Newport Beach, May 3o 1937•
The City Council of the City of Newport Beach met in regular
session in the City Council Chambers, at the City Hall, in the City of
Newport Beach at 7:30 P. M. on above date with Mayor Williamson in
the Chair.
The roll was called and the following Councilmen answered
present: Gordon, Claire, Wh�tson,Williamson. Absent: Councilman
Garfield. '
REPORTS OF HEADS OF DEPARTMENTS
The report of the City Treasurer was read, and on motion
of Councilman Claire, seconded by Councilman Gordon and carried,
the report was accepted, the reading of reports of other Heads of
Departments dispensed with, and all the reports ordered filed.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COA1M[TNICATIONS
A petition bearing upwards of 50 names of residents and
property owners of Balboa Island, each subscribing a sum of $1.57
toward the installation of additional lighting standards on the
seawall, and requesting the City to purchase and install the light-
ing standards, was presented. The matter was discussed at length,
Dr. Seager addressing the Council in connection with same. On motion
of Councilman Claire, seconded by Councilman Whitson and carried, the
petition was laid on the table for two weeks.
The application of Charles W. Gross for a veterans's exempt
license to peddle artificial flowers, was on motion of Councilman
Gordon, seconded by Councilman Whitson and carried, allowed.
The application of Al Anderson for a license to operate a
Merry -Go -Round without musle, was on motion of Councilman Claire,
seconded by Councilman Whitson and carried, allowed.
The application of the Shell Oil Company for a permit to
unstall underground storage for the handling of petroleum products
on Lot 4, Block 7, Section 1, Balboa Island, was on motion of
Councilman Claire, seconded by Councilman Whitson and carried,
referred the Fire Committee, Fire Chief and City Attorney for report.
The application of W. C. Gullatt for permission to construct
a commercial pier fronting on a portion of Lot H, Tract 919, was on
motion of Councilman Claire, seconded by Councilman Whitson and
carried, referred to the City Engineer for report.
The petition presented by Darrell King and others protesting
the two hour parking limit on Ocean Front between McFadden Place and
Twenty -Third Street, was read, and on motion of Councilman Claire,
seconded by Councilman Whitson and carried, the request was granted
and the petition ordered filed.
The request of J. C. Bechtold for a taxi zone on Central
Avenue at the corner of Main Street. Balboa, was on motion of Council-
man Claire, seconded by Councilman Gordon and carried, granted.
Whereupon Councilman Whitson moved the adoption of a resolution, being
a resolution amending the Parking Ordinance in order to permit the
taxi zone as granted. The resolution was designated Resolution No,
1130, the adoption of which was moved by Councilman Whitson, duly
seconded by Councilman Gordon and passed by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire, Whits an, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
On motion of Councilman Claire, seconded by Councilman
Gordon and carried, the City Clerk was directed to reply to the
request of Margaret Winchester to the effect that the beach fronting
on the property of the Pasadena Presbyterian Church, Balboa Island,
was public property and that it would be beyond the Council's
jurisdiction to prevent the beach being used by the public.

The communication of Dr. Howard W. Seager, Chairman of the
Balboa Island Improvement Committee, requesting the City Council to
instruct -the Engineer to prepare plans and specifications for steps
to be erected over the seawall, rings for the mooring of boats to
be installed in the seawall, and further recommending against the
re- installation of sand boxes , and that groynes be specified in the
construction of all private pier permits, was read. Considerable
discussion ensured relative to the above items, and on motion of
Councilman Claire, seconded by Councilman Whitson and carried, the
City Engineer was instructed to prepare plans and specifications for
'steps over the seawall, and also for mooring rings to be installed
therein. On motion of Councilman Claire, seconded by Councilman Whitson
and carried, the question of the size of boats to be permitted to moor
along the seawall was referred to the Harbor Master.
On motion of Councilman Claire, seconded by Councilman Gordon,
and carried, the City Engineer was instructed to prohibit the erection
of sand boxes on the Balboa Island beach.
On motion of Councilman Claire, seconded by Councilman Whitson,
and carried, the City Engineer was authorized to compel applicants
for pier permits to install groynes in connection therewith.
On motion of Councilman Claire, seconded by Councilman Whitson
and carried, the communication concerning the above requests was ordered
filed.
UNFINISHED BUSINESS
City Attorney Thompson resented an ordinance, being an emergency
ordinance amending Ordinance No. &28 by adding a new section to same,
said sections to be numbered Section 25a -1 to 28h -1 inclusive. On
motion of Councilman Claire the ordinance was declared an emergency
measure for the immediate preservation of the public peace, health and
safety, within -the meaning of`Section 1 of Article IV of the Constitution,
and due to the fact that the widespread depression many taxpayers have
been unable to pay their taxes or redeem their property from sale to
the City for delinquency, and by permitting redemption without penalties,
many taxpayers will be enabled to redeem their property and restore same
to the tax rolls, thereby adding revenue for the operation and mainten-
ance of government. The motion was duly seconded by Councilman Whitson,
and the fact-of an emergency existing was carried by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
.ABSENT: Councilman Garfield.
Councilman Claire moved the adoption of the emergency ordinance
which was designated Ordinance No. 455 and being duly seconded by
Councilman Whitson, was passed by the following vote, to -wit:
.AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
The ordinance amending Section 16 of Ordinance No. 428 regarding
the publishing of the delinquent tax list, came up for final assage,
the ordinance was read, considered, designated Ordinance No. 46, and on
motion of Councilman Claire, seconded by Councilman Whitson, the same
was adopted by the following vote, -to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
'The application of Walter W. Ralphs for permission to construct
a pleasure pier fronting on Lot 10, Block 2, Tract 626, having been
approved by the City Engineer, was on motion of Councilman Claire,
seconded by Councilman Gordon and carried, allowed.

Councilman Claire moved the adoption of Resolution No. 1131,
being a resolution accepting the offer of Leon E. Yale and Genevieve
E. Yale for the purchase of Lot 24, Block 225, Lancaster Addition,
from the City of Newport Beach. The motion was duly seconded by
Councilman Whitson and the resolution adopted by the following vote,
to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.

Grainger Hyer addressed the Council in connection with the
dredging of the Grand Canal, Balboa Island, suggesting that same
should be done at the City's expense and that groynes as recommended
by the City Engineer should be installed and also that the Contractor
constructing the seawall should.take care of the north end of the
canal. On motion of Councilman Claire, seconded by Councilman
Gordon and carried, the matter was laid on the table until such a
time as the budget for the fiscal year is made up.
The demand of the Dxainage Construction Company for the
payment due for the construction of the sewer system, having been
approved by the Finance Committee, was on motion of Councilman Claire,
seconded by Councilman Gordon and carried, allowed.
The monthly demands having been approved by the Finance
Committee, were on motion of Councilman Claire, seconded by Council-
man Whitson and carried, allowed, and warrents ordered drawn for same.
City Attorney Thompson presented an ordinance, being an
ordinance of the City of Newport Beach amending Section 27 -0 of
Ordinance No. 190, and pertaining to harbor regulations in connection
with the mooring of boats. On motion of Councilman Claire, seconded
by Councilman Whitson, the ordinance was passed to the second reading
by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson;
NOES: Councilmen None.
ABSENT: Councilman Garfield.

City Attorney Thompson presented an ordinance, being an
ordinance amending certain sections of License Ordinance No. 393,
and on motion of Councilman Claire, seconded by Councilman Whitson,'
the ordinance was passed to the second.reading by the following
vote, to -wit:
AYES: Councilmen Gordon, .Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Resolution No. 1132. A Quitclaim deed dated the 7th day of
April, 1937 from Hazel B. Guedel, to the City of Newport Beach, a
Municipal corporation of the sixth clasp, remising, releasing and
quitclaiming to the City of Newport. Beach, all that certain real
property situated in the City of Newport Beach, County of Orange,
State of California, and more particularly described as follows,
to -wit: Lot 5, Block 730, Corona Del Mar, as shown on a Map
recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records
of Orange County, California, was presented to the City Council of
the City of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded
by Councilman Whittson and carried, that said Quitclaim Deed be
accepted by the City of Newport Beach, and that the Clerk be instructed
to record the same forthwith with the County Recorder of Orange '
County, California.
That said motion was carried by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson; Williamson.
NOES: Councilmen None.
ABSENT: Councilman Garfield.

Resolution Mo. 1133. A Quitclaim Deed dated the 9th day of
April, 1937, from James R. Rubey and Alma Rubey, husband and wife,
to the City of Newport Beach, a Municipal corporation (f the sixth class,
remising, releasing and quitclaiming to the City of Newport Beach, all
that certain real property situated in the City of Newport Beach, County
of Orange, State of California, and more particularly described as
follows, to -wit: Lot 49, Block "A ", Tract 673, as shown on a Map
-recorded in Book 20, pages 17 and 19 of Miscellaneous Maps, Records of
Orange County, California, was presented to the City Council of the
' City of Newport Beach, California.
Whereupon, Councilman Claire made a motion, duly seconded by
Councilman Whitson and carried, that said Quitclaim Deed be accepted
by the City of. Newport Beach, and that the Clerk be instructed to
record the same forthwith with the County Recorder of OranF-e County,
California.

Resolution No. 1136, being a• resolution authorzing the
Mayor and City Clerk to execute on behalf of the City of Newport Beach,
a contract with Theodore Robins for the purchase of a 1937 Ford Sedan
for the use of the Police Department, was on motion of Councilman
-Claire, seconded by Councilman Gordon, adopted by the following vote:
to -wit:

NOES: Councilmen None.
ABSENT: Councilman Garfield.
Resolution_No. 1137, being a resolution authorizing the
Mayor and City Clerk to execute on behalf of the City of Newport Beach,
a contract with Theodore Robins for the purchase of a 1937 Ford Truck
for use of the Park Department, was on motion of Councilman Claire,
seconded by Councilman Whitson, adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.
ABSENT: Councilman - Garfield.
Resolution No. 1139, being a resolution authorizing the
Mayor and City Clerk to execute on behalf of the -City of Newport '
Beach an agreement between said City and F. M. Strobridge and
Myrtle E. Strobridge for a certain easement for sewer purposes. On
motion of Councilman Claire, seconded by Councilman Whitson, the
resolution was adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Williamson.
NOES: Councilmen None.

Claude A. Pullen addressed the Council on the various improve-
ments needed in the different sections of the City, and suggested that
immediate action be taken in connection with same.
On motion of Councilman Gordon, seconded by Councilman Claire
and carried, the members of the Council, City Attorney and City Engineer
were instructed to prepare a report-on the various projects needed
throughout the City. Whereupon Mayor Williamson appointed Councilmen
Gordon and Claire to act with the City Engineer and City Attorney in
preparing said report.
The matter of the Live Bait Receivers was brought up, Mr. Barker
of the Pacific Bait Service addressing the Council in regard thereto. An
Application was also presented by A. B. Pickelheimer for a license to
conduct a Live Bait business from Live Bait barges in the Harbor. After
much discussion it was tentatively decided to permit not more than two
Live Bait concessions in the Harbor, and on motion of Councilman Claire,
seconded by Councilman Gordon and carried, the question was referred to
the Police Committee and Harbor Master for report.
