That the aggregate special assessment liability on
the lands proposed to be assessed for such improvement, as such
liability is shown in said preliminary written report, will
exceed twenty -five (25) per cent of the true value of all the
lands to be so assessed, as said true value is defined in said
Act.
(3) That the estimated proposed assessment to be levied
for the proposed improvement against each parcel proposed to be
assessed therefor, will exceed twenty -five (25) per cent of
the said true value of such parcels.
AND BE IT FURTHER RESOLVED, that the said City Council
hereby finds and determines that the proposed improvement is
feasible, and that the lands proposed to be assessed to pay
the costs and expenses thereof, in the opinion of the said
City Council, are able to carry the burden of such proposed
assessment by reason of the fact that after said improvement
is completed as proposed, the use of the lands in the proposed
assessment district will be greatly benefited, to the extent
that when said improvement is made the said lands can then
be utilized for buildings or other improvements, and also will
be free from the tides or overflow by water.

OALIFORNIA.
On motion of Councilman Claire, seconded by Councilman
Gordon and carried, the demand in connection with sewer contract of
the Drainage Construction Company was allowed and warrant ordered
drawn for same.
The monthly demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire, seconded by Councilman
Whitson and carried, allowed and warrants ordered drawn for same.
On motion of Councilman Claire, seconded by Councilman
Whitson and carried, the Street Superintendent was directed to grade
and oil the alley between 30th and 36th Streets.
On motion of Councilman Claire, seconded by Councilman Whitson
and carried, anc.ordinance establishing the office of Poundmaster, and
defining his duties, fixing the license fees to be paid on dogs, owned
harbored or kept within the corporate limits of the City of Newport
Beach, was passed to the second reading.
The matter of Live Bait Receivers was brought up, and after
considerable discussion it was moved by Councilman Whitson, seconded
by Councilman Claire and carried, that bids be advertised for receiver
locations, same to be approved by the City Attorney, City Engineer and
Harbor Master.
City Attorney Thompson presented a resolution, being a
resolution designated as "Supplement No. 1 to District Map" same
pertaining to and to be, made a part of Zoning Ordinance No. 440.
The resolution was read, considered, designated Resolution No. 1092,
the motion for its adoption being made by Councilman Claire, seconded
by Councilman Gordon and was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
City Attorney Thompson presented Resolution No. 1093, being
a resolution authorizing the sale of Lot 2, Block 140 of Canal Section,
Newport Beach to Francis T. Stanbury and Eleanor A. Stanbury. The
adoption of the resolution was moved by Councilman Claire, seconded by
Councilman Whitson and was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
RESOLUTION N0. 1094.
A Quitclaim Deed dated the 22nd day of March, 1937, from
Sadie E. Heaney, to the City of Newport Beach, a Municipal corporation
of the sixth class, remising, releasing and quitclaiming to the city
.of Newport Beach all that certain real property situated in the City
of Newport Beach, County of Orange, State of California, and described
as follows: Lots 11 and 12, Block 337, River Section,:Newport Beach,
as shown on a Map recorded in Book 4, page 25 of Miscellaneous Maps,
Records of Orange County, California, was presented to the City
Council of the city of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded
by Councilman Whitson and carried, that said Quitclaim Deed be
accepted by the City of Newport Beach, and that the Clerk of the city
of Newport Beach be instructed to record the same forthwith with the
County Recorder of Orange County, California.
That said motion was carried by the fol -owing vote, to -wit:

a Municipal corporation of the sixth class, remising, releasing
and quitclaiming to the city of Newport Beach all that certain real
property situate in the city of Newport Beach, Orange County, California,

Resolution No. 1103 A Quitclaim Deed dated the 29th day

Resolution No. 1104. A Quitclaim Deed dated the 30th day
of March, 1937, f rom Ivy L. Cade, a married woman, to the City of
Newport Beach, a Municipal corporation of the sixth class, remising, '
releasing and quitclaiming to the City of Newport Beach all that
certain real property situated in the city of Newport Beach, Orange
County,'California, and more particularly described as follows:
Lot 10, Block 439, Corona Del Mar, as shown on a Map recorded in
Book 3, pages 41 and 42 of Miscellaneous Maps, Records of Orange
County, California. And Lot 9, Block A, Tract 673, as shown on a
Map recorded in Book 20, pages 17 and 18 of Miscellaneous Maps,
Records of Orange County, California, was presented to the City
Counoil.of the Oity of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded

City Attorney Thompson presented an ordinance, being an
ordinance amending Orainance No. 310 by adding a new section thereto
known as Section 11 A. The Ordinance was considered and on motion of
Councilman Claire, seconded by Councilman Whitson and carried, was
referred to the Fire and Water Committee and the Fire Chief for
recommendation, and passed to the second reading by the following
vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.

City Attorney Thompson presented Resolution No. 1105, being
a resolution authorizing the sale of Lot 4, Block 233, Lake Tract,
to H. F. Butler and Mary Ann Butler. The adoption of the resolution
was moved by Councilman Claire, seconded by Councilman Whitson and
was passed by the following vote, to -wit:

Resolution No. 1106, being a resolution authorizing the .
Mayor and City Clerk to execute on behalf of the City of Newport Beach
an extension of a license agreement between said City and George C.
Hiner to September 30, 1935 for the Newport Pier Bait Concession.
The adoption of the resolution was moved by Councilman Claire,
seconded by Councilman Whitson and was passed by the following vote,
to -wit:

Councilman Gordon presented and moved the adoption of
Resolution No. 1107, being a resolution authorizing the appropriation
of $750.00 for the purpose of contributing towards the cost of making
a survey and study of beach erosion in cooperation with the United
States Beach Erosion Board, and the County of Orange. The motion was
seconded by Couucilman Claire and same was passed by the following
vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
City Engineer Patterson reported on the matter of additional
lighting standards for the Balboa Island Seawall as petitioned for by
residents of that district, and recommended that same be done without
' the formation of an assessment distruct due to excessive work involved
thereby and suggested that funds be raised in part by the Island
property owners and the City. Dr. Howard Seager also addressed the
Council concerning the subject. On motion of Councilman Claire,
seconded by Councilman Whitson and carried the matter was referred to
a committee to be appointed by the Mayor.
Jaynor Graves addressed the Council concerning a license for
the operation of a "Servi- CyclePO rental, and on motion of Councilman
Claire, seconded by Councilman Whitson and carried, the matter was
referred to the City Attorney and Chief of Police for irsrestigation
and report.
Robert E. Graff addressed the Council concerning the Live
Bait Receivers.
Dr.a.Ludlow Haight addressed the Council in regard to the
dredging of the Grand Canal on Balboa Island.
L. W. Briggs addressed the Council concerning the proposed
change in the Building Ordinance in the Balboa section.
T. G. Elz addressed the Oouncil and requested that Marcus
Avenue be improved in order to permit residents there to reach their
property and advised that the residents would be willing to bear a
portion of the cost.
Harry Hyde addressed the Council in connection with the
proposed change in the Building Ordinance effecting the Balboa section

The City Council of the City of Newport Beach met in adjourned
regular session in the City Council Chambers at the City Hall in the
City of Newport Beach at 7;30 ooclock P. M. on above date with Mayor
Williamson in the Chair.
The roll was called and-the following answered present,
Councilmen Gordon, Claire, Whitson, Williamson, Absent, Councilman
Garfield.
REPORTS OF SPECIAL CORIT?ITTEES
Mayor Williamson reporting on the proposed ordinance regard-
ing certain changes in building; restrictions in the Balboa district,
advised that the Board of Underwriters representative would be unable
to be present until the following Wednesday. Whereupon it was moved
by Councilman Whitson, seconded by Councilman Gordon and carried,, that
the ordinance be laid over until Thursday, April 22, 1937.

on motion of Councilman Claire, seconded-by Councilman Whitson and
carried, allowed subject to the approval of the Health Officer.
The application of Emily Bergey for a license to operate a,
restaurant at 2 ?_1 - 19th Street, was on motion of Councilman Claire,
seconded by Councilman Whitson end cs.rried, allowed subject to the
approval of the Health Officer.
The application of Jane Manchester for a license to operate
a grocery and restaurant at 1708 East Central Avenue, was on-notion of
Councilman Whitson, seconded by Councilman Claire and carried, allowed
subject to the approval of the Health Officer.
The application of C. E. Brinkman for a license to operate
Ray- O -Lite Rifle Ranges in-various locations, was on motion of Council-
man Claire, seconded by Councilman Whitson and carried, allowed subject
to the approval of the Chief of Police.
The application of J. A. Thomas for nermission-to construct
a pleasure pier fronting on Lot 34, Tract 742, was on motion of Council-
man Claire, seconded by Councilman Gordon and carried, referred to the
City Engineer for approval.
The application of Hale Paxton for permission to construct
a pleasure pier fronting on Lot 851, Tract 907, Lido isle, was on
motion of Councilman Claire, seconded by Councilman Gordon and
carried, referred to the City Engineer for approval.
The letter of F. M. Strowbridge requesting information
upon what lasis an arrangement could be made whereby the land embraced
in Tract No. 1011 could be connected with the new sewer system now
being installed adjacent to said tract. On motion of Councilman
Gordon, seconded by Councilman Claire and carried, the matter was
laid on the table pending a conference with other applicants for
sewer service.
The letter of Herbert W. Packard complaining of dog nuisances
and noisy night bathers at the Bay end of Montero Street, was on motion
of Councilman Claire, seconded by Councilman Gordon and carried,
referred to the Chief of Police.
