HomeMy WebLinkAbout07/07/1939 - Adjourned Regular MeetingPROPOSITION NO. 4 of the Call for the Special meeting, laid over from the previous meeting, to consider the repeal of the Ordinance permitting the operation of Punch Boards and Games of Skill operating in the City of Newport Beach, was presented, it being alleged that complaints were being made regarding same. Considerable discussion was had by the Council and audience regarding the matter, after which it was moved by Mayor Williamson that Ordinance No. 476 permitting the operation of Punch Boards be repealed. The motion was duly seconded by Councilman Gordon and the ordinance repealing Ordinance No. 476 was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Newport Beach, July 7, 1939. • The City Council of the City of Newport Beach met in adjourned Special session in the City Council Chambers at the City Hall, in the City of Ne+rroort Beach at 11 o'clock a. m. on above date, with Mayor Williamson in the Chair. The Roll was called,the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. Absent, Councilmen None. The Call for which the Special Meeting was held at 7:30 o'clock P. m. July 6, 1939 and adjourned to this date, was read, together with the ' minutes of the previous meeting, same being approved by the Council. PROPOSITION NO. 1 of the Call for the Special Meeting pertaining to the appointment of Frank Naylor as Assistant Chief of Police, and laid over from the previous meeting, was brought up for consideration, and on motion of Mayor Williamson, seconded by Councilman Whitson, who suggested that the appointment should carry an increase of ten dollars per month in • salary, the appointment of Frank Naylor as Assistant Chief of Police was p confirmed by the following vote, to -wit: C� AYES: Councilmen Gordon, Whitson, Williamson. NOES: Councilmen Claire, Brown. ABSENT: Councilmen None. circulars concerning gambling ships or gambling barges. PROPOSITION NO. 2. of the Call for the Special meeting, laid over from the previous meeting, pertaining to the abatement of a certain gravel pit located on Newport Heights and alleged to be a public nuisance, was presented for consideration, the City Attorney advising that a. petition • signed by the property owners in that district should accompany the comp- laint in order to determine whether a public nuisance exists instead of merely the objection of one person. PROPOSITION NO. 3 of the Call for the Special meeting, laid over from the previous meeting, regarding the employment of 40 BRA workers in connection with Beach Sanitation, was on motion of Councilman Brown, F. That he shall enforce strictly all provisions of law relating seconded by Councilman Gordon and carried, referred to the City Engineer for report. It was moved by Mayor Williamson that an ordinance be adopted prohibiting the operation of any mechanical apparatus which could be construed as a gambling machine. The motion was duly seconded by Councilman Gordon and the ordinance was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. PROPOSITION NO. 5 of the Call for the Special meeting, leid over ' from the previous meeting, was brought up. On motion of Mayor Williamson, seconded by Councilman Claire, and unanimously carried, it was ordered that the Chief of Police of the City of Newport Beach be notified: A. That no taxis or other boats, vessels, or water craft shall be run from public piers or other public properties in the City of Newport Beach to gambling ships or gambling barges; that if an attempt is made to • do so he shall immediately arrest all those concerned therein, and if necessary close all piers and other public property by ropes and barriers and guards placed thereon to enforce the orders of the Council. B. That he shall make immediate arrests of all persons distributing or attempting to distribute by hand any advertising matter, hand bills, or circulars concerning gambling ships or gambling barges. C. That he shall immediately arrest all persons selling or attempting to sell transportation tickets for taxis or other means of conveyance to or from gambling ships or gambling barges. D. He shall make immediate arrests of all persons advertising or attempting to advertise by signs, wagons, automobile, or other public displays, gambling ships or gambling barges. E. He shall make immediate arrests of all persons operating or attempting to operate boats, vessels, taxis, or other water craft to or from gambling ships or gambling barges. F. That he shall enforce strictly all provisions of law relating to gambling ships in the waters of the Pacific Ocean, and shall make careful investigations of all complaints of citizens relating to any violation of the gambling ship law in the City of Newport Beach. G. That the foregoing be spread upon the Minutes. The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach on above date with Mayor Williamson presiding. Roll Call The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. Absent: Councilmen None. REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer visa read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was accepted, the reading of reports of other heads of departments dispensed with, and all the reports ordered filed. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None, COMMUNICATIONS App. to Various applications for free licenses to peddle home grown products were peddle presented, and on motion of Councilman YJilliamson, seconded by Councilman Brown and carried, same were referred to the Chief of Police for investigation with power to act. The letter of Frank A. Andrews protesting the construction of a board walk F.A.Andrews in the alley between Jade Street and East Bay Front, Balboa Island and requesting that const. of the alley be surfaced, one -half of cost of same to be paid by himself, was presented board walk and read, and on motion of Councilman Claire, seconded by Councilman Gordon End carried, the City Engineer was instructed to furnish an estimate of the cost of the improvement. A letter by E. A. Christy was read in which complaint was made of an alleged E.A.Christy nuisance of several hives of bees kept on the adjoining property and which were depos- hives of bees iting pollen on adjacent property, and requesting that some action be taken immediately to abate said nuisance. On motion of Councilman Whitson, seconded by Councilman Claire and carried, the matter was referred to the Chief of Police and City Attorney for investigation and report. Three hundred and eighteen protests against the establishment of parking Parking in facilities at any place on the Ocean Front, were filed by the Newport Harbor Woments Balboa Association, and after some discussion, the protests, together with the letter of the Chamber of Commerce regarding the posting of prices charged for parking cars in Parking Lots, and the letter of F. A. Polley favoring the Ocean Front Parking Lot, were, on motion of Councilman Claire, seconded by Councilman Whitson and carried, all ordered filed for future reference. The application of the Standard Oil Company for a permit to install under - Standard ground storage for the handling of petroleum products on Lot 7, Block H. Balboa Tract, Oil Co. was on motion of Councilman Claire, seconded by Councilman Whitson and carried, granted storage subject to the approval of the Fire Chief. Residents of Newport Heights presented a petition vigorously protesting the Newport existence and operation of gravel bunkers in that vicinity, the Council being addressed Heights by M. L. Holman, M. U. Rountree and others in connection with the matter, maintaining gravel that the noise and dust incident to the operation of the bunkers constitute a public bunkers nuisance. After some discussion, it was moved by Councilman Claire, seconded by Coun- cilman Whitson and carried that the building inspector be instructed to stop any further construction on the bunkers and that the Mayor appoint a Committee to investi- gate the matter and determine if a nuisance exists and if so to take the necessary steps to abate same. The letter of Grainger Hyer, on behalf of the Balboa Angling Club, requesting Balboa that the Council obtain an estimate of the cost of an extention of three or four hundred Angling Club feet to the Balboa pier, was read, and in view of the fact.that the City'Engineer was add to pier presenting a similar report, it was moved by Councilman Gordon, seconded by Councilman Claire and carried, that the.request be filed for future reference. Residents in the vinlAity of Grand Canal, Marine and Park Avenues, presented Alley in a petition requesting the re- surfacing of the alley in that district, and on motion of Balboa Is. Councilman Whitson, seconded by Councilman Gordon and carried, it was referred to the City Engineer for sa estimate of the cost. Residents of Balboa Island and particularly in the vicinity of Block 1, Section Mooring of 1, presented a petition protesting the mooring of the boat "Parag6ntt in the waters of boat "Paragon °kewport Bay aid fronting on the above named Block, a map was also presented showing the position of the vessel which indicated that it was outside the anchorage area designated for the mooring of boats in that district. The Council was addressed in the matter by Dr. Howard W. Seager, Dr. F. P. Brackett, and Ruby Stanley, property owners in that particular Block, all of whom alleged that the boat not only obstructed the view, but was a menace in case of severe storms, besides being a source of insanitation due to the number of persons comprising the crew of the boat, and further that suitable anchorage could be provided for boats of that type. Frank L. Smith also addressed the Council, stating that moorings and anchor chains were in excess of requirements. After some discussion it was moved by Councilman Vuhitson, seconded by Councilman Gordon and carried, that the City Engineer and Harbor Master be instructed to make a survey of the situation, and if as alleged by the protestants that the.boat was not within the anchor- age area, that the owner thereof be instructed to move the same to the proper area forthwith. • .] L 1 •
