The roll was called, the following Councilmen Claire, Whitson, Brown, Williamson. Absent: Councilmen REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. 3each, February 25, 1939• met in regular adjourned City of Newport Beach answering present: Gordon, None. Appointment It was moved by Councilman Claire, seconded by Councilman Whitson and of City Judge carried, to suspend the regular order of business to take up new business. Mayor Williamson moved that Robert Gardner be appointed as City Judge to succeed the late Wm. A. Leonard. The motion was duly seconded by Councilman Claire and carried unanimously. Bush. mussels from pier COMMUNICATIONS The application of Jack Wright for a license to-run a restaurant at 322 Marine Avenue, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, granted subject to the approval of the Health Officer. The application of Harry Gartler for a license for a new and used marine hardware establishment at 817 State Highway, was on motion of Councilman Claire, seconded by Councilman Gordon and carried., laid on the table. The application of E. D. McMahon for a license to run a bakery at 2112 Ocean Front, Newport Beach, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, granted subject to the approval of the Health Officer. . The letter of the Planning Commission regarding the Major Traffic Plan, laid over from a previous meeting, was presented and read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the Council was instructed to meet with the Planning Commission to discuss the matter and Councilman Whitson was delegated to arrange the time of meeting. The request of H. I. Bush for permission to take mussels from Newport pier piling, for which the City would receive 25¢ per sack, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Street Committee. UNFINISHED BUSINESS Dr. A. Soil and The matter of the quit Claim deed -in favor of Dr. Albert Soiland in connection with certain property in the vicinity of Bay Avenue and Buena Vista Blvd., same having been laid over from a previous meeting, was brought up for consideration, and on motion of Councilman-Whitson, seconded by Councilman Claire, the resolution was lost by the following vote, to -wit: AYES: Councilmen Whitson, Williamson. NOES: Councilmen Gordon, Claire, Brown. I, Frank L. Rinehart, City Clerk of the City of Newport Beach, hereby certify that the above and foregoing Resolution was passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 25,Gh day 91Aebruary, 1939• City Clerk of the City of Newport Beach Res. 1523.'^ The final map of Beacon Bay Subdivision was presented for the Council's Beacon Bay consideration, whereupon Councilman Whitson moved that the following changes in Subdivision said map be stipulated: Stoever et al Lot "H to be increased two feet in width from 30 feet to approval of Map 32 feet; Lot "I" to be decreased in width from 30 feet to 28 feet and an addition numbered lot to be added to existing area, included in tentative and final map, said numbered lot to be designated as Lot 62. The motion was duly seconded by Councilman Brown and carried unanimously. MINUTE RESOLUTION Councilman Whitson moved the adoption of a resolution, being a Minute Res. resolution approving the record map of Beacon Bay Subdivision and author - adoption of izing the City Engineer and City Clerk to sign said map on behalf of the Map of Beacon City of Newport Beach, the motion was duly seconded by Councilman Claire Bay Sub. and the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. HEARING IN THE MATTER OF BALBOA YACHT CLUB APPLICATION FOR ADDITIONAL FLOATS, ETC. Balboa Yacht Club The hearing in connection with the Balboa Yacht Club's application application for for additional floats and mooring facilities which was set for this time at additional floats, the meeting of February 20th was opened with the filing of petitions by Attorney etc.,hearing. Grainger Hyer, representing the opponents to the granting of the application and by those in favor of the Yacht Club's request. Attorney Hyer opened the discussion at length in behalf of his clients, setting fotth in detail certain alleged disadvantages and inconveniences that might accrue by reason of installing the landing floats, boat slips,'anchor piles and dredging proposed by the Club. This was followed with arguments against the plan by Gloria Gartz, G. A. Axelson, Howard MCBain, C. R. Prentiss, Dr. Howard W. Seager, C. Harold Hopkins and others. Those favoring the plan who addressed the Council were, Commodore L. Archie Bish, Joseph F. Bosio, H. F. Batchelor, J. L. Bernard, Roy Edwards, Whiting B. Wright, E. S. Ross, Dr. C. Smith, Earl Stanley and others. After much discussion regarding the matter, Councilman Brown moved that the Balboa Yacht Club submit an application with a definite plan in keeping with Standard Plan No. lb49 for pleasure piers adopted by the City of Newport Beach, and that the same be referred to the City Engineer for approval. More discussion ensued, whereupon it was suggested and moved by Council- man Gordon that the Yacht Club present their application and plan to the Council at the next meeting thereof, which in turn would be referred to the City Engineer for approval in accordance with the usual routine in such matters. At this Juncture Councilman Brown withdrew his motion, the motion of Councilman Gordon being duly seconded by Councilman Whitson and was carried unanimously.
