City Engineer Patterson reported on the matter of the 22nd Street side-
walk, and on motion of Councilman Claire, seconded by Councilman Whitson and
carried, the City Attorney was instructed to make application to the Pacific
Electric Railway Company in connection with same.
City Engineer Patterson advised the Council that the State-Highway
Department requested permission to install a drain under City owned property
In Tract 919,the City Engineer was instructed to contact the Highway Department
further concerning the matter as to location and change of same in future if
necessary.
J. A. Beek addressed the Council requesting a franchise to operate
a Ferry System covering all important points in the Bay, same to be operated
on schedule and calling at Lido Isle, Harbor Island, Balboa Island, Corona del
Mar and other points. After some discussion regarding the matter it was moved
by Councilman Gordon,.seconded by Councilman Claire and carried, that the subject
be laid on the table for further consideration.
ADJOURNMENT
On motion of Councilman Claire, seconded by Councilman Whitson and
carried, an adjournment was taken to 11 o'clock A. M. Thursday, November 4th.

The City Council of the City of Newport Beach met in adjourned regular
session in the City Council Chambers at the City Hall in the City of Newport
Beach at 11 o'clock A. M. on above date with Mayor Williamson presiding.
Roll.

COMMUNICATIONS

matters and requested that the Council g action in re- confirming the recommend -

ation of the Planning Commission relative to the variances granted the Bay
District Lumber Company and Verna T. Decker, inasmuch as his own application for
confirmation had been laid on the table pending a Court action, setting forth
the argument that such action by the Council might discriminate against the
applicant in said action and show prejudice on the part of the City Council.
After considerable discussion concerning the matter, it was moved by Councilman
Brown, seconded by Councilman Gordon and carried, that the Planning Commission's
recommendations in connection with the variances allowed the Bay District Lumber
Company, Verna T. Decker and Howard W. Seager be laid on the table pending the
decision of the Superior Court.

The request of the merchants of Newport Beach for permission to hold
dance permit
a street dance on the Ocean Front, SAturday, November 6th, was on motion of
Councilman Gordon, seconded by Councilman Claire and carried, granted.

The ordinance amending Ordinance No. 304 respecting advertising structures,

laid over from a previous meeting, was brought up for consideration. The ordinance
was read in full and on notion of Councilman.Cla.ire, seconded by Councilman Gordon
and carried, was passed to the second reading.

City Attorney Thompson presented a resolution, being a resolution author-
izing the Mayor and City Clerk to execute on behalf of the City of Newport Beach
Lease to
a certain Agreement between said City and Newport HarboV Union High School District,
High School
whereby the latter is granted a fifteen year lease on certain City owned property
and more particularly described in the resolution and agreement, The resolution
was read, considered, designated Resolution No. 1212, and upon motion of Councilman
Claire, duly seconded by Councilman Gordon, the resolution was adopted by the
following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.

City Attorney Thompson presented a resolution, being a resolution
authorizing the Mayor and City Clerk to execute on behalf of the City of Newport
Beach a certain Agreement by and between said City and C. E. McFarland, whereby
• the latter is granted a three year concession from the Newport pier for the
operation of fishing barges. The resolution was read, considered, designated
Resolution No'. 1213 and upon motion of Councilman Claire, duly seconded by Council-
man Whitson, was adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
NEW BUSINESS
On motion of Councilman Whitson all communications to be submitted to
and considered by the City Council at any meeting thereof, with the exception
of bids duly advertised for, must be filed with the City Clerk at least four
hours before the tiihe set for said meeting. The motion was duly seconded by
Councilman Claire and unanimously carried.
City Engineer Patterson presented a detailed report, together with
recommendations relative to the bids submitted for the purchase of equipment

The above prices do not include sales tax.
Reference is made to the proposals for information on the 6" sand pump.
Based on the assumption that the city contemplates the dredging of
approximately 200,000 cubic yards of material over a three year period, it is
my opinion that the city would be justified in expending not to exceed $11,000
for a complete dredging unit. Of the bids received, it is my opinion that the
bid of Brown -Bevis Equipment Company for furnishing the 120 H.P. Hercles Diesel
engine at a cost of $5,600.00 would be satisfactory in the event the city
constructs a dredge. The estimated cost of dredging would be 19¢ per cubic
• yard, based on doing 200,000 cubic yards.
The informal proposals of the Newport Dredging Company and Smith Brothers
for the rental of 8" dredge equipment are practically the same. The estimated
cost of dredging on a rental basis would be 20¢ per cubic yard. The informal bid
of Croft and Neville for rental of 6" dredge equipment would increase the cost
per cubic yard of material dredged.
In order to justify a city owned dredge, it is essential that a dredging
program involving at least 200,000 cubic yards of material over a three year period
be planned. This would involve an expenditure of approximately $40,000.
The prospective work in the harbor consists principally.of maintaining
the public beaches around the bay. This type of work requires a small dredge.
The Federal Government has allocated $15,000 per year for maintaining the jetties
and the channels dredged by the government. It is my opinion that the government
will not be required to expend any funds for maintenance dredgeing in the harbor
for some time. An 8" dredge suitable for maintaining the beaches would not be
economical in dredging channels where the length of discharge pipe line exceeded
1,000 feet.
At the present time I favor the rental of dredge equipment with the City
furnishing all labor and supervision. This will allow time for formulating and
financing a definite dredging program, and will afford the city the opportunity
' to experiment and to gain experience in actual dredging operations.

After considerable discussion regarding the matter, it was moved by
Councilman Claire, seconded by Councilman Whitson and carried, that the subject
be laid on the table for consideration at an adjourned meeting of the Council
at 4 o'clock P. M. November 4, 1937.
Resolution No. 1214. Whereas, Gerald W. Ritchie and Beulah B. Ritchie,
husband and wife, have this day offered to the City of Newport Beach, the sum of
$550.00 for Lot '24, Block B, Tract 673, Corona del Mar, in the city of Newport
Beach, as shown on Map recorded in Book 20, pages 17 and 19 of Miscellaneous
Maps, records of Orange County, California;.and
WHEREAS, the said price is a fair and adequate price as and for the
purchase price of said lot; and
WHEREAS, the City Council of the City of Newport Beach deems that it
is for the best interests of said City that said property be sold for the said
sum of $550.00; and
. WHEREAS, the price offered is gust, fair and adequate and is not dis-
proportionate to the real value of the property above described; and
WHEREAS, the City has not at this time perfect title to said property,
and an action to quiet title on said property is now pending.
NOW, THEREFORE, BE IT RESOLVED; That said property be sold to the
said Gerald W. Ritchie and Beulah B. Ritchie, husband and wife, for the sum of
$550.00, free and clear of all encumbrances when and if the City perfects title
thereto. Subject to the taxes for the fiscal year 1937 -35, and unpaid improve-
ment assessments of record. Also subject to conditions, restrictions and
reservations of record. And the Mayor and the City Clerk are hereby authorized
and directed to execute and deliver a deed for said property to the said parties
upon receipt of the consideration above set forth and the perfecting of title
to said property by the city as aforesaid.
BE IT FURTHER RESOLVED; That the sum of $55.00 be paid to Mrs. Gertrude
Williams, if and when the bity is able to perfect title to said property, and
give a deed thereto free and clear of encumbrances, except as herein mentioned,
as and for her commission for the negotiating of the sale of said real property
to Gerald W. Ritchie and Beulah B. Ritchie, his wife, as Joint tenants, said
sum being a fair and reasonable commission to be allowed in said sale, and said
broker being a licensed realtor of the City of Newport Beach.
I hereby certify that the above and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of Newport Beach
at a regular adjourned meeting thereof held on the 4th day of November, 1937,
by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.

J. A. Bedord addressed the Council concerning a certain assessment
levied against his property for the construction of the Balboa Island Seawall,
and was advised that the matter would be considered and reported to him later.

an adjournment was taken to 4 o'clock P. M. November 4, 1937.
