HomeMy WebLinkAbout03-03-1938 - Special MeetingAM rNMI Special Meeting Call Roll Call Map of Tract 1007 Roll Call Map of Tract 1007 Protests of aband. alley Newport Beach, March 3, 1935• A Special Meeting of the City Council of the City of Newport Beach met in the City Council Chambers at the City Hall in the City of Newport Beach at 5 O'clock P. M. on above date with Mayor Williamson presiding, the meeting being called for the purpose of considering the final approval of a certain Map of Tract 1007 in the City of Newport Beach, together with any other matters that might lawfully come before the Special Meeting. The Call for the Special Meeting was read by the Clerk who advised that same had been properly signed by all the Councilmen excepting Councilman Brown, who was absent. The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Williamson. Absent; Councilman Brown. On mction.of Councilman Claire, seconded by Councilman Whitson and carried, the Call for the Special Meeting was ordered filed. The approval of the re- subdivision Map of Tract 1007 was brought up for discussion, the question of approval or disapproval of the Map being dependent upon the applicant acceding to certain demands of the City, said demands being the proper assurance of a public sidewalk being provided on the northerly side of said tract fronting on Newport Bay, together with a suitable radius being provided for a certain alley created by the re- subdivision. The question arose as to the status of the present public walk being preserved as City property in case it was not shown on the re- subdivision Map, whereupon J. P. Greeley,representing the applicants,advised the Council that the present sidewalk traversing the property involved had never been posted as private property and felt that the City was not jeopardizing their interests by approving the Map as presented with a 10 foot right of way bordering on the bulkhead line thereof. The matter of the cost of constructing the walk in the location as shown on the Map was considered, it being estimated that with the bulkhead necessary in connection therewith, the cost would approximate $2,700.00, which would have to be borne by the City and which did not meet with the favor of the Council. The matter of improving the alley to be dedicated by the Map and the cost of the proceedings for vacating the present alley would of necessity be paid with City funds. Considerable discussion ensued regarding the matter without arriving at any satisfactory conclusion. Whereupon it was moved by Council- man Claire, seconded by Councilman Gordon and carried, that an adjournment be taken to 5:30 o'clock P. City of Newport Beach met in adjourned Chambers at the City Hall in the City of on above date with Mayor Williamson The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. Absent, Councilmen None. Mayor Williamson advised that the matter before the adjourned Special meeting was the consideration of the approval of a certain Map of Tract 1007, said Tract being a re- subdivision and reversion to acreage of certain parcels of property in Block C, Newport Bay Tract and Block 1, Balboa Bayside Tract. The applicants for the approval of the Map of Tract 1007 having failed to appear in behalf of same, Mayor Williamson announced that in view of the advice of the City Attorney that the Map was presented with no protection afforded for the rights of the City of Newport Beach, that approval should be denied and advised that a motion to that end would be entertained. Whereupon it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the Map of Tract 1007 as presented be disapproved. Mrs. C. D. Crandall and Mrs. Anna M. Stewart appeared before the Council offering protests against the abandonment by the City of a certain alley in connection with the re- subdivision of that property to be known as Tract 1007. The protestants were advised to submit their protests and reasons for same in writing on or before the 10th day of March 1935, and same would be in line for due consideration. ADJOURNMENT There being no further business o come before the Council for which the Special Meeting was called, it was mov by Councilman Claire, seconded by Councilman Whitson and carried, that an a ug?iment Ae,9taken Sine Die. • 0 0 0
