The City Council of the City of Newport Beach met in regular adjourned session in the City Council Chambers at the City Hall in the City of Newport Beach at 12 Noon on above date. Roll Call On Roll call the following Councilmen answered present: Gordon, Claire, Whitson, Brown. Absent, Councilman Williamson. In the absence of the Mayor, the City Clerk advised that a motion would be in order for the appointment for a Mayor pro tem, whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that"Councilman Whitson be appointed as Mayor pro tem. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS Mrs.L.S.Lee The letter of Mrs. L. S. Lee regarding the condition of the sidewalk at sidewalk 115 and 117 Edgewater Place and requesting that the City repair broken places therein, repairs was read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was referred to the City Engineer. UNFINISHED BUSINESS None. NEVI BUSINESS Res. 1421 Resolution No. 1421, being a RESOLUTION CALLING ELECTION AND AUTHORIZING SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF.NEWPORT BEACH, CALIFORNIA, OF A CERTAIN PROPOSITION. WHEREAS, The City Planning Commission of the City of Newport Beach, California, has heretofore approved a number of municipal improvements in one group as constituting a City Plan, and pursuant to an act sometimes referred to as the Bond Act of 1901, Statutes 1901, page 27, as amended (Deerings General Laws, 1937, Act No. 5178), in order to issue bonds for all of said improvements comprised in said Plan in one bond issue for one gross amount, it is necessary that said City Plan be approved by a majoriey vote of the qualified electors of the City of Newport Beach voting thereon, and it is necessary and desirable to call an election for that purpose, NOW, THEREFORE, the City Council of the City of Newport Beach, in Orange County, California, does hereby resolve, determine and order as follows: Section 1. That an election shall be held and the same is hereby called to be held on the 31st day of October, 1938, in the City of Newport Beach for the purpose of. submitting to the qualified electors of said City the following proposition, to -wit: PROPOSITION NO. 1: Shall the City of Newport Beach approve and adopt in one group as constituting a City Plan (as heretofore approved by the Planning Commission of the City of Newport Beabh) the following municipal improvements in said City, to -wit: (a) The acquisition and construction of a group of buildings for public purposes, including equipment of same, on one parcel of land, including therein a city hall, police station and jail,, and construction of streets, walks and other work incidental thereto, and the acquisition of rights of way and lands necessary or convenient_ for the use of said buildings, said project to cost approximately $90,000.00. (b) The acquisition and construction of .additions to the municipal water system, including therein fire protection, mains and hydrants, water.works, aeration tanks, pumping plants and the acquisition of buildings and lands necessary or convenient therefor, said project to cost approximately $1419819.00. (c) The acquisition and construction of additions to the municipal sewer system, including therein construction and reconstruction of sanitary sewers, underground pumping stations, and including the acquisition of lands and rights of way, and other work incidental thereto, said project to cost approximately $127,273.00. (g) The construction of a building for public uses in Corona Del Mar, such building to be used for recreational purposes and public meetings, and play- grounds, showers, lockers and equipment, including the acquisition of lands and ri hts of way and other works incidental thereto, said project to cost approximately $34,000. Section 2. That said election shall be held between the hours of six o'clock A.M. and seven o'clock P.M. on said day and the polls shall be kept open r. between the aforesaid hours. That for the purposes of said election the said City C\2 shall comprise four consolidated election precincts designated as hereinafter Lm stated and comprised of the regular election precincts as now established in said �S City for the holding of state and county elections hereinafter described; that the polling places for each of said precincts shall be the polling places herein- after designated and that the persons hereinafter named for each of said election precincts, being competent and qualified electors of said City and of their respective election precincts, are hereby appointed officers of election, inspectors, judges and clerks, respectively, and they shall hold said election • and make return thereof in the manner provided by law. SECTION 3. That the public interest and necessity demand the acquisition and construction by said city of a certain municipal improvement, to wit: Additions to the municipal sewer system, including therein construction and reconstruction of sanitary sewers, underground pumping stations, and including the acquisition of lands and.rights of way, and other work incidental thereto. Said municipal improvement is necessary and convenient to carry out the objects, purposes, and powers of said city. The estimated cost of said proposed improvement is the sum of $127,273.00; it is contemplated that a portion of said cost will be paid by the United States of America; that the estimated amount of moneys to be provided by the City of Newport Beach, which is the estimated cost of said proposed municipal improvement to the City of.Newport Beach, is the sum of $70,000.00; that the estimated cost of $127,273.00 is and will be too great to be paid out of the ordinary annual income and revenue of the City of Newport Beach; that the estimated cost to the City of Newport Beach, to wit, the sum of $70,000.00, is and will be too great to be paid out of the ordinary annual income and revenue of the City of Newport Beach. SECTION 4. That the public interest and necessity demand the acquisition and construction by said city of a certain municipal improvement to wit: The construction and reconstruction of a public wharf at Newport Beach, including therein the acquisition of lands and rights of way and other works incidental thereto. Said municipal improvement_is necessary and convenient to carry out the objects, purposes and powers of said city. The sstimated cost of said pro- posed improvement is the sum of $25,000.00; it is contemplated that a portion of said cost will be paid by the United States of America; that the estimated amount, of moneys to be provided by the City of Newport Beach, which is the estimated cost of said proposed municipal improvement to the City of Newport Beach, is the sum of $17,000.00; that the estimated cost of $25,000.00 is and will be too great to be paid out of the ordinary annual income and revenue of the City of Newport Beach; that the estimated cost to.the City of Newport Beach, to wit, the sum of $17,000.00, is and will be too great to be paid out of the ordinary annual income and revenue of the City of Newport Beach. The City Council of the City of Newport Beach does hereby RESOLVE AND ORDER that in the notice of the special election to be held October 31, 1938 which this City Council has heretofore directed the City Clerk to publish, said City Clerk shall include another proposition, to be designated Proposition No. 2, said proposition shall be for the issuance of bonds in the amount of three hundred twenty - five thousand dollars ($325,000.00) in one bond issue for one gross amount for all of the improvements constituting said City Plan. Patterson as Street bond Superintendent, and in favor of the City of Newport Beach, was presented, and being approved by the City Attorney, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, accepted and ordered filed. The application of- and Aark for a permit to construct Pier permit a joint pleasure pier fronting on Lots Block having been approved by the City Engineer, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, granted. I.H.K.Budau The application of Dr. I. H. D. Budau for a permit to construct a pier permit pleasure pier fronting on Lot 857, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion of Councilman Claire, seconded by Councilman Brown and carried, allowed. A.A.Kemper The application of A. A. Kemper for a permit to install piling, pier pier permit and ramp at 1135 State Highway in Tract 919, having been approved by the City Engineer, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed. Frank Andrews The application of Frank Andrews for a permit to install a slip pier slip pier in connection with an existing pier, having been approved by the City Engineer subject to approval of the War Department, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed. Notifying PWA On motion of Councilman Claire, seconded by Councilman Gordon and authorities carried, the City Engineer was authorized to notify the PWA authorities as to the manner in which the proposed bond election of the City of Newport Beach is to be carried out. Res. 14247 Resolution No. 14244, being a RESOLUTION OF THE CITY COUNCIL AMENDING amending lease THE PROVISIONS OF A CERTAIN LEASE RELATIVE TO THE PAYMENT OF RENT, and amending lease authorized by Resolution 11791, was presented. Whereupon it was moved by Councilman Claire, seconded by Councilman Whitson, and the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown.
