Newport Beach, April 15, 1940
. The City Council of the City of Newport Beach met in adjourned regular
session in the City Council Chambers at the City Hall in the City of Newport Beach
at 7:30 o'clock p. m. on above date with Mayor Williamson presiding.
The roll was called, the following Councilmen answering present: Gordon, Roll Cali
Claire, Whitson, Brown, Williamson. Absent, Councilmen None.
REPORTS OF SPECIAL COMMITTEES
City Attorney Thompson presented and read a report on the matter of
abandonment of certain portion of 24th Street (now 26th Street) in the City of
Newport Beach. On motion of Councilman Claire, seconded by Councilman Brown and
carried, the report was accepted and the City Clerk instructed to send a copy of
same to Glenn Helms.
City Engineer Patterson presented an estimate of the cost of the Newport
and Balboa piers and the cost incurring from certain changes ordered, not a part of
the general contract and a total cost including changes and additions on the plans
approved April.1st, and also a quotation from the Mojave Corporation for performing
certain proposed additional work. After considerable discussion regarding the
matter, Councilman Brown advising against the additional work particularly the
placing of palms and shrubbery, it was moved by Councilman Whitson, seconded by
Councilman Williamson that the work be authorized in accordance with the City
Engineer's estimate. On roll call the motion was carried by the following vote,
to -wit:
AYES, COUNCILMEN: Gordon, Whitson, Williamson.
NOES, COUNCILMEN: Claire, Brown.
ABSENT, COUNCILMEN: None.
It was moved by Councilman Williamson, seconded by Councilman Whitson
' that the quotations submitted by the Mojave Corporation for the additional work
on the Balboa pier approach be accepted. The motion was carried by the following
vote, to -wit:
AYES, COUNCILMEN: Gordon, Claire, Whitson, Brown, Williamson.
ABSENT COUNCILMEN:' None.

On motion of Councilman Claire, seconded by Councilman Gordon and
carried, the petition on file including the letter of-E. H. Allen, in connection
with the improvements to the Balboa pier approach were ordered filed.
City En ' er Patterson resented an est'mate.of cost of removin sand
under the Balboa �avilion floats at approximately 115.00 and stated that the City
dredge would be available for the work after April 22nd. On motion of Councilman
Whitson, seconded by Councilman Claire and carried, the removal of said•was
authorized. •

together with report on the petition complaining of the alledged encroachment
by Dr. Soiland upon the public's ingress to the Bay Front.

UNFINISHED BUSINESS
Ordinance No. 491, being an ordinance declaring it unlawful to permit or
allow dogs in or upon any public pier in the City of Newport Beach, was presented
for final passage. The Ordinance was read in full and on motion of Councilman
Whitson, seconded by Councilman Brown, the ordinance was adopted by the following
vote, to -wit:

• Ordinance No. 492, being an ordinance declaring it unlawful to ride,
operate.or drive bicycles or motorcycles in or upon any public pier in the City
of Newport Beach, was presented for final passage. The Ordinance was read in full,
and on motion of Councilman Whitson, seconded by Councilman Brown, was adopted by
thefollowing vote, to -wit:

NEW BUSINESS
Demands Certain demands for election officers and election expenses were
presented, having been duly audited by the Finance Committee, and on motion of
Councilman Claire, seconded by Councilman Gordon and carried, the demands were
allowed and warrants ordered drawn for same.
Res. 1795 It was moved by Councilman. Claire, duly seconded by Councilman Gordon,
sale of lot that the following Resolution No. 1795 be adopted.
to Dongald E. WHEREAS, DONGALD E. SKINN and ADELINE M. SKINN, husband and wife; have

1940 -41 and unpaid improvements assessments of record. Also subject to conditions,
restrictions and reservations of record. The Mayor and the City Clerk are hereby
authorized and directed to execute and deliver a deed for said property to the
said parties upon receipt of the consideration above set forth.
BE IT FURTHER RESOLVED: That the sum of $15.00 be paid to Ralph P.
Maskey, as and for his commission for the negotiating of the sale of said real
property to Dongald E. Skinn and Adeline M. Skinn, his wife, as joint tenants,
said sum being a fair and reasonable commission to be allowed in said sale, and
said broker being a licensed realtor of the City of Newport Beach.

election herein mentioned, to -wit:
PROPOSITION NO. 1
Shall the City Council of the City of Newport Beach enact an
ordinance prohibiting dancing in public dance halls, cafes,
restautants, dining rooms and other public places in the city
of Newport Beach, between the hours of twelve o'clock midnight
and nine o'clock A.M.; fixing the penalty for the violation
thereof; defining dance halls; repealing all ordinances or
parts of ordinances in conflict with this ordinance?.
PROPOSITION NO. 2
Shall the City Councilmen who take office subsequent to the
canvass of the returns of this election receive compensation
in the'sum of $25 per month in lieu of $50 per month as heretofore
voted by the people in full for their services as such Councilmen,
excepting that any member of the City Council who may be appointed
or elected to fill a vacancy shall receive the same compensation
as that payable to such member whose office was vacated?

Assuming

Frank L. Rinehart having been duly elected to the office of City Clerk
of the City of Newport Beach, .presented his certificate of election, took and
subscribed the Constitutional Oath of Office, which was filed with the Clerk and he
being duly qualified, entered upon and assumed the duties and responsibilities of
City Clerk of the City of Newport Beach.
The Clerk was thereupon directed to deliver to each of the persons elected
ito
offices, a certificate of election signed by him and duly authorized; to adminster
to each the Constitutional Oath of Office and to have said person subscribe thereto.
The term of office of Harry H. Williamson and Elmer B. Whitson having
expired, their seats were vacated and they retired from the City Council.
J. A. Gant, Irvin George Gordon, 0. B. Reed and Robert Allen having been
duly elected to the offices of City Treasurer, and City Councilmen respectively,
presented their certificates of election, took and subscribed the Constitutional
Oath of Office, which was filed with the Clerk, and they being duly qualified,
entered upon and assumed the duties of City Treasurer and Councilmen of the City of
Newport Beach.
ORGANIZATION
The City Clerk entertained a motion by Councilman Claire, seconded by
Councilman Brown that 0. B. Reed, Councilman -elect be made Mayor pro tem, the
motion was carried unanimously, Whereupon Mayor pro tem Reed entertained a motion
by Councilman Brown, seconded by Councilman Allen that Irvin George Gordon be
appointed as Mayor, which was carried unanimously. Whereupon Mayor Gordon assumed
the duties of the Chair and proceeded to appoint the Finance Committee, consisting
of Councilman Claire and Councilman Brown, and Chairmen of other Committees as
follows: Councilman Reed, Street Committee; Councilman Allen, Police Committee;

The bonds of City Treasurer Gant and City Clerk Rinehart, having been
approved by the City Attorney, were presented, and on motion of Councilman Claire,

Applications City Engineer Patterson presented and approved the application of Armin
for piers & H. Winterberg for permission to construct a pier and slip float fronting on Lot
floats 10, Block 1, Tract 626; C. L. Thompson to construct a pier and float fronting on
Lot 439, Tract 907; and Mark Healy to construct a pier and float fronting on Lot
3, Block 1, Section 4, Balboa Island. On motion of Councilman Claire, seconded by
Councilman Reed and carried, the applications were approved.
Application On motion of Councilman Claire, seconded by Councilman Allen and carried,
to WPA the City Engineer was authorized to make application to the WPA in connection with
the Recreation project.
