Island Impr.Assn. July 5, 1937• The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock P. M. on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. REPORTS CF HEADS OF DEPARTMENTS On.motion of Councilman Claire, seconded by Councilman Gordon and carried, the reading of reports of Heads of Departments was dispensed with and . the reports ordered filed. '4 REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The application of C. F. Lips for a permit to:build a pleasure pier fronting on Lot 41, Tract 907, Lido Isle, was on motion of Councilman Claire, • seconded by Councilman Gordon and carried, referred to the City Engineer. The application of Mrs. J. W. Peterson for a permit to build a pleasure pier fronting on Lot 30, Tract 742, Balboa Island, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. The application of Harold B. Robertson for a permit to build a pleasure pier fronting on Lot 21, Tract 742, Balboa Island, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. The application of James L. Rubel for a permit to extend an existing pier fronting on Lot 451, Tract 907, Lido Isle, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed. The application of W. B. MacGinitie and Wm. McElhannon for a license to run a cold drink stand on Fernleaf Avenue near Ocean Boulevard, Corona del Max, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to the approval of the Health Officer. The application of E. R. Ramsey for a license to conduct a cafe in the Epperly building at 504 West Central Avenue, having been approved by the .Health Officer, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed. The application of George Phillips for a license to operate a Penny Arcade in the Allen Building, 101 Main Street, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to the approval of the Chief of Police. The application of James A. Carrell for a veteran's exempt license to peddle fruit and vegetables, was on motion of Councilman Gordon, seconded by Councilman Claire and carried, allowed. The letter of Roger and Dorothy Barrow, asking for the vacation of the 15 foot alley running Prom 14th Street to Old.County Road and lying between Lots 1, 2 and 3, Tract 27, Boulevard Addition to Newport Heights, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Planning Commission and the City Engineer. The request of H. A. Armstrong for a ramp for.launching small boats on the Corona del Mar side of the Bay, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. ' The letter of John G. Hess regarding the width of Avocado Avenue, Corona del Mar, and the alleged encroachment thereon by. James Irvine, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. The letter of L. W. Briggs, Secretary of the Planning Commission, recommending the granting of certain variances in favor of F. A. Andrews, Lot 4, • Block 4, Section 5; F. F. Scribner, Lot 26, Tract 742 and Dorothy Ross, Lot 27, Tract 742, all on Balboa Island, was presented. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the hearing on the above recommend- ations of the Planning Commission was set for August 2, 1937• The communication of L. W. Briggs, relating to the resignation of L. Deming Tilton as Consultant for the Planning Commission, and of the meeting to be held at the Peninsula Cafe on July 21st for the benefit of the new members of the Planning Commission and the new member of the City Council, was on motion of Councilman Claire, seconded by- Councilman Whitson and carried, ordered filed. Mayor Williamson brought up the matter of speed trials for the newly launched Coast Guard boats in the North Channel of the Bay, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, permission for same was granted and the Mayor authorized to inform the .Coast Guard Commander accordingly. The application of F. M. Strowbridge to purchase water from the City of Newport Beach to supply a subdivision outside the City limits, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, denied' The communication of F. M. Strowbridge regarding a certain pipeline easement and requesting cancellation of said•easement and removal of the pipe line to another easement to be granted for same, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Attorney and the City Engineer for investigation and report. The petition presented by property owners requesting the construction of a cement sidewalk between 23rd Street and 30th Street, Newport Beach and } under the WPA Grant, was on motion of Councilman Claire, seconded by Councilman • Gordon and carried, referred to the City Engineer for an estimate of the cost of the same. The request of the Balboa Island Improvement Association that the City Council require the Seawall contractors to replace the Balboa Island beach in the same condition as maintained before the construction of the seawall, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer for report. Pauline Messing The application of Pauline Messing for one month leave of absence leave of absence necessitated by reason of sickness, and the recommendation of same by the Library Board, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed for two weeks only. Grainger Hyer The letter of Grainger Hyer, Chairman of the Library Board, advising Library Board the City Council that the Library Board was taking no part in the petition. being circulated for an increase in the tax rate for library purposes and that their position was a neutral one in the matter, was read. On motion of Council- man Claire, seconded by Councilman Whitson and carried, the communication was ordered filed. Petition A petition bearing approximately 300 names requesting that the City Park Dept. Council call an election for the purpose of voting a levy of ten cents per $100.00 valuation for the purpose of providing funds for the Park Department, was on motion of Councilman Claire, seconded by Councilman.Gordon and carried, Laid on the Table. Petition A petition bearing approximately 175 names requesting that the City Public Library Council call an election for the purpose of voting a levy of six cents per X100.00 valuation for the purpose of providing funds for the making of improve - ments and purchasing books and equipment for the Public Library, was on motion of Councilman Gordon, seconded by Councilman Claire and carried, Laid on the Table. W.E.Robinson The letter of W. E. Robinson of the Sea Scout Service, requesting sewer & water an estimate of the cost of extending water and sewer connections to the Sea connections Scout Base site, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer for report, Petition A petition bearing 26 names of residents of Corona del Agar complain - Stairway, CDM ing.of the damage being done to the stairway leading to the beach in the vicinity of Hazel Drive and other acts of vandalism by outside visitors, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Chief of Police. Employees The request of City Engineer Patterson for authority to employ WPA Recreation Chauncey Druck for full time, and Charles Langmade, Virginia Sweetman and Program Gilman Brookings for half .time, during the summer months in connection with the WPA Recreational Program, was on motion of Councilman Gordon, seconded by Councilman Claire and carried, allowed. Delinquencies Water Superintendent Patterson requested approval of credits Water Dept. made by the Water Department, due to delinquencies left by former owners and tenants between the dates of April 9, 1935 and.April 5, 1937 in the sum of $214.10. Whereupon Councilman Claire moved the adoption of a resolution authorizing the writing off of the uncollectable accounts. The motion was duly seconded by Councilman Gordon, and the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. The application of E. H. Day, laid over from a previous meeting, for permission to deposit 'sand on certain land north of Block 109, was on recommend- ation of the City Engineer, moved by Councilman Claire, seconded by Councilman Whitson and carried, allowed. The application of E. H. Day for permission to construct and maintain two wooden groynes fronting on a sixty -five foot lot north of Block 109, Section B, was on recommendation of the City Engineer, moved by Councilman Gordon, seconded by Councilman Claire and carried, allowed. The application of V. E. Britton for permission to construct a pleasure pier fronting on Lots 16 and 17, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion ofCouncilman Claire, seconded by Councilman Gordon and carried, allowed. The demand in favor of the Drainage Construction Company for the Drainage Const. monthly payment in accordance with the Sewer Project Contract, was on motion of demand. Councilman Claire, seconded by Councilman Whitson and carried, allowed arri the warrant ordered drawn for same. Mayor Williamson appointed Councilman Brown as Chairman of the Fire, Council.Brown Water, Light and Sewer Committee and a member of the Street Committee, and on Committees motion of Councilman Claire, seconded by Councilman Gordon and carried, the appointments were confirmed. Resolution No. 1159 was presented, being a• RESOLUTION OF THE CITY COUNCIL OF THE CITY Resolution OF NEWPORT BEACH APPROVING MEMORANDUM OF No- 1159 AGREEMENT FOR EXPENDITURE OF J CENT GAS TAX ALLOCATED FOR STREETS OF MAJOR IMPORTANCE. The resolution was read and considered and on motion of Councilman Claire, seconded by Councilman Gordon, was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson, NOES: Councilmen None. ABSENT: Councilmen None. • Resolution No. 1159 was presented, being a resolution authorizing the Resolution Mayor and City Clerk to execute on behalf of the City of Newport Beach a certain No, 1159 Contract of Conditional Sale, by and between Theodore Robins and the City of Newport Beach for the purchase of one certain 1937 Ford V -S Truck Chassis with ' cab and dual wheels, Motor No, 15- 3972630 for the sum of $1,563.77. On motion of Councilman Claire, seconded by Councilman Gordon, the resolution was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. Resolution No. 11592 was presented, being a resoluticn. authorizing the Resolution Mayor and City Clerk to execute on behalf of the City of Newport Beach a certain No. 11592 Contract of Conditional Sale by and between Theodore Robins and the City of Newport Beach for the purchase of one certain 1937 Ford V -9 Standard Fordor Sedan, Motor No. 18- 4056170 for the sum of $553.15. K. Blue and the City of Newport Beach for the purchase of a certain Chevrolet Commercial Pick -Up truck as described in said contract and for the sum therein stated. Resolution No. 1162 was presented, being a resolution -authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a certain Contract of Conditional Sale between Theodore Robins and the City of Newport Beach for the purchase of one certain 1937 Ford V -S, Model 79 1312" W.B. Chassis with cab and dual real wheels for the sum specified in said Contract. Councilman Claire moved the adoption of a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a Quit Claim Deed in favor of G. W. Kitzmiller and covering Lot 15, Block 9, Section 2, Balboa Island as shown in Book 6, page 31, Miscellaneous Maps, Records of Orange County, California. The City Council of the City of Newport Beach mat in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock P. Gifford Davidge for a permit to build a pleasure pier fronting on Lots 9 and 10, Block 4, E1 Bayo Tract, was on motion of Councilman Claire, seconded by Councilman Whitson and carried referred to the City Engineer. The offer of Ethel Rea Balaton to purchase from the City of Newport Beach for a price of $125.00 for Lots 5, 9, 10 and 12 in Block 5, Seashore Colony Tract was on motion of Councilman Claire, seconded by Councilman Gordon and carried, Laid on the Table. The letters of Margaret Gibson and Nellie Whall complaining of traffic hazards and the condition of the street at Clubhouse Avenue and 32nd Streets, were presented and on report of Assiht.ant Street Superintendent Siegel that the matter had been taken care o£, it was trroved by Councilman Claire, seconded. by Councilman Whitson and carried, that the letters be filed. The letter of Mrs. Lydia A. Gross complaining of the high tides inundat- ing their property at 3501 Finley Avenue, was,presented, and on report of Assistant Street Superintendent Siegel that the matter had been taken care of to the satisfaction of the complainant, it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the letter be filed. The application of Frank Suttora for permission to constrir-t a ramp from the City's 26th Street pier to a building being erected on adjoining property.by him for the handling of fish, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, referred to the Street Committee. The letter of Lew H. Wallace and J. J. Schnitker complaining of the erosion alleged to be due to boats speeding in the Lido Channel adjacent to Tract No. 515, was presented, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the tentative permission given for speed trials of boats in this channel was rescinded and the City Clerk instructed to notify the Harbor Master to endeavor to secure other area in the Bay for speed trials, the channel southward of the-State Highway Bay Bridge being suggested. The letter of C. Harold Hopkins to Mayor Williamson accepting the appoint- ment as a member of the Planning Commission was read, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the letter was ordered filed. The request of City Engineer Patterson for approval for the employment of Jim Woods at $$100.00 per month and Mrs. Truax at $$60.00 per month in the City Camp Grounds during the summer months, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed. Various applications for licenses to operate Games of Skill and Science were presented, and on motion of Councilman Whitson, seconded by Councilman Claire and carried, the same.were referred to the Chief of Police and City Attorney with power to act. It was moved by Councilman Gordon, seconded by Councilman Whitson and carried, that the City Engineer be instructed to prepare applications to the WPA authorities for funds for park areas and parks and including the construction of a cement sidewalk between 23rd Street and 30th Street, NexT ort Beach, provided the property owners in that section agree to pay_the customary charge for same. UNFINISHED BUSINESS The petitions presented at the previous meeting requesting the Council to call a special election for the purpose of increasing the tax levy from 30 to 100 for the Park Fund and from 3¢ to 6¢ for the Library Fund, was brought up. The City Clerk reporting on the check as to the number of property owners contained in the signatures appearing on the petitions. After considerable discussion regarding the matter and the cost of the holding of an election, it was moved by Councilman Whitson, seconded by Councilman Claire and carried, that the question be placed on the ballot of the next regular election, and the City Attorney was instructed to prepare the necessary ordinance therefor. City Engineer Patterson's detailed written report on the matter of re- locating an existing water main across the property of F. M. Strowbridge in the vicinity of 44th Street, estimated the cost of re- locating same at $$1,771.00.
