HomeMy WebLinkAbout06/02/1941 - Regular MeetingNewport Beach, June 2, 1941. • O The City Council of the City of Newport Beach met in regular session ' in the City Council Chambers at the City Hall in the City of Newport Beach at the hour of 7:30 P. m. on above date with Mayor Gordon presiding. The roll was called, the following Councilmen answering present: Roll Call Reed, Claire, , Brown, Gordon. Absent, Councilmen: Allen. On motion of Councilman Brown, seconded by Councilman Claire, and carried, the reading of the minutes of the previous meeting was dispensed with. REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer was read, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the report was approved, the reading of the rest of the reports dispensed with and all the reports ordered filed. 1`• r ^, REPORTS OF SPECIAL COMMITTEES City Attorney Thompson reporting on 'the matter of the Buena Vista Walter Simon controversy-,.,advised that Attorney McGinnis representing Walter Simons had street end at conferred with him regarding the matter and had suggested a conclusion of the Buena Vista St. question and further agreed and recommended that the City Council instruct its • City Engineer to remove any obstructions deemed necessary and which did not comply with City regulations. City Attorney Thompson that also recommended no bulkheads be constructed in that area without a permit from the City and complying with City specifications. It was further recommended that certain tile material and wall be removed immediately, whereupon the City Engineer _ advised that Mr. Simons had informed him that he would remove the the and wall and any other objectibnal things later. On motion of Councilman Claire, seconded by Councilman Brown, and carried, the City Engineer was instructed to make a study of the situation as to what should be removed in that section and make a report to the Council, and a Committee of the Whole to cooperate. The City Attorney reported on the matter of certain lots in Corona del Max, each of which was in the name of:.a: "deceased person, and wherein no Certain lots Corona del administrator had been appointed, and which would require the appointment of in Mar. Clearing a local administrator at an approximate cost of Fifty Dollars, to clear the property. On motion of Councilman Claire, seconded by Councilman Reed and title carried, the City*Attorney was instructed to proceed with the Quiet Title suit. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The application of R. W. Eyer and C. W. Kelley for a license to run R.W.Eyer do C.UJ. a hand ball game, called 'Aim to Win' in the Sportland Pavilion, Balboa, was Felley - license on motion of Councilman Claire, seconded by Councilman Reed and carried, referred to the Chief of Police for investigation with powerto act. The letter of Lew H. Wallace complaining of a condition that existed L.W.Wallace at 309 Anade Street, East Newport, last season by the misuse of a dwelling complaining of for boarding house purposes and over - crowding with tenants, was filed as a boarding house protest against the same occuring again this year. The letter was read, and after some discussion it was moved by Councilman Claire, seconded by Council- man Brown and carried, that the City Attorney refer the matter to the Health Officer, Mr. Wallace to be notified and the letter ordered filed. The request of P. A. Palmer of Lido Isle, for the entrance to the P.A. Palmer Island to be cleaned of weeds, was on motion of Councilman Reed, seconded by weeds Councilman Claire and carried, referred to the City Engineer with instructions to contact Mr. Palmer on the matter. Residents in the neighborhood ofPalm and Adams Street presented a Petition for petition requesting the City to install lights in the alley beteen those lights near streets and in the block between Central Avenue and the Ocean Front in an Palm & Adams St. • effort to discourage alleged nuisances committed in that area, and after discussing the matter of cost of the lights it was suggested by the City Attorney that the Special Police Officer at the Rendezvous from where the it is claimed is the source of the annoyance, should look after the matter. Whereupon it was moved by Councilman Brown, seconded by Councilman Claire and carried, that the City Clerk advise the petitioners of that fact and also that if they wish to take up a collection for the installation of the lights, that the City would, defray the cost of the electricity. The petition presented by residents of the Seashore Colony Tract Petitions, tide requesting that something be done to eliminate a condition alleged to water in Sea- be caused by tide water becoming stagnant due to improper drainage, was Shore Colony Tr. discussed, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the Mayor and City Clerk were instructed to sign a communication addressed to the Orange County Flood Control with a request that they do something to relieve the condition inasmuch as the City has no available funds for the purpose and further that the Flood Control District is being supported by Countywide taxation. Citizens in the Balboa area presented a. petition requesting the Petition, for City Council to install a large sign, or signs, on the Railroad right of signs re: park- way calling attention to the free parking area on the Ocean Front in order ing area to aquaint the public with the fact that there is no charge connected with ' Its use. On motion of Councilman Reed, seconded by Councilman Claire and carried, the City Engineer was instructed to place the sign as requested. The request of the Newport- Balboa Press for the City to advertise Advertising for • for bids for the legal printing of the City as required by law, was presented bids on legal and read, and on motion of Councilman Claire, seconded by Councilman Brown printing. and carried, the City Clerk was instructed to advertise for bids for the legal printing and to place the ad in both papers in the City. I Fire Insurance Councilman Reed brought up the matter of fire insurance on the newly Street Dept. constructed street department warehouse and submitted and recommended the policy Warehouse of the Queen Insurance Company written by Mrs. Mabel Garfield, and on motion of Councilman Reed, seconded by Countilma.n Claire and carried, the policy was accepted. Clearing Beach Councilman Reed brought up the matter of clearing the beach fronting on in Blk 218, Block 218, Section A, of boat concessions or buildings occupying that area, and Section A after some discussion it was moved by Councilman Claire, seconded by Councilman Reed and carried that the City Attorney notify all owners of same to vacate the area between 18th and 19th Street at once. The communication from Verner E. Britton requesting that the City take V. E. Britton the necessary action to cause the construction of a bulkhead fronting on Block bulkhead in P of Tract 518 and that if necessary to use the 1911 Act in connection therewith, Tract 518 that he would bid on the bonds, was presented and read. Whereupon Councilman Claire advised that inasmuch as the proceedings had been started several times with no results, he would insist that the City be not liable for any costs in case the project failed of going through. Smith Bros. On motion of Councilman Claire, seconded by Councilman Reed and carried, demand the City Engineer was instructed to make an estimate of the cost of the project, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the property owners intt�reste.d in the project are to deposit the approximate cost of the proceedings,"pending the beginning of the actual work. Mrs. Cordiero The letter of Mrs. Manual Cordiero requesting permission to smoke fish request to smoke at 202 - 20th Street and on property owned by her, was presented and read and fish on 20th St. considerable discussion was had in connection with same, the City Attorney 440 advising that it would be necessary to amend Zoning Ordinance No. before the Council could grant such permission, and on motion of Councilman Gordon, seconded by Councilman Claire and carried, the matter was referred to the Planning Commiss- ion with a recommendation that the Ordinance be amended in order to permit the smoking of fish on both sides of 20th Street from Central {Avenue to the Bay Front. R.J.Saunders The resignation of Ray J. Saunders as a member of the Examining Board of resignation the Electrical Department was presented, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the resignation was accepted and V. A. Tripp appointed to fill the vacancy. F.A.Hellehthal The letter of Frank A. Hellenthal asking for permission to discharge fitting boat ballast from the boat 'Rex' in the area adjacent to the County dock and to lie "Rex ". at the dock during the period of re- rigging the vessel, was read, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the request was referred to the Harbor Master to take up with the County authorities, there being no objections on the part of the City. Earl Hall, letter The letter of thanks from Earl Hall, President of the Newport Beach of thanks Business Mans Association, for the assistance given that organization in connection with the second annual Fish Fry held on May 18th, was on motion of Councilman Claire, seconded by Councilman Reed and carried, ordered filed. Board of Sup. The invitation of the Board of Supervisors of Orange County for the City 6th Fair & Horse Show of Newport Beach to participate in the Orange County Fair.and Horse Show June to 8th, was read and on motion of Councilman Claire, seconded by Councilman Brown and carried, the City Clerk was instructed to extend the thanks of the City Council +for the invitation. Chief of Police The letter of Chief of Police Hodgkinson recommending certain traffic traffic regulation�egulations on Washington Street, Palm Street between Central Avenue and the Ocean ront, in connection with the parking on the Beach, was presented to the Council, Res. 2'90 whereupon Councilman Claire moved the adoption of Resolution No. 2290, amending amending Ord. j45 traffic Ordinance No. 345, which was duly seconded by Councilman Reed and passed by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN; Allen Neport Heights The report of City Engineer Patterson regarding the WPA siever project in sewer project the Newport Heights area of which it'was stated that sufficient funds were not being paid by the property owners in that section to carry on the work to completion and that additional funds would be required and advised that the remaining property owners should be notified that unless all owners of property paid their share it would be necessary to discontinue the sewer project. On motion of Councilman Claire, seconded by Councilman Brown and carried, the City Engineer was instructed to notify the property owners of the district in accordance with his suggestion. After discuss- ing the matter, it was moved by Councilman Claire, seconded by Councilman Brown and carried, that the matter be laid on the table until the next meeting. Upon the report of City Engineer Patterson that the work of Smith Bros. Smith Bros. Boat Works in the construction of two piers and landing floats fronting on the demand North Channel of-the Bay had been completed in accordance with plans and specifi- cations, it was moved. by Councilman Claire, seconded by Councilman Brown and carried, the demand in favor of Smith Bros. Boat Works was allowed and warrant ordered drawn for same. Upon the report of the City Engineer that the City with Gordon B. Findlay G.B.Findlay in connection with the construction of a storage garage and office building for the demand Street Department had been complied with, it was moved by Councilman Claire, seconded by Councilman Brown and carried, that the work be accepted. On motion of Councilman Claire, seconded by Councilman Brown and carried, the demand in favor of Gordon B. On motion of Councilman Claire, seconded by Councilman Brown and carried, Budget the annual budget for the ensuing year was approved. ' Resolution No. 2291 was presented, being a Resolution approving and adopt- ing a wage scale for City employees, and on motion of Councilman Claire, seconded Res. 2291 wage scale by Councilman Brown ;the resolution was adopted by the following vote, to -wit:- for employees AYES, COUNCILMEN: Reed, Claire, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN:• Allen. Delinquent City Auditor Gant presented the delinquent tax roll for the fiscal year roll 1940 -41, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the roll was approved and ordered returned to the Tax Collector. City Attorney Thompson explained the condition of the tax suit of the Res. 2292 City vs. Earl W. Colby for permission to construct a pier and H.F.Colby appurtenances fronting on Lot 52, Tract 907, was on recommendation of the City pier permit ' Engineer and on motion of Councilman Claire, seconded by Councilman Brown and carried, granted. City Engineer Patterson presented a report with the description of the Report on portion of Lot 10, Block 227, Section A which would be required in the proposed widening of widening of Central Avenue, whereupon it was moved by Councilman Claire, seconded Central Ave. by Councilman Brown and carried, that the Council issue instructions that the above mentioned City.owned property not be sold except on approval of the City Council. City Engineer Patterson advised that certain docks fronting City owned J.R.Owens property on the North Channel had been completed and recommended that the agree- dock on North ment between the City of Newport Beach and J. R. Owens occupying one of the Bay docks be dated June'2, 1941 in accordance with the lesseeb's request. Resolution No. 188 of the Planning Commission granting an addition to Planning Com- a non- conforming element to Art La Shells on a building located on Lots 1 to' La Shelle 6 inclusive, in the Balboa Bayside Tract, was presented, when considerable building discussion developed on the part of Mrs. Helen Grace who vigorously opposed the Council's approval of the recommendation of the Planning Commission, where- upon it was moved by Councilman Claire, seconded by Councilman Reed and. carried that the matter be laid on the table. Resolution No. 2294 was presented, being a resolution authorizing the Res. 2294 Mayor and City Clerk to execute on behalf of the City ofNewport Beach a contract water Cont for furnishing water to R. C, A. COMMUNICATIONS, INC. under certain stipulated with R.C.A. conditions, and on motion of Councilman Claire, seconded by Councilman 3rown, the Communications resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Brown, Gordon. NOES, COUNCILMEN: None.
