Res. 1321 application for W.P.A. funds to repair sewer lines etc. SPECIAL MEETING Newport Beach, California. April M,1939- A Special Meeting of the City Council of the City of Newport Beach was held in the City Council Chambers at the City Hall in the City of Newport Beach at 9:00 o'clock a. m. on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Councilmen Gordon, Claire, Whitson, Brown, Williamson. Absent, Councilmen None. The Call was read, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the Call was ordered filed. The Planning Commission's Resolution No. 123 was presented, wherein a variance of 100 percent and reduction affecting rear yard requirements was granted and recommended for J. E. Reimer and Florence Reimer covering Lots 8, 9, 10 and 11, Block 7, Balboa Tract. After a discussion of the matter by the Council and Building Inspector, Councilman Claire moved the adoption of Resolution No. 1320, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GRANTING A VARIANCE TO J. E. REIMER and FLORENCE REIMER, AFTER REPORT AND RECOMMENDATION OF PLANNING COMMISSION AND PURSUANT. TO ORDINANCE NO. 440 AND AMENDMENTS THERETO. The motion for adoption was duly seconded by Councilman Whitson and the resolution adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. April 13, 1938• A Special Meeting of the City Council of the City of Newport Beach was held in the City Council Chambers at the City Hall in the City of Newport Beach at 11:00 o'clock a. m, on above date with Mayor Williamsoh presiding. The roll was called, the following Councilmen answering present: Councilmen Whitson, Brown, Williamson. Absent: Councilmen Gordon and Claire. The Call was read, and on motion of Councilman Whitson, seconded by Councilman Brown and carried, the Call was ordered filed. The letter of Governor Frank F. Merriam, acknowledging the City's application for funds, was read, and on motion of Councilman Whitson, seconded by Councilman Brown and carried, the letter was ordered filed. It was moved by Councilman Whitson, and duly seconded by Councilman Brown that the following Emergency Resolution be adopted. RESOLUTION NO. 1321. WHEREAS, the Santa Ana River flood of March 3rd, 1938 damaged the main sewer trunk lines, the sewage disposal plant and roadway to said plant of the City of Newport Beach, and certain streets in the vicinity of the Santa Ana River Outlet to the extent of $18,463; and WHEREAS, said sewer lines, disposal plant and.streets must be repaired at once in order to safeguard life and property in the City of Newport Beach; and WHEREAS, the City of Newport Beach had no funds with which to do said work and has applied to the Federal Government under the Works Progress Adminis- tration for the sum of $18,463, under which projects the city has agreed to furnish materials, equipment and supervision, in the sum of $7,024; and WHEREAS, flood waters from the Santa Ana River flowed into the westerly arm of Newport Bay causing damage to said streets and property between 42nd Street and Channel Place, and the depositing of sand and silt in Newport Bay resulted in damage to the extent of $2,650, as shown by the estimate of the City Engineer of the City of Newport Beach; and WHEREAS, the total estimated cost of emergency repairs, including $7,024 to be contributed by the city under Federal Works Progress Administration, Project No. 9458, and $2,650 for other repairs herein set forth, is $9,674; and WHEREAS, the City Engineer has presented Plan No. 72 -1050 consisting of one (1) sheet, and Plan -No. 401 consisting of Sheets 2, 3, 34 and 39, showing the work and repairs required; and WHEREAS, the City of Newport Beach has no funds available at this time ,to appropriate for the purpose of repairing and reconstructing damage caused by the Santa Ana River flood to the sanitary facilities and streets as aforesaid. NOW, THEREFORE, BE IT RESOLVED: That public property, life and health is endangered in the City of Newport Beach by reason of damage to its sanitary sewage lines and by reason of the other conditions mentioned in this resolution, and therefore a grave emergency exists in the City of Newport Beach which requires the immediate expenditure of monies in order to safeguard the life, property and health of the inhabitants of said city; and 40 fJ i • 0 APPROVED: CitylClerk u 0 Adjournment BE IT FURTHER RESOLVED: That the city has not sufficient funds to appropriate for the purposes of the emergency herein mentioned and is compelled • by reason thereof to seek assistance from the emergency fund created by Assembly Bill No. 25, 1936 Session of the Legislature of the State of California; and BE IT FURTHER RESOLVED; That the plans submitted by the City Engineer, ' being Plan No. 72 -1050 consisting of one (1) sheet and Plan No. 401 consisting of Sheets 2, 3, 34 and 39 §bowing the work and repairs required are hereby approved; and The roll was called, the following councilmen answering present: Gordon, BE IT FURTHER RESOLVED: That the City Engineer is hereby instructed to submit an application for an appropriation of $9,674 under said emergency fund to the Governor of the State of California. April 16, 1936. The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock P. M. on above date with Mayor Williamson presiding. The roll was called, the following councilmen answering present: Gordon, Roll Call Claire, Whitson, Brown, Williamson. Absent: Councilmen None. REPORTS OF SPECIAL COMMITTEES City Engineer Patterson reported on the matter of Recreational Centers Report on for the summer season, outlining the different areas and the approximate cost of Recreational carrying on the same, and on motion of Councilman Claire, seconded by Councilman Centers Gordon and carried, the report was approved with the exception of the payment of rental for a Handicraft Shop on Balboa Island, and the City Engineer was author- ized to act as agent for the City in connection with the above. Bid for City Engineer Patterson reported on the question of the bid submitted garbage by by George M. Green for the collection of, or the sale of City garbage and G.M.Green recommended that the rr esent contract be renewed for the ensuing year. Whereupon it was moved by Councilman Gordon, seconded by Councilman Whitson and carried, that the existing contract with E. V. S. Pomeroy be renewed and the City Attorney was instructed to draw up an Agreement in accordance therewith. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The letter of E. H. Corbin concerning the re- location of the swimming swimming floa =_ swimming f float now located between Washington and Palm Streets, was presented and read, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the letter was ordered filed. Allen Kent The application of Allen Kent for a license to run a restaurant at application 309 Palm Street, Balboa, was on motion of Councilman Claire,seconded by Council- for license man Gordon and carried, allowed subject to the approval of the Health Officer. The application of Mrs. Whalen for a license to conduct a beauty shop Mrs. Whalen at 406 East Bay Avenue, was on motion of Councilman Claire, seconded by Councilman application Gordon and carried, allowed subject to zoning restrictions, for license ' The application of H. L. Beezley for a veteran's license to peddle H.L.Beezley handmade novelties, was on motion of Councilman Claire, seconded by Councilman license Whitson and carried, laid on the table for investigation. app. • The application of Edward S. The application of Floy B. Thompson for permission to construct a pleasure .F :B.Thompson pier fronting on Lot 12, Block 2, Tract 626, was on motion of Councilman Claire, pier app. seconded by Councilman Whitson and carried, referred to the City Engineer for approval.
