PLANNING COMMISSION
Resolution No. 161 of the City Planning Commission was presented,
being a resolution in connection with a certain variance requested by Joseph
B. Parks for property described as Lot 3, Block 1, Section 5, Balboa Island.
After some discussion regarding the matter, it was moved by Councilman Claire,
seconded by Councilman Gordon and carried, that same be laid on the table
until the next meeting of the Council.
Resolution No. 162 of the City Planning Commission was presented,
beingg a resolution granting a variance to James C. and Janet D. Fraizer, of
33 1/3 side yard set back for a garage and for the property described as Lot
1, Block 536, Canal Section, Whereiipon :Cduncilman Claire moved the adoption
of a resolution, being a resolution approving the resolution of the Plannin
Commisiion.,The above Minute Resolution was approved.unanimously by roll call vote.
City Engineer Patterson presented a letter from the Metropolitan
Water District regarding the annexation of the City of Newport Beach to.that
district. The letter was read and after some discussion it was moved by
Councilman Claire, seconded by Councilman Gordon and. carried that the Mayor
appoint some citizen to act with the City Engineer,regarding the matter.
J. H. Mills addressed the Council with thanks for the allowing of
use of certain City owned property for the storage of bait tanks.
ADJOURNMENT
On motion of Councilman Claire, seconded by Councilman Gordon and
carried, an adjournment was taken Sine Die.

The City Council of the City of Newport Beach met in regular session
in the City Council Chambers at the City Hall in the City of Newport Beach on
above date with Mayor Williamson presiding.
The roll was called, the following Councilmen answering present,
Gordon, Claire, Whitson, Brown, Williamson. Absent: Councilmen None.
REPORTS OF HEADS OF DEPARTMENTS
It was moved by Councilman Claire, seconded by Councilman Whitson and
carried, that the reading of reports of heads of departments be dispensed with
and all the reports ordered filed.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS
Residents of blocks 9 and 9 in the Balboa Tract, presented a petition
protesting the removal of a certain eucalyptus tree in that district, and on
motion of Councilman Claire, seconded by Councilman Brown and carried, the
matter was referred to Chairman Gordon of the Street Committee.
R. S. Downing presented an application for the'position of custodian
of the Trailer Park, if such should be established on the City owned property
situated on the State Highway. On motion of Councilman Claire, seconded by
Councilman Gordon and carried, the communication was ordered filed.
J. M. M. Leonard presented a request for a portion of City insurance
business, and after some discussion regarding the question as to the applicant
having a City license to engage in said business, it was moved by Councilman
Claire, seconded by Councilman Whitson and carried, that the application be
filed.

be accepted, the motion was duly seconded by Councilman Whitson and the Resolutions

The monthly demands having been duly audited by the Finance Committee,
were on motion of Councilman Claire, seconded by Councilman Gordon and carried,
allowed and warrants ordered drawn for same.
Minute Res. MINUTE RESOLUTION. City Engineer Patterson presented plans and specifications
Approving plans in connection with the construction of two municipal piers for which bonds in the
and specificationssum of $130,000 were voted and sold. Whereupon Councilman Claire moved the adop * -
for piers ion,of a resolution, being a resolution accepting and approving said plans and
specifications as prepared by the City Engineer, the motion was duly seconded by
Councilman Gordon and the resolution adopted by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.

certify that the above and foregoing Resolution was passed and adopted by the
City Council of the City of Newport Beach a regular meeting thereof held on

Resolution No. 1710 was presented, being in full as follows:

WHEREAS, the City Council of the City of Newport Beach has ordered

published a Notice Inviting Bids for the furnishing of labor, materials, trans -
labor on piers
portation and services for the construction of an ocean pier located at the
southerly extension of Main Street and an ocean pier located at the southwesterly
extension of McFadden Place, and other work incidental thereto; in the City of
Newport Beach; and
WHEREAS it became necessary for the City Council of the city of
Newport Beach, prior to the giving of said Notice referred to in the previous
paragraph, to ascertain and determine the general prevailing rate of per diem
wages and rapes for legal holidays and overtime work in the locality in which
the work of construction above mentioned is to be performed, and further,
it became necessary to determine and ascertain the general prevailing rate of
per diem wages for each craft or type of workman or mechanic needed to execute
the.conttact which will be awarded to the successful bidder, pursuant to said
Notice Inviting Bids; and
WHEREAS, prior to the giving of said Notice Inviting bids, the City
Council of the city of Newport Beach, after due consideration and study, has
ascertained and determined the prevailing rate of per diem wages and rates
for legal holidays and overtime work in the locality in which the work herein

mentioned is to be performed, for each craft or type of workman or mechanic needed
to execute the contract which will be awarded to the successful bidder pursuant to
said Notice Inviting Bids.
• NOW, THEREFORE, BE IT RESOLVED AND DETERMINED that the general prevailing
rate of per diem wages and rate for legal holidays and overtime work in the locality
in which the work of construction of the piers in this resolution mentioned is to be
performed for each craft or type of workman or mechanic needed to execute the contract
which will be awarded the successful bidder pursuant to Notice Inviting Bids, is as

BE IT FURTHER RESOLVED that the foregoing schedule of per diem wages is
based upon a working day of eight (6) hours. The hourly wage rate prescribed
hereinabove is the per diem rate divided by the aforementioned number of hours
constituting a working day.
BE IT FURTHER RESOLVED that one and one -half (1j) times the prevailing
rate herein determined shall be paid except, watchmen, flagmen and other non -
manual workers, for any working time more than eight (6) hours during any one (1)
calendar day where such work is required in cases of extraordinary emergencies
caused by fire, flood, or danger to life or property, and for time on-Sundays
and the seven (7) legal holidays, to -wit: New Year's Day, Memorial Day, Fourth
of July, Labor Day, Armistice Day, Thanksgiving Day and Christmas.
BE IT FURTHER RESOLVED that it shall be mandatory upon the Contractor
to whom the contract is awarded, and upon nay subcontractor under him to pay not
less than the said specified rates to all laborers, workmen and mechanics employed
by them in the execution of the contract.
' I hereby certify that the abole and foregoing Resolution was duly and
regularly passed and adopted by the City Council of the city of Newport Beach at
a regular meeting ibhereof held on the 1st day of January, 1940, by the following
vote, to -wit:
• AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
