The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock p. m, on above date, with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Roll Call Claire, Whitson, Brown, Williamson. Absent, Councilmen None. ' REPORTS OF SPECIAL COMMITTEES The City Engineer made a tentative report and estimate in the matter WPA improvemen of certain proposed improvements through the medium of WPA, as presented at the last meeting of the Council, and comprising improvement of alleys; extension of Palm Street; establishing a Trailer Camp on the North Channel of the Bay; and the replacing of water main in the Santa Ana River bed. After some discussion it was moved by Councilman Claire, seconded by Councilman Gordon that the matter be referred to the City Engineer for a definite estimate of the various projects together with an application to the WPA for assistance in connection with the projects and to present same at the next meeting of the Council. The motion was carried by the following vote, to -wit: 4° AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Councilman Brown reporting for the Fire Committee in connection with Fire Hose the purchase 'of 2,000 feet of 2J inch fire hose, advertised for and for which bids were opened at the last meetin g of the Council and referred to the Fire Committee for investigation and recommendation, submitted the following report: • "We, the undersigned Fire Committee, recommend the purchase of 2,000 feet of 2z inch fire hose from The American Rubber Manufacturing Fire Committee Company, as per specifications of -the City of Newport Beach. report The American Rubber Manufacturing Company has submitted the low bid of $ .79 per foot for fire hose, as specified by the City of Newport ' Beach. Crocker FIRE COMMITTEE On motion of Councilman Claire, seconded by Councilman Gordon and carried, the report of the Fire Committee was accepted, ordered filed, the bid of the American Rubber Company accepted and all other bids rejected, the City Clerk being instructed to return to the unsuccessful bidders the checks submitted with their bids. On motion of Councilman Whitson, seconded by Councilman Brown and carried, the City Attorney was instructed to prepare the necessary contract between the City of Newport Beach and the American Rubber Company. Resolution No. 1771 -A, was presented, being a resolution author- Res. 1771 -A izing the Mayor and the City Clerk to sign the contract with the American Cont. with Rubber Company on behalf of the City of Newport Beach, and on motion of American Coufte4.lman Whitson, seconded by Councilman Brown, the resolution was adopted Rubber Co.for by the following vote, to -wit: fire hose. AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. City Attorney Thompson presented a written report regarding the complaint made by Mr. Titus of 202 E. Surf Avenue, of a fence said to be Mr.Titus obstructing the view from his property. The report was read, and on motion view of Councilman Claire, seconded by Councilman Whitson and carried, the matter ' was referred to the City Engineer and the Building Inspector with power to act. Mr. Titus addressed the Council regarding the fence and advised that he wishdd to cause no trouble in the matter. COh=NICATI ONS The application of P. S. Allen for a permit to take out a license P.S.Allen • to operate a candid camera from March 14th to March 24th, was on motion of application Councilman Claire, seconded by Councilman Brown and carried, denied. for license The application of L. B. Shaver for a free license to sell home grown produce to stores and restaurants, was on motion of Councilman Claire, L.B.Shaver seconded by Councilman Whitson and carried, ordered filed and the applicant app.for lic. declared to be subject to the wheel tax license. The letter of Hal Will Smith, President of the Newport•Harbor H.W.Smith Realty Board, endorsing the Planning Commission and City's action in restrict- billboards ing the use of advertising structures and business signs in the residential areas, was presented and read, and on motion of Councilman Whitson, seconded by Councilman Gordon and carried, was ordered filed. The letter of Grainger Hyer relative to a certain real estate sign G.Hyer at 1221 W. Bay Avenue and other alleged similar violations of the Zoning signs Ordinance, was read, same bringing out some comment from members of the Council and Mr. Byer. On motion of Councilman Brown, seconded by Councilman Whitson and carried, the letter was ordered filed. Curbs on The City Engineer presented a plan and estimate of cost of construction of curb along bridge approaches to Lido Isle. After some deliberation on the Lido bridge subject it was moved by Councilman Claire, seconded by Councilman Whitson and approaches carried, that the Street Superintendent be instructed to install curb on the west side approach to the Lido Isle bridge. • 316 RUBBER TUBE Thickness of tube 70/1000 inches Shall betnbt less than 5 ply rubber Tensile strength of tube 2000/2500 lbs, per inch Friction of tube to inner jacket - 22/25 lbs. National Standard Thread Hose gaskets to be Koroseal. Demands The demand in favor of Theodore Robins for the purchase of truck for ' the Water Department and the demand in favor of Wm. S. Little, were on motion - of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. Res. 1778" Resolution No. 1778 was presented, being a resolution accepting a quitclaim on quitclaim deed to the City of Newport Beach from William S. Little and Abbie • delinquent E. Little, husband and"wife, and covering Lots 11, 13 and 15, Block 537, property Corona del Mar, as shown on a Map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, records of Orange County, California. Whereupon, it was moved by Councilman Claire that the quitclaim deed be accepted. The motion was duly seconded by Councilman Gordon and the resolution passed by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 1779 It was moved by Councilman Claire, duly seconded by Councilman Gordon, sale of lots that the following Resolution No. 1779 be adopted. to Earl K. WHEREAS, EARL K. LEE and EFFIE A. LEE, husband and wife have this day Lee et ux offered to the CITY OF NEWPORT BEACH the sum of $675.00 for Lots 2 and 4, Block 240, Corona del Mar, in the city of Newport Beach, as shown on Map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, records of Orange County, California; and WHEREAS, the saidprice is a fair and adequate price as and for the purchase price of said lots; and ' WHEREAS, the City Council of the City of Newport Beach deems that it ' is for the best interests of said City that said property be sold for the said sum of $675.00; and WHEREAS, the price offered is just, fair and adequate and is not disproportionate to the real value of the property above described. • UNFINISHED BUSINESS 1940 In the matter of the request of the Newport Harbor Publishing Company Directory for an appropriation in connection with the Dawson directory for 1940, Mayor Williamson suggested that same be referred to the Chamber of Commerce, and on • Dredging motion of Councilman Claire, seconded by Councilman Gordon and carried, the in Balboa request was referred to that body. Piers The matter'of additional improvements to the Newport and Balboa piers was brought up, the City Engineer presented a detailed report of same which was , read by the Clerk, and after some discussion, particularly of the proposed improvements in connection with the Balboa pier, it was moved by Councilman Gordon, seconded by Councilman Claire and carried, that the question be laid on Specifications the table in order that the property owners be contacted as to their wishes in for fire hose connection with improvements at Balboa. Dredging Councilman Whitson brought up the matter of dredging the sand in in Balboa front of the Balboa Pavilion and depositing same in front of Block B, Balboa, where erosion of the beach has develop6d, -and moved that the City Engineer furnish an estimate of the cost of removing the sand and the construction of a groyne westerly of the Harbor Master's office in order to prevent further dtifting. The motion was seconded by Councilman Claire and carried. The Mayor and the City Clerk are hereby authorized and directed to execute and deliver a deed for said property to the said parties upon receipt of the consideration above set forth. BE IT FURTHER RESOLVED: That the sum of $67.50 be paid to Frank L. Andrews, as and for his commission for the negotiating of the sale of said real property to Earl K. Lee and Effie A. Lee, his wife, as joint tenants, said sum being a fair and reasonable commission to be allowed in said sale, and said broker being a licensed r ealtor of the City of Newport Beach. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 11th day of March, 1940 by the following vote, to -wit: AYES', COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. It was moved by Councilman Claire, duly seconded by Councilman Gordon, Res. 1780 that the following Resolution No.1780 be adopted. sale of lot �t WHEREAS, LARTON F. ACKERSON and HATTIE ACKERSON, husband and wife, to Larton F. have this day offered to the CITY OF NEWPORT BEACH, the sum of $150.00 for Lot Ackerson et ux 2, Block 232, ]Cake Tract, in the city of Newport Beach, as shown on Map recorded in Book 4, page 13 of Miscellaneous Maps, records of Orange County, California; • and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lot; and WHEREAS,the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the said sum of $150.00; and ' WHEREAS, the price offered is just, fair and adequate and is not disproportionate to the real value of the property above described. NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said Larton F. Ackerson and Hattie Ackerson, husband and wife, for the sum of $150.00, free and clear of all encumbrances, subject to the second half of taxes for the fiscal year 1939 -40 and unpaid improvement assessments of record. Also subject to conditions, restrictions and reservations of record. The Mayor and the City Clerk are hereby authorized and directed to execute and deliver a deed for said property to the said parties upon receipt of the consideration abo le set forth. BE IT FURTHER RESOLVED: That the sum of $15.00 be paid to Eugene Elliott, as and for his commission for the negotiating of the sale of said real property to Larton F. Ackerson and Hattie Ackerson, his wife, as joint tenants, said sum being • fair and reasonable commission to be allowed in said sale, and said broker being • licensed realtor of the City of Newport Beach. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 11th day of March, 1940 by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. Councilman Claire moved the adoption of a Resolution, being a Minute Res. resolution authorizing the Mayor and City Clerk to execute on behalf of the City quitclaim to of Newport Beach a quitclaim deed in favor of Frances E. Bower and covering Frances E. Lot 16, Block 5, Section 2, Balboa Island, as shown on Map recorded in Book Bower 6, page 31 of Miscellaneous Maps, records of Orange County, California. The ' motion was duly seconded by Councilman Gordon and the resolution passed by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. NOES, COUNCILMEN: None. The motion was duly seconded by Councilman Gordon and the resolution passed by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson. NOES, COUNCILMEN: None.
