Councilman
Newport Beach, July 25, 1935.
UNFINISHED BUSINESS
Re- Appointment For the purpose of re- organizing the Newport Beach City Planning
of Planning Commission in order to conform more fully to the statutes of the State of
Commission California, Mayor Williamson declared the terms of the members thereof vacant
and on motion of Councilman Gordon, seconded by Councilman Whitson and carried,
the action of the Mayor was approved, Whereupon the Mayor proceeded to

The City Council of the City of Newport Beach met in regular adjourned
session in the City Council Chambers at the City Hall in the City of Newport Beach
at 7:30 o'clock p. m. on above date, with Mayor Williamson presiding.
Roll Call
The roll was called, the following Councilmen answering present: Gordon,
Whitson, Brown, Williamson. Absent, Councilman Claire.
REPORTS OF SPECIAL COMMITTEES
Dividing walk
Councilman Whitson of the Poll6e Committee, reporting on the question
for bicycles
of dividing the Ocean Front walk in order to allow bicycle riders to use one lane
of same as suggested by Mrs. Norris through the Chamber of Commerce, recommended
against the idea as creating too much hazard, and on motion of Councilman Gordon,
seconded by Councilman Whitson and carried, the recommendation was approved.
Parking cars
Councilman Whitson,, of the Police Committee, reported on the petition

referred to that Committee at a previous meeting regarding the parking of cars
between 19th Street and 23rd Street, and reported that nothing could be done

this year due to funds not having been budgeted for the signs necessary for
posting same.
Piers
The Committee appointed to investigate the pier situation on Balboa
on
Island and particularly the pier of Frank Andrews over which there had been

some controversy, reported that the requirements of the Standard Plan had not
been conformed to, and on motion of Councilman Brown, seconded by Councilman
Gordon and carried, the City Engineer was instructed to enforce adherence to
the requirements. "
Councilman Whitson inquired of the City Engineer if all the piers
around Balboa Island were built in accordance with the Standard specifications,
and if not that they should all be made to comply with same. The City Engineer
advised that those constructed within the past eight years were in conformity,
with the City's requirements. whereupon it was moved by Councilman Whitson, seconded
by Councilman Gordon and carried, that any piers built during that period and not
conforming to the City's regulations shall be removed.
COMMUNICATIONS
Gordon & Ritchie
The letter of Gordon and Ritchie of Corona del Mar requesting the
Bldg. Ord.
changing of paragraph 2205, Chapter 22 of the Building Ordinance to read from
400 square feet to 500 square feet on dwelling, subject to approval of the
Building Inspector, was read, and on motion of Councilman Gordon, seconded by
Councilman Whitson and carried, same was Laid on the Table for further
consideration.
C.Monahan
The application of Carl Monahan for a license to operate a penny
penny arcade
arcade at 301 Palm Street, was on motion of Councilman Whitson, seconded by
Councilman Gordon and carried, allowed subject to the approval of the Chief
of Police and the Police Committee.
Donald Gibson
The application of Donald Gibson for a free license to peddle milk
license
from his own dairy, was on motion of Councilman Gordon, seconded by Councilman
Whitson and carried, denied and the City Clerk instructed to notify the
applicant.
Sam Focht
The application of Sam Focht for a free license to peddle cut flowers
license
raised by himself, was on motion of Councilman Gordon, seconded by Councilman
Whitson and carried, denied due to a conflicting ordinance.
George Blasdell
The application, with proper affidavit, of George Blasdell for a
license
free license to peddle home grown corn and cucumbers, was on motion of Council-
man Gordon, seconded by Councilman Whitson and carried, allowed.
League of Mun.
The letter from the Leggue of Municipalities regarding the meeting
meeting
of same at Laguna July 25th, was presented, and on motion of Councilman Brown,
seconded by Councilman Whitson and carried, was ordered filed.
Railroad Qom.
The letter from the California State Railroad Commissiou. inviting
conference
representation at a conference of Public Transportation utilities at the City
Hall in Santa Ana July 26th for the purpose of considering rate structures,
was presended, and on motion of Councilman Whitson, seconded by Councilman
Gordon and carried, the Mayor was appointed to attend the hearing.
PWA
The telegram from Administrator Ickes to Mayor Williamson in which
applications
it was stated that the applications of the City of Newport Beach for the sewer
and waterworks projects were under study at the Regional Offices of the PWA,
was read, and on motion of Councilman Whitson, seconded by Councilman Brown
and carried, same was ordered filed.

On motion of Councilman Brown, seconded by Councilman Gordon and carried, the
appointments were confirmed.
Dr. Howard W. Seager addressed the Council, advising that the Planning
Commission should consist of nine members, including the ex- officio members, and
after some discussion regarding the matter, the Mayor appointed Chief of Police
Rowland R. Hodgkinson as an ex- officio member of the Planning Commission, and on
motion of Councilman Gordon, seconded by Councilman Brown and carried, the appoint-
ment was confirmed.
NEW BUSINESS
The Council was addressed by three different operators of music vending
machines, each asking for some modification of the proposed ordinance providing for
a license for the operation of same, and after considerable discussion, the City
Attorney presented an emergency ordinance, being an ordinance amending the License
Ordinance of the City of Newport Beach by adding a new section thereto to be known
as Section 72 -A and reading as follows; "For music machines where a coin is inserted
for its operation the fee shall be $5.00 per machine per annum ". On motion of
Councilman Whitson, seconded by Councilman Gordon and carried, it was declared that
an emergency exists by reason of the fact that there is no ordinance covering that
particular type of machine. which was designated Ordinance 475
The motion for adoption of the emergency ordinancerwas moved by Councilman
Whitson and duly seconded by Councilman Gordon and the ordinance was passed by the
following vote, to -wit:
AYES: Councilmen Gordon, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Claire.
Ray Foust addressed the Council concerning the Punch Board license and
advocated a lower license on same and suggested a flat rate or so much per board
that would be within reason. On motion of Councilman Whitson, seconded by Council-
man Gordon and carried, the matter was referred to the Police Committee to peport
on at the next meeting of the Council.
The request of the Balboa Island Yacht Club in connection with floats and
piers, was on motion of Councilman Gordon, seconded by Councilman Brown and carried,
referred to the City Engineer for checking.
Councilman Gordon moved the adoption of a resolution, being a resolution
authorizing the Mayor and City Clerk to execute on behalf of the City of Newport
Beach a quitclaim deed in favor of Philip G. Brown and covering Lot 5, Block 530,•
Lancaster Addition, in the City of Newport Beach, as shown on Map recorded in
Book 5, page 14 of Map Books, records of Orange County, California. The motion
was duly seconded by Councilman Brown and the resolution was passed by the following
vote, to -wit:
AYES: Councilmen Gordon, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilman Claire.
I, Frank L. Rinehart, City Clerk of the City of Newport Beach, hereby
certify that the above and foregoing resolution was passed and adopted by the
City Council of the City of Newport Beach at an adjourned regular meeting thereof
held on the 25th day of July, 1939.

Resolution No. 1372. WHEREAS, LEO KOCH, a single man, has this day offered
• to the CITY OF NEWPORT BEACH, the sum of $250.00 for Lot 25, Block B, Tract 673 in
the city of Newport Beach, as shown on Map recorded in Book 20 pages 17 and 18 of
Miscellaneous Maps, records of Orange County, California; and
WHEREAS, the said price is a fair and adequate price as and for the
purchase price of said lot; and
WHEREAS, the City Council of the City of Newport Beach deems that it is
for the best interests of said City that said property be sold for the said sum of
$250.00; and
WHEREAS, the price offered is just, fair and adequate and is not dispropor-
tionate to the real value of the property above described.
NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said
Leo Koch, a single man, for the sum of $250.00, free and clear of all encumbrances,
subject to the taxes for the fiscal year 1938 -39, and unpaid improvement assessments
of record. Also subject to conditions, restrictions and reservations of reco�?d. And
the Mayor and the City Clerk are hereby authorized and directed to execute and
deliver a deed for said property to the said parties upon.receipt of the consideration
above set forth.
BE IT FURTHER RESOLVED: That the sum of $25.00 be paid to G. W. Ritchie,
as and for his commission for the negotiating of the sale of said real property to
Leo Koch, a single man, said sum being a fair and reasonable commission to be
' allowed in said sale, and said broker being a licensed realtor of the City of
Newport Beach.
I hereby certify that the above and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of Newport Beach at an
• adjourned regular meeting thereof, held on the 25th day of July, 1936, by the
following vote, to -wit:

to H.P.Pitts

WHEREAS, the said price is a fair and adequate price as and for the
purchase price -of said lot; and
WHEREAS, the City Council of the City of Newport Beach deems that

said sum of- $200.00; and
WHEREAS, the price offered is just, fair and adequate and is not
disproportionate to the real value of the property above described.

said Harold P. Pitts and Jean D. Pitts, husband and wife, for the sum of $200.00,
free and clear of all encumbrances, subject to the taxes for the fiscal year
1938 -39, and unpaid improvement assessments of record. Also subject to conditions,
restrictions and reservations of record. And the Mayor and the City Clerk are
hereby authorized and directed to execute and deliver a deed for said property
to the said parties upon receipt of the consideration above set forth.

Sloan, as and for his commission for the negotiating of the sale of said real
property to Harold P. Pitts and Jean D. Pitts, his wife, as joint tenants, said
sum being a fair and reasonable commission to be allowed in said sale, and
said broker being a licenses realtor of the City of Newport Beach.
I hereby certify that the above and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of Newport Beach at
an adjourned regular meeting thereof held on the 25th day of July, 1939, by the
following vote, to -wit:

Parking cars
Chief of Police Hodgkinson addressed the Council regarding the parkin

of cars between 15th and 19th Streets and recommended that no parking be 'allowed

in that area. On motion of Councilman Gordoni seconded by Councilman Whitson
and carried, the matter was referred to the Police Committee with power to act.
PWA Bonds
City Attorney Thompson recommended the employment of O'Melveney, Tuller
employment
& Myers to handle the legal phase of the bonds proposed to be voted in connection
with certain projects for which PWA funds are being applied for and on a basis
of $200.00 if the bonds failed to carry and $700.00 if they did carry.
ADJOURNMENT
On motion of Councilman Gordon, seconded by Councilman Whitson and
carried, an adjournment was taken Sine Die.
