The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 4 o'clock P. M. on above date with Mayor Williamson in the Chair. The roll was called, the following Councilmen answering present: Gordon, Roll call. Claire, Whitson, Brown, Williamson. Absent, Councilmen None. REPORTS OF SPECIAL COT31ITTEES None. REPORTS OF STANDING C0191ITTEES UNFINISHED BTUSINESS The matter of the bids submitted for the purchase of machinery necessary Bids on for the construction of dredging equipment, together with bids submitted for the Dredger. ,q rental of dredging.equipment, was brought up for re- consideration. After considerable discussion regarding the matter, it was moved by Councilman Whitson, that in view of the City Engineer's report and recommendation, local dredging equipment be rented, Q the bids on machinery for the construction of a City owned dredger be rejected and the certified checks or bonds accompanying same be returned. Due to the lack of a second, the motion was lost. Mayor Williamson suggested that the matter should be left to the City Engineer to decide and that in keeping with the Engineer's report, new equipment for the const- • tuction of a City owned dredger should be purchased in accordance with the lowest bid the City Engineer's recommendation. Whereupon it was moved by Council- submitted and man Gordon that the City Engineer's recommendation be approved, and the bid of Brown - Bevis Equipment Company be accepted, the same being the lowest bid submitted. The motion was duly seconded by Councilman Brown and the motion carried by the following roll call vote, to -wit: AYES: Councilmen Gordon, Brown, Williamson. ' NOES: Councilmen Claire, Whitson. ABSENT: Councilmen None. On motion of Councilman Claire, seconded by Councilman Gordon and carried, all other bids submitted for the purchase of dredger equipment were rejected and the checks or bonds accompanying same ordered returned. Resolution No. 1215. WHEREAS, there has this day been presented to the City Res. 1215. Council of the City of Newport Beach a certain contract dated the 4th day of November, Contract 1937, by and between Brown -Bevis Equipment Company, a corporation, party of the first with part, and City of Newport Beach, a Municipal corporation, party of the second part; Brown -Bevis and Company WHEREAS, said contract provides that the party of the first Dart was on the 4th day of November, 1937, awarded the contract by second party for the furnishing of a new Kimball -Krogh B inch horizontal dredge pump fully equipped with certain accessories, all in accordance with first party's written proposal for the furnish- ing of the same, and in accordance with second party's specifications, for the consideration, and upon the terms, covenants and conditions in said contract and in said proposal and specifications more fully set forth; and WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City of Newport Beach that said contract be entered into with Brown -Bevis Equipment Company. NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City Clerk of the city of Newport Beach be, and they are hereby directed, authorized and instructed to execute said contract in the name of and on behalf of the City of Newport Beach, and that the City Clerk deliver an executed copy thereof to the party of the first ' part therein named. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 4th day of November, 1937, by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. • NOES: Councilmen None.
