NOES: Councilmen None. ABSENT: Councilmen ivone. 257 Res. 1661 setting wage scale. The report and estimate of Water Superintendent Patterson regarding certain Report on improvements in connection with the 1,Jater System, was on motion of Councilman Claire, imps in seconded by Councilman Gordon and carried, accepted and ordered filed. ':rater Syst?xo W. C. Cutler addressed the Council regarding an application for a self - service laundry at 23rd and Ocean Front, same not being in the industrial zone, it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that same be denied. City Engineer Patterson presented for approval the map of Tract 1049, said Map 'being a re- subdivision of Lot 49, Tract 7429 Balboa Island. After some discussion, no action was taken in the matter. Mrs. Edna Fisher addressed the Council regarding the purchase of fire ho' §e ;:rs.Fisher and the Irvine matter regarding connecting with the City sewer system. Roll call Bids for pipe etc. Bids for re- roofing Bids for fire hose The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. Absent, Councilmen None. On motion of Councilman Whitson, seconded by Councilman Gordon and ' carried, the regular order of business was suspended in order to open bids for furnishing pipe valves and fittings; re- roofing the City Hall and Corona del Mar water reservoirs and for furnishing fire hose. BIDS. Pipe, Valves and fittings. Bids submitted for the furnishing of pipe, valves and fittings were opened and read aloud by the Clerk, whereupon it was moved by Councilman Claire, • seconded by Councilman Gordon and carried, that the bids be referred to the City Engineer for checking and recommendation, action on same to be taken at a meet- ing of the Council to be held at 12 o'clock noon, Wednesday, October 4, 1939. BIDS. Re- roofing City Hall and Water Reservoirs. Bids submitted for the fe�rbofing of the City Hall and Water Reservoirs were opened and read aloud by the Clerk, whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the bids be referred to the City Engineer for checking and recommendation, action on same to be taken at a meeting of the Council to be held at 12,o' clock noon, Wednesday, October 4, 1939. 'BIDS. Fire Hose. Bids submitted for the furnishing of fire hose were opened and read aloud by the Clerk, whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the bids be referred to the Fire Chief for checking and recommendation, action on same to be taken at a meeting of the Council to be held at 12 o'clock noon, Wednesday, October 4, 1939- The telegram received from Eureka Fire Hose Division and submitted as a bid, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, rejected and ordered filed. On motion of Councilman Claire, seconded by Councilman Gordon and ' carried, the regular order of business was resumed. REPORTS OF HEADS OF DEPARTMENTS • The report of the'City Treasurer was read, and on.motion of Councilman Claire, seconded by Councilman Gordon and carried, same was accepted, the read- ing of reports of other heads of departments dispensed with, and all the reports ordered filed. REPORTS OF STANDING COMMITTEES Councilman Whitson presented a report regarding the closing hours of Closing hours public dance halls in various neighboring cities. The report was read by the for dance halls City Clerk, whereupon Councilman Whitson recommended and moved that pending action on a petition pertaining to the matter and now before the Council, that nothing be done in this connection and that the report be filed. The motion was seconded by Councilman Claire and carried, by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown. NOES: Councilman Williamson. ABSENT: Councilmen None. COMMUNICATIONS W.H.Fulghum The application of William H. Fulghum for a license for a grocery license and fish market at 7200 Coast Blvd., was on motion of Councilman Claire, seconded by Councilman Whitson and carried, granted subject to the approval of the Health Officer. Norman Nurseries The application of Norman Nurseries for a permit to install under - gasoline tanks ground storage for the handling of petroleum products, same having been approved by the Fire Chief, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, granted. The letter of Hazel Mayfield, County corresponding Secretary of Rescue work the W. C. T. U., expressing appreciation for the work of Lugo, Dawson and the during storm Harbor Master, during the recent storm, was read, and on motion of Councilman Whitson, seconded by Councilman Gordon and carried, the City Clerk was directed to investigate the probability of securing some worthy recognition in connection with the rescue work done by the above named persons. Nellie Whall The letter of Nellie Whall thanking the City for improvements made thanks on Clubhouse Avenue, was read and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was ordered filed. Petition A petition was presented signed by property owners in the Newport re- construct district urging the Council to take immediate steps toward the re- construction pier of the Newport pier destroyed by the recent storm and recommended that an assessment district be formed for the purpose to include all property in the Newport district bounded by 9th Street on the East. Considerable discussion was had in connection with the matter, Edward H. Allen addressing the Council regarding a similar petition presented at a previous meeting of the Council for the purpose of constructing a pier in the Balboa District. The matter of Federal aid in the projects was also brought up and discussed, the City Clerk reading a communication addressed to Mr. Allen from the WPA authorities regarding possible aid from that source, whereupon the City Engineer explained methods by which Federal aid would need to be applied. Plans for City Attorney Thompson advised the Council that the City Engineer pier projects could be instructed to prepare plans for both projects, and it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the City Engineer be instructed to prepare Report and Debt Limitation proceedings in a district Westerly from Ninth Street to approximately 46th Street. C. E. Dennison and Wm. A. Kirk each addressed the Council concerning the re- building of piers, Mr. Dennison suggesting that the entire City be bonded to pay for same. Harry Estus also addressed the Council and suggested that the Council proceed with the matter without a definite district being set. City Engineer Patterson suggested that a Committee meet with the Council in order to work out the matter of Assessment Districts. Petition for The City Clerk reporting on a certain referendum petition filed on reducing salary September 25, 1939 for the purpose of placing upon the November 7th ballot the of couoilmen question of reducing the salaries of the City Councilmen from fifty dollars per month to twenty -five dollars per month, advised that the petitions had been checked against the Great Register of Orange County and had been found to be sufficient. Whereupon City Attorney Thompson ruled that inasmuch as the proper procedure had not been followed in accordance with the statutes respecting referendum petitions, the Council could not legally consider the petition. On motion of Councilman Whitson, seconded by Councilman Claire and carried, the petition was ordered filed. Petition for The City Clerk reporting on a certain referdndum petition filed on establishing September 25, 1939 for the purpose of placing upon the November 7th ballot the closing hours question of establishing certain closing hours where public dancing is allowed, for dance halls advised that the petition had been duly checked against the Great Register of Orange County and had been found to be sufficient. Whereupon City Attorney Thompson advised that the same ruling applied as in the other petition, and on motion of Councilman Whitson, seconded by Councilman Claire and carried, the petition was ordered filed. H. L. Sherman addressed an inquiry to the City Attorney as to the date of the enactment of the statute on which the ruling on the petitions was based. Applications Applicationd of Harvey L. Bear and Frank Vaughan for the lease of a for lease on certain 34 acres of City owned land were presented and read, and on suggestion 34 acres of Councilman Gordon that inasmuch as more than one application had been filed, bids should be advertised for, and on motion of Councilman'Gordon, seconded by Councilman Brown and carried, the City Clerk was instructed to advertise for bids for the rental of the land. C.E.Dennison The communication of C. E. Dennison offering to convey to the City of offer of strip Newport Beach a certain 1,000 foot strip of beach property at 15th Street for of beach for the sum of $1$,000 was presented and read. Mr. Burton,owner of said land, sale. addressed the Council regarding the matter and requested a permit to erect a bath house thereon in case the City did not wish to purchase same. On motion of Councilman Gordon, seconded by Councilman Claire and carried, the matter was laid on the table. Boat races The request of Hubbard Howe, Chairman of the Yachting Committee of the Newport Harbor Chamber of Commerce, for permission to hold speedboat races in the County Channel on November 12th, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed, and the Harbor Master and Chief of Police instructed to attend same. E.J.Allen The contract submitted by E. J. Allen for the furnishing of lamps contract for for City street lighting was presented, and on motion of Councilman Claire, lamps. seconded by Councilman Whitson and carried, the 14ayor and City Clerk were authorized to execute same on behalf of the Cityo E • • • �0V NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, Demands were on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Whitson and City Clerk carried, the City Clerk was instructed to attend the Conference of Assessors to convention be held in San Francisco from the 9th to the 16th of October and fifty dollars was appropriated for expenses in connection therewith. The request of Chief of Police Hodgkinson for permission to take his Chief of vacation from October 15th to November 1st for the purpose of attending the State Police Peace Officers Convention in Santa Cruz, October 19th to 21st, was on motion of convention Councilman Claire, seconded:by Councilman Gordon and carried, granted and fifty dollars appropriated for the purpose. City Attorney Thompson in accordance with instructions of the Council Advertising T.M.Mills at a previous meeting, presented an ordinance, being an ordinance amending Zoning structures ' the proposed piers at Balboa and Newport. Ordinance No. 440 and pertaining to the regulating of Advertising Structures. On motion of Councilman Whitson, seconded by Councilman Brown and carried, the ordinance was referred to the Planning Commission. City Engineer Patterson reported on the petition presented by residents Petition of Tract 519 requesting that a pier be constructed at the foot of "N" street in for pier at • that district, and presented estimates as to the cost of same. Grainger Hyer "N" St. addressed the Council and suggested that the cost of the pier be included with the proposed pier at Balboa. Councilman Whitson recommended that the cost of of construction of a pier at "N,' Street be included with the Balboa pier, providing the petitioners for the Balboa pier are agreeable. On motion of Council- man Gordon, seconded by Councilman Claire, the matter was laid on the table by the ' following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown. Resolution No. 1662. WHEREAS, GEORGE W. ORME and MARTHA I. ORME, Res. 1662 husband and wife, have this day offered to the CITY OF NEWPORT BEACH, the sum of sale of lot $300.00 for Lot 24, Block B, Tract 673, in the city of Newport Beach, as shown on to GeorgeW. Map recorded in Book 20, pages 17 and 19 of Miscellaneous Maps, records of Orange Orme et ux County, California; and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lot; and ' WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the said sum of $300.00; and WHEREAS, the price offered is just, fair and adequate and is not dis- proportionate to the real value of the property above described. NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the • said George W. Orme and Martha I. Orme, husband and wife, for the sum of $300.00 free and clear of all encumbrances, subject to the taxes for the fiscal year 1939 -40 and unpaid improvement assessments of record. Also subject to conditions, restrictions and reservations of record. The Mayor and the City Clerk are hereby authorized and directed to execute and deliver a deed for said property to the said parties upon receipt of the consideration above set forth. BE IT FURTHER RESOLVED: That the sum of $30.00 be paid to F. L. Andrews, as and for his commission for the negotiating of the sale of said real property to George W. Orme and Martha I. Orme, his wife, as joint tenants, said sum being a fair and reasonable commission to be allowed in said sale, and said broker being a licensed realtor of the City of Newport Beach. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach at a regular meeting thereof held on the 2nd day of October, 1939 by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. Fire Hydrants bid Bids -re- roofing Vance Roofing Company, City Hall Roof bid It was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the regular order of business be suspended in order to receive the City Engineer's report on bids submitted for "furnishing Pipe, Valves, Fittings and Fire Hydrants, also for re- roofing the City Hall and Corona del Mar water reservoirs. City Engineer Patterson advised that 17 bids had been received in all for furnishing Pipe, Fittings, Gate Valves and Fire Hydrants. The bid of the American Cast Iron Pipe Company, being the lowest bid submitted for furnishing the pipe, it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the bid be accepted, the City Engineer was authorized to purchase same, all other bids on same were rejected and checks or bonds of the unsuccessful bidders ordered returned. The bid of the Santa Ana Iron Works, being the lowest bid submitted for Fittings, it was moved by Councilman Claire, seconded by Councilman Brown and carried; that the bid be accepted, the City Engineer was authorized to purchase same, all other bids on same were rejected and checks or bonds of unsuccessful bidders ordered returned. The bid of the Utilities Supply Company, being the lowest bid submitted for furnishing Gate Valves, it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the bid be accepted, the City Engineer was authorized to purchase same, all other bids on same were rejected and checks or bonds of unsuccessful bidders ordered returned. The bid of the Utilities Supply Company, being the lowest bid submitted for furnishing Fire Hydrants, it was moved by Councilman Claire,seconded by Councilman Gordon and carried, that the bid be accepted, the City Engineer was authorized to purchase same, all other bids on same were rejected and checks or bonds of uneuccessful bidders ordered returned. The City Engineer advised that 7 bids-bad been received in all for re- roofing the City Hall and the Corona del Mar water reservoirs. The bid of the Vance Roofing Company being the lowest bid submitted for the re- roofing of the City Hall in accordance with specification No. 3, adopted by the City Council, it was moved by Councilman Brown that a Resolution be adopted, being'a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach, an agreement with the Vance Roofing Company for performing said work in conformancy with said agreement and specifications and to the satisfaction of the City Engineer of the City of Newport Beach. The motion was duly seconded by Councilman Whitson and the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None.
