The report of the Committee regarding the placing of moorings for small The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport • Beach at the hour of 7:30 p. m. on above date; with Mayor Gordon presiding. The roll was called, the following Councilmen answering present: Reed, Claire, Allen, Brown, Gordon. Absent, Councilmen None. On motion of Councilman Allen, seconded by Councilman Claire and carried, the reading of the minutes of the previous meeting was dispensed with. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF'STANDING COMMITTEES None. COMMUNICATIONS ' The application of Frank Showalter for a license to operate a sales card business, was on motion of Councilman Claire, seconded by Councilman Brown and carried, referred to the Chief of Police'for investigation and report. The letter of George T. Monyahan, Assistant to E. Raymond Cato, Chief of the California Highway Patrol, stating that it would be impossible to comply ' with the request of this City for an increase in Highway patrolmen at this time and that Inspector Cannon had explained the matter to Mayor Gordon, was presented, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the letter was ordered filed. ' ' The letter of Leroy M. Edwards, general Counsel for the Southern Counties Gas Company, requesting the passage of an emergency ordinance which would obviate the necessity of displaying red lights during construction work, • was on motion of Councilman Claire, seconded by Councilman Reed and carried, referred to the City Attorney with instructions to reply to same. The letter of Ralph P. Maskey requesting that the City request the Planning Commission to re -zone Block 732, Corona del Mar from an R -2 class- ification to an R -3 classification, was on motion of Councilman Claire, seconded by Councilman Allen and carried, referred to the Planning Commission on behalf of the City as the applicant. The letter from C. I. Bartholomew, as representative of the A. F. of L. organization, assuring cooperation on any program in connection with National Defense, was presented and read, and on motion of Councilman Claire, seconded by Councilman Allen and carried, same was referred to the Mayor to answer. UNFINISHED BUSINESS The matter of the regulation of private pier construction on Balboa Island was brought up for consideration of the reports presented by the Committees appointed to investigate and report to the Council on the matter. There was much ' discussion as to the method of collecting the proposed fee of $25.00 contained in the regulations governing the construction of piers with requests for joint ownership and limits one pier to each two adjoining lots. The City Engineer presented a map, said being designated as Map No. 1055, which after due consider- ation was adopted on motion of Councilman Allen, seconded by Councilman Brown and carried unanimously. On motion of Councilman Allen, seconded by Councilman Brown, the regulations affecting the construction of piers, dredging and other types of construction and providing a fee therefor; was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Allen, Brown, Gordon. NOES, COUNCILMAN: Claire. ABSENT, COUNCILMEN: None. The report of the Committee regarding the placing of moorings for small Ordinance No. F06, being AN ORDINANCE ORDERING THE WIDENING OF CENTRAL AVENUE BETWEEN McFADDEN PLACE AND "B" STREET IN THE CITY OF NEWPORT BEACH, • ORANGE COUNTY, CALIFORNIA, AS CONTEMPLACED BY ORDINANCE OF INTENTION N0. 503 OF SAID CITY, came up for final passage. The ordinance was read in full and on motion of Councilman Claire, seconded by Councilman Reed, was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. Resolution No. 2505, being A RESOLUTION APPROVING MAP SHOWING PORTION OF A CERTAIN ALLEY IN THE CITY OF NEWPORT BEACH, CALIFORNIA, PROPOSED TO BE CLOSED UP AND ABANDONED, was presented, and on motion of Councilman Claire, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen; Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. ' Resolution No. 2506, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, DECLARING ITS INTENTION TO ORDER THE CLOSING UP AND ABANDONMENT OF A CERTAIN ALLEY IN THE CITY OF NEWPORT BEACH, LOCATED IN SUBDIVISION "C ", NEWPORT BAY TRACT, DECLARING IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE AND FIXING THE TIME AND PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED IMPROVE= MENT, AND SPECIFYING THE EXTERIOR BOUNDARIES OF THE DISTRICT OF LANDS TO BE AFFECTED OR BENEFITED BY SAID WORK OF IMPROVEMENT AND TO BE ASSESSED TO PAY THE DAMAGES, COSTS AND EXPENSES THEREOF, was presented, and on motion of Councilman Claire, seconded by Councilman Reed, was adopted by the following ' vote, to -wit: AYES, COUNCILMEN: R6ed, Claire, Allen, Brown, Gordon. Res. 2507 Resolution No. 2507 was presented, being a resolution retaining the hiring bond firm of O'Melveny & Myers of Los Angeles for the purpose of passing on all attornies proceedings relative to the widening of Central Avenue, and on motion of Councilman Claire, seconded by Councilman Allen, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 2508 Resolution No.'2508 was presented, being'a resolution accepting a tax deed from deed from the County Tax Collector, and covering certain lots purchased from Co.Tax Coll. the County of Orange, by the City of Newport Beach. On motion of Councilman Claire, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. demand On motion of Councilman Claire, seconded by Councilman Reed and Co. of Orange carried, the demand for payment of lots purchased from the County was allowed, Tax. Coll and warrant ordered drawn for same. City Attorney Thompson presented an ordinance known as a 'Blackout 1st reading Ordinance' and after'the reading of same, it was on motion of Councilman Claire, Blackout seconded by Councilman Allen, passed to the second reading by the following Ordinance vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. At this juncture Mayor Gordon presented the following proclamation Declaring which was read: "In conformity with the Governor's declaration of a state of State of emergency now existing in the State of California and in accordance with the emergency provisions of Ordinance No. 483 of the City of Newport Beach, I now Irvin Geo. Gordon, as Mayor of the City of Newport Beach now declare that a state of emergency exists in the City of Newport Beach." Whereupon it was moved by Councilman Claire, seconded by Councilman Allen and carried, that the necessity for the enforcing of the ordinance exists. On motion of Councilman Claire, seconded'by Councilman Allen and Letter to carried, the Mayor was authorized to sign on behalf of the City the following Board of letter to the Board of Supervisors of Orange County protesting the leasing of Supervisors the County dock at the turning basin for private use: of Orange Co. December 16, 1941. re: County dock Honorable Board of Supervisors Santa Ana, California Gentlemen: ti 0 n 0 0 Ire L� 0 The City Council of the City of Newport Beach, at a meeting held December 15th, 1941, 'passed a motion requesting the Board of Supervisors to hold open for the general public use, the County dock at the turning basin in Newport Harbor. The reasons for this request are that emergencies are arising within the harbor and also Government work within the harbor, and there are no other'dock facilities available to take care of same. The City Council thought for the very best interests of all that the Honorable Board of Supervisors of Orange County should consider this request. Very truly yours, IRVIN GEORGE GORDON Mayor. PIERS V.Lindbury The application of V. Lindbury for a permit to construct a private pier pier and landing float fronting on Lot 7, Block 339, Canal Section, was on motion of Councilman Claire, seconded by Councilman Allen and carried, granted as approved by the City Engineer and subject to the Standard regulations as adopted by the City Council. H.L.Palmer The application of H. L. Palmer for a permit to construct a private pier pier fronting on Lots 18, 19and 20, Section 5, Balboa Island, was on motion of Councilman Brown, seconded by Councilman Allen and carried, denied in accordance with the recommendation of the City Engineer as not complying with the standard regulations affecting Balboa Island. M.M.Culver The application of M. M. Culver for a permit to construct a private pier pier in conjunction with Sheldon Hartwell as joint ownership, fronting on Lots 18 and 19, Block 14, Section 3, Balboa Island, was on motion of Councilman Allen, seconded by Councilman Brown and carried, granted as recommended by the City Engineer and subject to the standard regulations. Wm.Meikeljohn The application of Wm. MeikeljOhn for a permit to construct a private pier pier fronting on Lot 23, Tract 742, Balboa Island, was on motion of Councilman Allen, seconded by Councilman Brown and carried, laid on the table for further investigation. The application of E. H. Day for a permit to construct a boat slip at E.H. Day 9th Street and Bay Front, was after some discussion laid on the table by motion boat slip of Councilman Claire, seconded by Councilman Allen and carried. ti 0 n 0 0 Ire L� 0 0 1 0 l J r� u N 4'7 The matter of private construction of sidewalk, curb and pavement by W. Improvements T. Jefferson on portions of Lots A and F, in Tract 919, fronxting on San Bernardino in Tract 919. Avenue, was brought up, Lew H. Wallace explaining the plans of the owner of the property involved. Some discussion arose as to the method of storm drain construction in connection with the work and as to the possibility incurring responsibility by the City in case of damage by storm waters. Finally on motion-of Councilman Claire, seconded by Councilman Allen and carried, the applicatt was authorized to proceed with the improvement 150 feet landward from the State Highway, and requested to post a bond for labor, material and faithful performance, the City Engineer being authorized to construct the catch basin necessary for the project. . Councilman Allen moved the adoption of a resolution, being a resolution Minute Res. authorizing the Mayor and City Clerk to execute on behalf of the City of Newport quitclaim dee• Beach a quitclaim deed to Edward E. Jones and covering Lot 17, Block 5, Resub- to E.E.Jones division of Section 1, Balboa Island. The motion was duly seconded by Councilman Reed and the resolution adopted by the following vote, toewit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Resolutions No. 2509 to 2511 inclusive were presented, being Resolutions Res. 2509 to authorizing the Mayor and City Clerk to execute grant deeds to the following people 2511 - and covering the following described property sold to them. Sale of City owned lots. Res. 2509 Leo J. Klepl et ux Lot 10 Block 140, Canal Sec. Price 4175.00 Res. 2510 A. Redden et ux Lots 4, 5 and 6, Block 140 Canal Section Price $525.00 Res. 2511 William T. Cash Lot 3, Block 543, Corona del Mar Price $200.00 Whereupon it was moved by Councilman Allen, seconded by Councilman Reed, that the resolutions be adopted, and the motion passed by the following vote, to -wit: AYES, COUNCILMEN: Reed, Claire, Allen, Brown, Gordon. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Robert Pridham of Balboa Island, addressed the Council pleading for an area on the beach in that district for the use of the public and also that all applications for private piers on the Island be referred to the people there before granting permission for the construction of same. On motion of Councilman Claire, seconded by Councilman Allen and carried, all applications for the construction of private piers are to be laid on the table for two weeks before granting permission for same, and Mr. Pridham is to be notified of those from Balboa Island. Ralph Maskey addressed the Council regarding the filling of a gully on San Bernardino Avenue, offering tb-furnish the necessary dirt- for same.
