Newport Beach, October 16, 1939.
The City Council of the City of Newport Beach met in adjourned regular
session in the City Council Chambers at the City Hall in the City of Newport
Roll Call
Beach on above date with Mayor Williamson presiding.
The roll was called, the following Councilmen answering present: Gordon,
Claire, Whitson, Brown, Williamson. Absent: Councilmen None.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS
Mooring of
The communication from Charles and Laura Sandquist regarding mooring
"Louie Carson"
for the schooner Lottie Carson was read, and on motion of Councilman
Claire,
Claire, seconded by Councilman Gordon and carried, was referred to a Committee
to be appointed by the Mayor. Whereupon Mayor Williamson appointed the City
Engineer, Councilmen Claire and Brown as a Committee to investigate and report
as to the cost of providing the anchorage.
J.H.Bowen
The letter of James Harrison Bowen asking for a concession to install
booths on the beach for the purpose of spraying bathers with suntan oil, was
concession
read, and on motion of Councilman Claire, seconded by Councilman Brown and
carried, the City Clerk was instructed to inform the.applicant to the effect
that no concessions are permitted on the beaches in the City.
Industrial
A letter from the Industrial Workshop of the Blind was presented

and carried, same was referred to the Street Superintendent.

The invitation from the American Legion Post of Huntington Beach
Legion -parade
to place an entry in the Armistice Day parade to be held in that City, was
read, and on motion of Councilman Claire, seconded by Councilman Whitson and
carried, same was referred to the Chamber of Commerce.
Petition
The petition of residents in the vicinity of Bay Front between
cement rocks
Island and Alvarado Streets, requesting that the rocks be cemented in place
along the Bay Front in order to protect the sidewalk and swimmers from being
cut on same, was presented and read, and on motion of Councilman Gordon,
seconded by Councilman Whitson and carried, the petition was referred to the
City Engineer and a Committee for estimate as to cost and to report at the
next meeting of the Council.
Fire Chief
The letter from the Fire Chief regarding the purchase of oxygen
tanks
tanks was read, and after some discussion on the subject it was moved by

Councilman Claire, seconded by Councilman Gordon and carried, that the same
be filed.
Federal Aid for
A letter from the City Engineer in reference'to the securing of
piers.
Federal Aid in connection with the construction of the proposed Balboa pier,
together with a communication from V. R. Seawall, Director, Division of Oper-
ations, was read, and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, same was accepted and ordered filed.
Petition
A petition bearing upwards of 600 signers from various parts of
the City and requesting that the City Council call a special election for
piers
re- construction of the two ocean- goiftg piers, was presented, and on motion
of Councilman Gordon, seconded by Councilman Claire and carried, the matter
was referred to a Committee of the Whole to meet with the interested parties
in order to go into the proposition. Councilman Claire suggested that the
question of forming of 1911 Assessment Districts should go ahead without
delay in case the bond issue failed to carry.
Petrol Corp,
The application of the Petrol Corporation'for permission to install
gasoline storage
underground storage for the handling of petroleum products, was on motion of
Councilman Claire, seconded by Councilman Gordon and carried, granted su.1iject
to the approval of the Fire Chief.
UNFINISHED BUSINESS
Fire Hose bids
The letter from the Fire Chief, regarding the bids received for the
rejected.
purchase of fire hose, advised that after checking over same he would recommend
that all bids should be rejected and no purchase made at this time. On motion
of Councilman Brown, seconded by Councilman Whitson and carried, the recomm'en-
dation of the Fire Chief was accepted.
BIDS FOR LEASE OF CITY OWNED PROPERTY.

Bids received for the leasing of a certain 34 acres of City owned

property ordered advertised for at a previous meeting of the County, were
opened and read by the City Clerk, two bids having been submitted, as follows:

HARVEY L. BEAR. Proposition No. 1 - Cash Rental. I hereby offer to
bid
the City of Newport Beach the sum of $1800.00 for a three year lease, ayable
in the manner provided for by said general provisions and as follows: $600.00
for the first year's rental, which amount I am sending you herewith by certified
check, and the balance of $1200.00 as follows: $600.00 on October lst,'1940,
and $600.00 on October lst, 1941.
Proposition No. 2 - Crop rental. I agree to give to
the City of Newport Beach as crop rental in the event that you do not wish to
accept the cash rental proposition the following: One -third of all beans raised
on said premises and as thrashed and sacked, divided in the field, and one -third
of the straw, divided at the machine as baled, and in the event the city so
desires, I will haul the beans as sacked to the Greenville Bean House without
charge to the city.

FRANK R. VAUGHN. I hereby submit a bid for the lease cf the 34 acres
of City owned land located at the corner of Harbor Boulevard and Huntzinger
Street upon the following terms: Will plant the entire 34 acres to beans only,
which will tend to reclaim that portion affected with alkali. Will use the
pumping plant for the irrigation of the City's land only. The above bid is
based on a crop rental basis of one - fourth share of the crop, or a share
agreeable to the City, said share of crop to be delivered to the City at the
bean warehouse. The above lease is desired for a period of three or more years
in accordance with the wishes of the City.

ADJOURNMENT
On motion of Councilman Claire, seconded by Councilman Gordon and
carried, an adjournment was taken to 7:30 o'clock p.m., Monday, October 23, 1939•

Some discussion followed regarding the bids, Councilman Gordon was

crop rental, whereupon it was moved by Councilman Claire, seconded by Councilman
Gordon and carried, to accept the bid of Harvey L. Bear, the City Attorney being
instructed to prepare the necessary contract and the Mayor and City Clerk were
authorized to execute same on behalf of the City. See Resolution No. 1662 -A.

The City Attorney brought up the matter'of the application of J. A. Beek

for an extention of a certain lease covering City owned property known as 'Beacon
lease
Bay', same having been presented at a previous meeting of the Council. There was
extension
considerable discussion regarding the subject, some from members of the Council
objecting to certain phases of the agreement, particularly the section including
buildings erected prior to the acceptance of the lease extension agreement. The
Council was addressed by J. A. Beek and Earl Stanley in connection with the matter.
On motion of Councilman Gordon, seconded by Councilman Whitson and carried, the
agreement was referred back to the City Attorney for revision and presentation at
the next meeting of the Council.
NEW BUSINESS

Resolution No. 1663. WHEREAS, INER SHELD - RITCHIE and INELDA SHELD- RITCHIE,

husband and wife, have this day offered to the CITY OF NEWPORT BEACH, the sum of

$650.00 for Lots 22 and 24, Block 139, Re -Sub of Corona del Mar in the City of

NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said

$650.00, free and clear of all encumbrances, subject to the taxes for the fiscal
year 1939-40 and unpaid improvement assessments of record. Also subject to
conditions, restrictions and reservations of record. The Mayor and the City
Clerk are hereby authorized and directed to execute and deliver a deed for
said property to the said parties upon receipt of the consideration above set
forth.
I hereby certify that the above and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of Newport Beach at
an adjourned regular meeting thereof held on the 16th day of October, 1939, by
the following vote, to -wit:

Much discussion was had concerning the proposed'bond issue in connection

also addressed the Council in reference to the piers. City Attorney Thompson
explained the method of calling the special bond election.

explained the situation and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, the City Engineer was authorized to install a vent or other
necessary means to remedy the trouble.
