Councilman
Newport Beach, April 19, 1937.
The City Council of the City of Newport Beach met in adjourned
regular session in the City Council Chambers at the City Hall in the
City of Newport Beach at 7:30 o'clock P. M. on above date with Mayor
Williamson in the Chair.
The roll was called and-the following answered present,
Councilmen Gordon, Claire, Whitson, Williamson, Absent, Councilman
Garfield.
REPORTS OF SPECIAL COD,7ITTEES
Mayor Williamson reporting on the proposed ordinance regard-
ing certain changes in building restrictions in the Balboa district,
advised that the Board of Underwriters representative would be unable
to be present until the following Wednesday. Whereupon it was moved
by Councilman Whitson, seconded by Councilman Gordon and carried, that
the ordinance be laid over until Thursday, April 22, 1937.
REPORTS OF STANDING CO1.06I`PTEES None.
COMMUNICATIONS
The application of Mrs. Margaret Parkes for a license to
operate a Die shoo in the Fairfield Building, 807 East Bay Ave., was
on motion of Councilman Claire, seconded-by Councilman '!Whitson and
carried, allowed subject to the approval of the Health Officer.
The application of Emily Bergey for a license to operate a.
restaurant at 221 - 19th Street, was on motion of Councilman Claire,
seconded by Councilman 'Whitson and carried, allowed subject to the
approval of the Health Officer. -
The application of Jane Manchester for a license to operate
a grocery and restaurant at 1708 East Central Avenue, was on'motion of
Councilman Whitson, seconded by Councilman Claire and carried, allowed
subject to the approval of the Health Officer.
The application of C. E. Brinkman for a license to operate
Ray -O -Late Rifle Ranges in-various locations, was on motion of Council-
man Claire, seconded by Councilman Whitson and carried, allowed subject
to the approval of the Chief of Police.
The application of J. A. Thomas for oermission to construct
a pleasure pier fronting on Lot 34, Tract 742, was on motion of Council-
man Claire, seconded by Councilman Gordon and carried, referred to the
City Engineer for aonroval.
The application of Hale Paxton for oermission to construct
a pleasure pier fronting on Lot 851, Tract 907, Lido Isle, was on
motion of Councilman Claire, seconded by Councilman Gordon and
carried, referred to the City Engineer for approval.
The letter of F. M. Strowbridge requesting information
upon what 'a,sis an arrangement could be made whereby the land embraced
in Tract No. 1011 could be connected with the new sewer system now
being installed adjacent to said tract. On motion of Councilman
Gordon, seconded by Councilman Claire and carried, the matter was
laid on the table pending a conference with other applicants for
sewer service.
The letter of Herbert W. Packard complaining of dog nuisances
and noisy night bathers at the Bay end of Montero Street, was on motion
of Councilman Claire, seconded by Councilman Gordon and carried,
referred to the Chief of Police.

The request of R. R. Bixler for exemption from license charges
for the sale of home grown flowers was oresented, and upon advice from
the City Attorney that home grown products did not apply to flowers, it
was moved by Councilman Claire, seconded by Councilman Whitson and
carried, that the request be denied.
The written opinion of City Attorney Thompson ruling adversely on
the right of the City to set up a fund for the purpose of building a
City Hall by adding a certain amount yearly to the tax levy, was presented,
and upon motion of Councilman Claire, seconded by Councilman Gordon and
carried, the ruling was ordered filed.
The communication of L. W. Briggs, Secretary of the Planning
Commission, relating to the use of a building located at Lot 15, Block
26, Eastside Addition to Balboa, being used for business purposes
contrary to Zoning restrictions was presented, and on motion of Councilman
Claire, seconded by Councilman Gordon and carried, the same was referred
to the Chief of Police for investigation and report.
The letter of L. W. Briggs, Secretary of the Planning. Commission,
advising the Council of the joint meeting of the City Council and the
Planning Commission at 7:30 P. D.R. April 27, 1937 for the purpose of
reviewing the.Major Traffic Plan, was presented and on motion of Council-
man Whitson, seconded by Councilman Gordon and carried, the City Clerk
was instructed to notify Mr. Briggs that said dated would be agreeable
to the Ciaty Council.
City Engineer Patterson presented a written reoort regarding the
sanitary sewer system on Harbor Island, advising that same had not been
connected to the City system since November 1935, and on motion of
Councilman Claire, seconded by Councilman Gordon and carried, the reoort
was ordered filed.
The letter of Albert Launer, Secretary of the Orange County
League of Municipalities advising of the meeting of that body on April
22nd was read, and on motion of Councilman Claire, seconded by Councilman
Whitson and carried, the City Clerk was instructed to advise the number
attending from this City and the letter ordered filed.
The letter of Albert Launer requesting that the City forward a
protest to the State Senator from this District opposing the enactment
of Assembly Bill No. 1467 relating to the exemption of non - resident

wholesalers '•.vas read, and on motion of Councilman Claire, seconded by
Councilman Gordon and carried the matter was laid on the table.
The communication of E. C. Johnson, Chief Engineer of the Pacific
Electric Railway Company, in connection with the opening of Orange Street
a.croers the Railway Company's tracks was presented, and on motion of
Councilman Claire, seconded by Councilman Whitson and carried., the same
was ordered filed.
The petition of certain Dronerty owners on Balboa. Island
requesting that the City plant suitable flowers in the parkways on Park
Avenue was Dresented, and after some discussion it was moved by Councilman
Claire, seconded by Councilman Gordon and carried, that the request be
complied with In an amount not to exceed fifty dollars.
The joint report of the City Attorney and Chief of Police
pertaining to the application of W. Paul Bltler for a license to operate
a motor glide.business in the City.and recommending against the issuance
of said license was presented, and on motion.of Councilman Gordon,
seconded by Councilman Claire and carried, the application was denied.
The joint report of the City Attorney end Chief of Police
regarding the application of Charles McFarland for a license to operate
a "Servi- Cycle" rental in the City and recommending against the issuance
of said license was Dresented, and on motion of Councilman Gordon,
seconded by Councilman Claire and carried, the application was denied.
The Council was addressed by Mrs. Graves on the matter.
The application of Carroll Kaler for a license to operate a
' "Milk Bottle Game" at 107 Palm Street, Balboa, was on recommendation
of the Chief of Police, allowed, by motion of Councilman Claire, seconded
by Councilman Whitson and carried.
The application of Currie Ice Cream.Comoany for a license to
operate a "Skee Ball Game" at 115 Main Street, was on recommendation of
the Chief of Police, allowed by motion of Councilman Claire, seconded
by Councilman Whitson and carried.
The request of Councilman Garfield for a leave of absence for
30 days during the month of May, was on motion of Councilman Claire,
seconded by Councilman Gordon and carried, allowed.
On motion of Councilman Claire, seconded by Councilman Gordon
and carried, the Mayor and Council were authorized to represent the City
of Newport Beach at the Ramona Pegeent to be held in Hemet and an
appropriation of twenty - dollars from the Advertising Fund approved to
defray expenses of same.
U14FINISHED BUSINESS
Pursuant to instructions heretofore given by the City Council,
the City Engineer presented Plan No. 403 2nd specifications for the
construction of a steel sheet pile bulkhead adjacent to the easterly
line of Block P of Tract No. .518. Whereupon, Councilman Whitson
moved that said Plan and specifications be approved, which motion
was seconded by Councilman Claire and upon roll call was carried by
the following vote, viz:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Councilman Claire offered and moved the adoption of Resolution
No. 1108, txing a Resolution of Intention for the construction of a
steel sheet pile bulkhead adjacent to the easterly line of Block P of
Tract No. 518, which motion was seconded by-Councilman Whitson, and
upon roll call the said Resolution was adopted by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.

Councilman Whitson brought up the matter of making certain
changes in the construction of the Balboa Island Seawall and after
some discussion and upon the ruling of Consultant A. S. Monroe that
the changes could not be made after letting the contract no further action
was taken in the matter.
Councilman Whitson reported on the matter of addition 11ghting
standards for the-Bblboa Island Seawall recommending that the expense
therefor be defrayed jointly by the property owners of the Island and
from the General Fund of the City. On motion of Councilman Claire,
seconded by Councilman Gordon and carried, the report was ordered
filed. Dr. H. W. Seager addressed the Council concerning the add-
itional lighting standards, advising that some 200 signatures had
been secured favoring the plan.
NEW.BUSINESS
Certain demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire, seconded by Council-
man Whitson and carried, allowed and warrants ordered drawn for same.
City Attorney Thompson presented a resolution, being a
resolution authorizing the Mayor and City Clerk to execute on behalf
of the City of Newport Beach a certain Indenture of Lease from the
City of Newport Beach to the Orange County Council of the Boy Scouts
of America for certain City owned lands for recreational purposes.
The resolution was designated Resolution No. 1109, the adoption of
which was moved by Councilman Claire, seconded by Councilman Gordon
and was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson,
NOES; Councilmen None.
ABSENT: Councilman Garfield.
City Attorney Thompson presented a resolution, being a
resolution authorizing the Mayor and City Clerk to execute on behalf
of the City a written license to E. G. Greeley to operate the City
Dumn Ground for a period of one year, upon certain conditions set
forth in a written contract. The resolution was designated Resolution
No. 1110, the adoption of which was moved by Councilman Claire,
seconded by Councilman Whitson and was passed by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire,-Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
City Attorney Thompson presented Resolution No. 1111, being
a resolution offering the City of Newport Beach a certain sum for
Lots 8 and 10, Block 432, Corona del Mar, in the City of Newport Beach
as recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records

of Orange County, California.. On motion of Councilman Claire, seconded
by Councilman Whitson, the resolution was adopted by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT. Councilman Garfield.
Resolution No. 1112. A Quitclaim deed dated the 15th day of
April, 1937, from B. H. Cieck and Ruby E. Cieck, husband and wife, to
'the City of Newport Beach, a Municipal corporation of the sixth class,
remising, releasing and quitclaiming to the City of Newport Beach, all
that certain real property situated in the City of Newport Beach, County
of Orange, State of California, and more particularly described as
follows. Lots 19 and 21, Block 5 9, Corona Del Mar, as shown on a Map
recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records of
Orange County, California. Lots 1 and 3, Block 639 Corona Del Mar,
as shown on a Map recorded in Book 3, pages 41 and 42 of Miscellaneous
Maps, Records of Orange County, California, was presented to the City
Council of the City of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded by
Councilman Whitson and carried, that said quitclaim deed be accented
by the City of Newport Beach, and that the Clerk be instructed to record
the same forthwith with the County Recorder of Orange County, California.
That said motion was carried by the following vote, to -wit.

Municipal corporation of the sicth class, remising, releasing and
quitclaiming to the City of Newport Beach, all that certain real

State of California, and more particularly described as follows:

On motion of Councilman Claire, seconded by Councilman Gordon

and carried permission was granted the "Yankee Patterson Dog and Pony
Show" for one day exhibition under the sponserhip of the Chamber of
Commerce, the matter of location being referred to the Chief of Police.
On motion of Councilman Claire, seconded by Councilman Gordon
and carried, City Attorney Thompson was authorized to sign the complaint
in the case of certain litigation in connection with an agreement with
the Citizens National Trust and Savings Bank of Los Angeles and pertain-
ing to certain properties situated in Corona Del Mar.
Resolution No. 1121 authorizing the Mayor and City Clerk to
execute on behalf of the City of Newport Beach a. contract for furnishing
water to C. C. Hosmer, under certain stipulated conditions, was presented,
and on motion of Councilman Claire, seconded by Councilman Gordon, the
Resolution was adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Resolution No. 1122 authorizing the Mayor and City Clerk to
execute on behalf of the City of Newport.Beach a contract for furnishing
water to The Irvine Comoany, under certain stipulated conditions, was
presented, and on motion of Councilman Claire, seconded by Councilman
Gordon, the Resolution was adopted by the following vote, to -wit:

Resolution No. 1123 authorizing the Mayor and City Clerk to
execute on behalf of the City of Newport Beach a contract for furnishing

Resolution No. 1124 authorizing the Mayor and City Clerk to �
execute on behalf of the City of Newport Beach a contract for furnishing
water to Heinz Kaiser, under certain stipulated conditions, was
presented, and on motion of Councilman Claire, seconded by Councilman

Resolution No. 1125 authorizing the Mayor and City Clerk to
execute on behalf of the City of Newport Beach a contract for furnish- '
ing water to Heinz Kaiser, under certain stipulated conditions, was
presented, and on motion of Councilman Claire, seconded by Councilman
Gordon, the resolution was adopted by the following vote, to -wit:

NOES: Councilmen None.
ABSENT: Councilman Garfield.
Resolution No. 1126 authorizing the Mayor and City 'Clerk to
execute on behalf of the City of Newport Beach a, contract for fu.rnish-
tng water,to J. A. Beek and L. W. Briggs, under certain stinula.ted
conditions, was "resented, and on motion of Councilman Claire,
seconded by Councilman Gordon, the'resol,.xtion was adopted by the
following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
