HomeMy WebLinkAbout08/01/1938 - Regular Meeting• i� C • 1. • r 123 Newport Beach, August 1, 193$• The City Council of the City of-Newport Beach met in regular session in the City Council Chambers at the City Hall in the city of Newport Beach at 7:30 o'clock p.-m. on above date, with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon,Claire, Roll Cel- Whitson, Brown, Williamson. Absent, Councilmen None. It was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the regular order of business be suspended to permit Mrs. W. A. Fraser to Mrs.Frasi address the Council in connection with a letter to Mayor Williamson from her bicycle husband complaining of the riding of bicycles on the Ocean Front walk, and cited on sidewalk the case of her sister a Mrs. Maxwell, who is still in the hospital as a result of being struck down by a bicycle and urged the Council to more rigidly enforce the ordinance prohibiting the riding of bicycles on the sidewalks. Councilman Whitson again reporting of the petition presented for the regulation of parking and traffic between 19th and 23rd Streets, advised that the same be carried over until next year. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the report was accepted and ordered filed. COMMUNICATIONS The applications of George A. Brower, Charles Goldberg and Frank E. Wierman for veterans exempt licenses for peddling fruits and vegetables, were on motion of Councilman Claire, seconded by Councilman Whitson and carried, Laid on the Table. The application of Lester L. Robinson for a permit to build a retain- ing wall and to construct a pier and float fronting on Lots 853 and 854, Tract 907 Lido Isle, and that of Mrs. George Parmenter and Mr. Douglas for a permit to construct a joint pier and float, were on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. The application of Romaine Poindexter for a license to operate a confectionery at 2300 Ocean Front, Newport Beach, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed subject to the approval of the Health Officer. The request of the Newport - Harbor Yacht Club for an appropriation of $250.00 to be used for the purpose of Newport Harbor Race Week, August 22nd to 28th inc., was on motion of Councilman Claire, seconded by Councilman Brown and carried, referred to the Chamber of Commerde. The letter of Lew H. Wallace regarding the exchange of certain described property for the payment of delinquent taxes on other described property was presented, and on motion of Councilman Claire, seconded by Councilman Brown and carried, was Laid on the Table for further consideration. The letter of Helen L. Coffin requesting various improvements for the West Newport District, was presented and discussed, and on motion of Councilman Gordon, seconded by Councilman Whitson and carried, was Laid on the Table for further study. The letter of Peter Webber complaining of speeding of automobiles on Coast Blvd. in the vicinity of 37th Street, West Newport, and suggesting that the emossings•in that section should be posted with proper signes in order to safequard pedestrians, was on motion of Councilman Gordon, seconded by Council- man Claire and carried, referred to the Police Committee. J. J. Shalda of the Peerless Weighing Machine Corporation, addressed the Council after the reading of two communications in regard to the license on weighing machines, advocating a lower license for same. After some discussion, it was 4oved by Councilman Claire, seconded by Councilman Whitson and carried that the communications be filed and the request be denied. The recommendation of Fire Chief Crocker for the appointment of Life Guards for 1936 was presented, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same were approved. UNFINISHED BUSINESS The City Planning Commission presented their report and recommendations in connection with the various projects proposed for the City of Newport Beach, said report being compiled from the reports of the sub - committees of the Committee of Fifty appointed by Mayor Williamson. The Minutes of the Planning Commission's meeting of July 30th as presented in their report to the Council indicated that it was their recommendation that each of the proposed projects be voted on separately at the bond election to be called for the purpose of financing the projects. There was considerable discussion regarding certain phases of the proposed projects and particularly the Planning Commission's recommendation regard- ing the method of presenting the question to the voters, whereupon it was moved by Councilman Gordon that the matter be referred back to the Planning Commission for re- consideration. The motion was duly seconded by Councilman Brown and the motion carried.by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Brown, Williamson. NOES: Councilman Whitson. ABSENT: Councilmen None. Resolution No. 1374, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GRANTING A VARIANCE TO MR. & MRS. STEBBINS AFTER REPORT AND RECOMMENDATION OF PLANNING COMMISSION AND PURSUANT TO ORDINANCE NO. 440 AND AMENDMENTS THERETO was presented, and on motion of Councilman Claire, seconded by Councilman Whitson the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. Appointing Life Guards Planning Commission report Res. 1374 variance to Stebbins 124 NEW BUSINRSS Minute Res. MINUTE RESOLUTION. Councilman Claire moved the adoption of a resolution, appointing being a resolution creating the office of Plumbing Inspector and approving the Plumbing Insp. appointment of Louis A. Wright as Inspector and fixing the salary at $160.00 per month from the first day of July, 1938. The motion for adoption was duly seconded by Councilman Whitson and the Resolution was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.. NOES: Councilmen None. ABSENT: Councilmen None. I, Frank L. Rinehart, City Clerk of the City of Newport Beach, hereby certify that the above and foregoing resolution was passed and adopted by the City Council of the City of Newport Beach at a regular meeting thereof held on the let day of August, 1938• /1 Amending Councilman Whitson moved that the reading of the ordinance amending Ord. 393 License Ordinance No. 393 and pertaining to the licensing of punch boards be waived, the motion was seconded by Councilman Claire and carried. Whereupon Councilman Whitson moved, that the ordinance amending License Ordinance No. 393 and establishing a fee of One Dollar for all punch boards and fixing the minimum charge therefor at $150.00, be passed to the second reading. The motion was duly seconded by Councilman Gordon and the ordinance passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Dredging the On motion of Councilman Gordon,,seconded by Councilman Brown and Rhine, carried, the City Engineer was authorized to revise the plans for the dredging of the Rhine by changing the depth to be dredged from fifteen feet to twelve feet. Frank Saunders Frank Saunders addressed the Council regarding the pier and float pier & float fronting.on Lots 3 and 4, Block 4, Section 5, Balboa Island, over which there had been considerable controversy as to its conforming with the City's speci- fications,.the speaker cited the Council to Senate Bill No. 245 and its relation to Newport Harbor. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the matter was referred to the City Attorney for a written report as to the legality of pier location. Demands The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Qouncilman Whitson and carried, allowed and warrants ordered drawn for same. City Hall Mr. Harvey, representing Donald Beach Kirby, addressed the Council plans regarding the City Hall project, and on motion of Councilman Gordon, seconded by Councilman Whitson and carried, authorization was given to the architect to compile sufficient data for the City Engineer tq formulate the application to the PWA for the grant in connection with same. G. Findlay Gordon Findlay addressed the Council concerning a tree at the corner tree in CDR of Jasamine and Seaview. Corona del Mar, which it was said interfers with the use of the garage at that location. On motion of Councilman Whitson, seconded by Councilman Gordon and carried, the matter was referred to the Park Department with power to act. G.W.Ritchie G. W. Ritchie addressed the Council in connection with a, request made building code to the Council at a previous meeting for a change in the Building Code affect- . ing the Corona del Mar district in which paragraph 2205 Chapter 22 of the Building Code be changed from 400 to 600 square feet for dwellings. Mayor Williamson asked Gordon Findlay for his opinion regarding the matter, whereupon Mr. Findlay advised the,Council that he objected to any lowering of the Standard of construction. On motion of Councilman Whitson, seconded by Councilman Claire and carried, the matter was referred to the Planning Commission. Sign in City Auditor.Gant advised the Council regarding an application from Corona del Mar a firm to pay rental on and to construct a sign on property acquired by the City in Corona del Mar, but on motion of Councilman Claire, seconded by Councilman Gordon and carried, it was ordered that the applicant be notified to remove the sign.
