The City Council of the City of Newport Beach met in regular session In the City Council Chambers at the City Hall at the hour of 7 :30 o'clock p. m. on above date with Mayor Hall presiding. Roll Call The roll was called, the following Councilmen answering present: Gordon, Allen, Isbell, Reed, Hall. Absent, Councilmen: None. • On motion of Councilman Allen, seconded by Councilman Gordon and carried, the reading of the minutes of the previous meeting was dispensed with. REPORTS OF HEADS OF DEPARTMENTS The report of City Treasurer Gant was read, and..on motion of Council- man Gordon, seconded by Councilman Isbell, the reading of reports of other Heads of Departments was dispensed with and all reports ordered filed. ' REPORTS OF SPECIAL COMMITTEES 1st reading The report of Fire Chief Crocker and Councilman Gordon regarding the or ordinance passing of an ordinance prohibiting the use of fire works for the duration of re: fireworks the emergency was presented, and read, whereupon Councilman Gordon moved the adoption of an Ordinance restricting the use of fireworks for the duration of the emergency, the motion was duly seconded by Councilman Allen and the Ordinance passed to the second reading by the following vote, to -wit: ' AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. 'Bike Day' Chief of Police Hodgkinson asked for more time to report on the request of the Newport Harbor Junior Chamber of Commerce for permission to use a street for events to be held on the so- called 'Bike Day', June 6th. City Engineer The report of City Engineer Patterson regarding collections for the • collections month of April was read, and on motion of Councilman Gordon, seconded by Council- man Allen, was ordered filed. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS War Salvage The communication from the Commonwealth Club of California regarding materials the collection, segregation and utilization of war salvage materials, was presented and read, and after some discussion and suggestions, it was moved by Councilman Gordon, seconded by Councilman Allen and carried, that the matter be referred to the City Engineer. Calif. Ihst. The inquiry of the California Institute of Technology regarding the of Tech. transportation of explosives through Newport Beach was presented and read, and explosives on motion of Councilman Gordon, seconded by Councilman Allen and carried, same was referred to the City Attorney. W.T.Jefferson The request of W. T. Jefferson for the improvement of the left fork ' improvement of of San Bernardino Avenue in order to provide access to the most thickly settled street portion of Newport Heights, was presented and read. In discussing the matter the City Engineer informed the Council that no funds were available at this time for the improvement. The matter of the upkeep of the street, if improved, was brought up by Councilman Gordon. Councilman Isbell expressed the opinion that due to war conditions, the improvement should not be undertaken at the present time. On motion of Councilman Reed, seconded by Councilman Gordon and carried, the communication was ordered filed, and Mr. Jefferson to be notified of the Council's action in the matter. J.G.Hesa The request of John G. Hess for the City to do some dredging in the dredging vicinity of Palm and Adams Streets was presented and read, and on motion of Councilman Gordon, seconded by Councilman Reed and carried, was referred to the City Engineer for an estimate of the cost of the work. UNIFNISHED BUSINESS Soiland The matter of the suit of Dr. Albert Soiland vs. the City of Newport • lawsuit Beach, laid over from a previous meeting, was on motion of Councilman Allen, seconded by Councilman Gordon and carried, again laid on the table. U.S.Navy The request of the United States Navy for a site for the assembling assembling and launching of Lighters, laid over from a previous meeting, was brought up, site and on motion of Councilman Gordon, seconded by Councilman Allen and carried, was again laid on the table. NEW BUSINESS ' Res. 2613 Resolution No. 2613 was presented, being a resolution cancelling a cancelling lease with J. R. Owens for rental of dock, garage and storehouse for the lease with yacht Melodie , and refunding to him pro -rated rent in the amount of $101.37. J.R. Owens On motion of Councilman Gordon, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed., Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. ' Res. 2614 Resolution No. 2614 was presented, being a resolution cancelling a cancelling, lease with John Ford for rental of dock and storage garage for the yacht lease with "Araner ", and refunding to him pro - rated rent in the amount of $1696.00. Valentine for rental of dock and storage garage for the yacht cancelling !4Volador ", and refunding to him pro -rated rent in the amount of $1705.00. On lease with motion of Councilman Gordon, seconded by Councilman Reed, the resolution was W.L.Valentine adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. • ABSENT, COUNCILMEN: None. The monthly demands having been audited by the Finance Committee, Demands were on motion of Councilman Reed, seconded by Councilman Isbell and carried, allowed and warrants ordered drawn for same. Resolutions No. 2616 and 2617 were presented, being resolutions Res. 2616 & authorizing the Mayor and City Clerk to execute on behalf of the City of 2617 ' Newport Beach, grant deeds to the following people and covering the following sale of City property sold to them. owned property Res. 2616 Ann L. Brown Lots 20 and 22, Block 732, Corona .del Mar. Price $450.00 Res. 2617 Beatrice Emma Hatter Lot 23, Tract 673, Corona del Mar Price $330.00 ' On motion of Councilman Allen, seconded by Counciiman.Gordon, the resolutions were adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOFS, COUNCILMEN: None. ABSENT, COUNCILMEN: None. The matter of the agreement and amendment to a lease between the Lide Isle • Lido Isle Community Association and the City of Newport Beach, laid over from Community Assn. a previous meeting, was brought up, the City Engineer advising that a meeting amendment to of the Association is to be held in two weeks, at which time request should be lease made by the Association rather than from an individual. Whereupon it was moved by Councilman Isbell, seconded by Councilman•Reed and carried, that the request before the Council be denied. City Attorney Thompson presented a written report in connection with Easement for a request from certain property owners fronting on the site of the former West property in Newport pool for an easement of 25 feet together with an additional 25 feet west Newport for street purposes. The reason for the request being that due to the depth near Pool. of the lots in that section there is no access to the property. The report was read and after discussing the question it was moved. by Councilman Reed, seconded by Councilman Allen and carried, that a permit be granted through the Street Department and Street Superintendent, and that a letter be sent to the property owners, said letter to be approved by the City.Attorney, stating that the use of the 25 foot easement be for park purposes only with no fences or other improvements to be made thereon and said easement revokable at any time by the City. City Attorney Thompson presented the proposed lease of the Newport pier U.S.Army by the United States Army, wherein the occupancy would be for the present emergency proposed lease and not to exceed 90 days thereafter; the United States Army to keep the pier in of Newport pirA repairs and to take care of public utilities. On motion of Councilman Gordon, seconded by Councilman Allen and carried, it was ordered that the Government authorities be contacted in order to go over the proposed lease of the pier. The application of Leo Clevereley for a permit to install a pleasure L.Cleversley pier and float fronting on Lot 849, Tract 907, haying been approved by the City pier permit Engineer, was on motion of Councilman Allen, seconded by Councilman Gordon and carried, granted. The insurance policy covering the City garage and store rooms, approved Insurance on by the City Engineer, was on motion of Councilman Reed, seconded by Councilman garage Allen and carried, accepted. On motion of Councilman Reed, seconded by Councilman Allen and carried, L.Wright two weeks vacation was granted to Plumbing Inspector Wright, beginning May 5th, vacation 1942. Mayor Hall appointed the following as members of the Civil Service Appointment of • Board: Carl A. Danielson for the term ending December 31, 1942; Col. F. C. Venn Civil Service for the term ending December 31, 1943, and Edward I. Moore for the term ending Board December 31, 1944. On motion of Councilman Allen, seconded by Councilman Isbell and carried, the appointments were approved. Councilman Isbell brought up the matter of widening Central Avenue WidenirF of from Main to "A" Streets in Balboa, and on motion of Councilman Isbell, seconded Central Ave. by Councilman Gordon and carried, the City Engineer was instructed to submit estimates of the cost of removing the curbs and surfacing the street and also for providing a crossing at 10th Street. Chief of Police Hodgkinson addressed the Council with a request for Chief of .folic additional room for the Police Department. On motion of Councilman Allen, request for seconded by Councilman Gordon and carried, same was referred to the Police additional roe Committee for investigation and report. Councilman Gordon moved that the resignation of J. M. Kennedy as a J.M.Kennedy police officer be reconsidered, the motion dying for the lack of a second. resignation ' ADJOURNMENT On motion of Councilman Gordon, seconded by Councilman Reed, an adjournment was taken to 7:30 P. m., Monday, May 18, 1942. r1 U ATT T: ".
