The City Council of the City of Newport Beach met in adjourned regular
session—in—the City Council Chambers at the City Hall at the hour of 7:30 o'clock
p• m. on above date with Mayor Hall presiding.
Roll Call
The roll was called, the following Councilmen answering present: Gordon,
Allen, Isbell, Reed, Hall. Absent, Councilmen: None.
On motion of Councilman Reed, second &d by Councilman Isbell and carried,
the reading of the minutes of the previous meeting was dispensed with.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS
Aaron Golud
The application Aaron Golud for a veteran's exempt license to sell
license
novelties, razor blades, etc. to business places, on report of Chief of Police
Hodgkinson as to credentials, was on motion of Councilman Allen, seconded by
Councilman Gordon-and carried,-granted.
Toby Owens
The application of Toby Owens for a veteran's exempt license to sell
license
neckties and other merchandise to business places, on report of the Chief-of
Police as to credentials, was on motion of Councilman Gordon, seconded by Council-
man Allen and carried, granted.
S.H.Walkerdine
The letter of Dr. S. H. Walkerdine requesting the picking up of dead
dead animals
animals from the dog and cat hospital in Corona del Mar, by the trash wagon, was on
motion of Councilman Allen, seconded by Councilman Gordon and carried, referred to
City Engineer Patterson to check with Dr. Walkerdine on the subject.
J.F.Vogel
The request of John F. Vogel for a•reduction of the bicycle license from
bicycle rental
$50.00 to $12.00 per annum, was read and after some discussion of the matter,

The letter of W. T. Jefferson of the 'Miracle Mile Association" requesting

and after discussing the question, it was moved by Councilman Allen, seconded by
Councilman Reed and carried, that the matter be laid on the table.
Grainger Hyer.
A communication presented by Grainger Hyer and signed as Warden No. 9,

pertaining to expectant mothers during blackouts, was read and after considering
the question upon which the Council was addressed by the writer, it was moved by
Councilman Allen, seconded by Councilman Gordon and carried, that the letter be
referred to Dr. G. M. Grundy as Civilian Defense Physician.
D.B.Kirby
The letter of Donald Beach Kirby soliciting any architectural work in

connection with the — proposed improvements to the Police Department headquarters,

was presented and on motion of Councilman Gordon, seconded by Councilman Allen
and carried, the City Clerk was instructed to advise Mr. Kirby that inasmuch as
the total cost of the proposed improvement would not exceed $500 the services
of an architect would be unnecessary.
F.W.Hickman
The letter of F. W. Hickman, Secretary of the Seal Beach Chamber of

In connection with the petition letters in opposition to the plan were presented
by Frank Riddle of the Seashore Colony section and Lew H. Wallace of Newport
Beach. On advise of the City Attorney that the collector of water bills would
need- to- be- bonded and would come under the State Compensation requirements, it
was moved by Councilman Reed, seconded by Councilman Gordon and. carried, that
the request be laid on the table for further investigation.
L.A.WriGht
The request of Louis A. Wright for a leave of absence far the duration
resignation
of the war, was presented together with his resignation as City Plumbing Inspector,
and on advise from the City Attorney that the leave of absence could not be granted,
It was moved by Councilman Isbell, seconded by Councilman Reed and carried, that
the resignation be accepted effective May 1E, 1942 and the salary be paid to that
date inclusive.
August Clerk
The request of City Engineer Patterson that August Clark be appointed
employment
Superintendent of Electrical Maintenance at a salary of $150 per month to succeed
Hobart Ohowell who resigned May 13th, was presented and on motion of Councilman
Reed, seconded by Councilman Gordon and carried, the appointment of August Clark
was approved and the resignation of Hobart Ohowell accepted with three weeks
vacation allowed with the salary to be paid to June 3, 1942 inclusive.
E. B. Whitson
On motion of Councilman Reed, seconded by Councilman Isbell andcarried,
resignation
the resignation of E. B. Whitson and City Electrical Inspector was accepted
with two weeks vacation granted and salary to be paid to May 31, 1942 inclusive.
F.C.Venn
The request of Col. F. C. Venn, Secretary of the newly created Civil
Service Commission, fo•r suitable office space. and the services of a stenographer
office space
when necessary, was on motion of Councilman Reed, seconded by Councilman Gordon
and carried, laid on the table.
International
The communication of the International Association of Electrical
Assn of Elec.Insp.Inspectors
requesting the affiliation of the City with that organization, was
presented and read, and on motion of Councilman Reed, seconded by Councilman
Gordon and carried, same was referred to the City Engineer
Enlarging water
The request of City Engineer Patterson for the removal of the Electrical
dept. yards
and Park Department warehouses to the site of the Water Department warehouse and
the enlargement of the Water Department yard, space to be provided for the Electrical

and Park Departments by partitioning off a portion of the Water Department build -
ing for a store reom.;,wasrpresented. Whereupon it was moved by Councilman Gordon
that the matter be laid on the table for further consideration, which motion was
lost by lack of a second. The motion of Councilman Isbell, seconded by Councilman
Reed that the recommendation of the City Engineer be approved was carried by the
following vote, to -wit:

ABSENT, COUNCILMEN: None.
UNFINISHED BUSINESS
The matter of the suit of DI:. Albert Soiland vs. the City of Newport
Beach was again brought up, and on motion of Councilman Reed, seconded by Council-
man Gordon and carried, same was laid on the table for further study.
On motion of Councilman Gordon, seconded by Councilman Reed and carried,
the City Attorney was instructed to prepare an amendment to a lease from the City
of Newport Beach to the Lido Isle Community Association, striking out certain
portions of a proposed lease presented to the Council at a previous meeting.
Ordinance No. 514 was presented, being in full as follows:
The City of Newport Beach by and through its City Council does ordain
as follows:
Section 1. It shall be unlawful for.any person, firm or corporation
to sell, display, dispose of, give away, store, keep, stock, or discharge, fire
explode or set off any fire works or.fire crackers of any. description, within tie
incorporated limits of the City of Newport Beach.
Sedtion 2. Any.person, firm or corporation violating any of the
provisions of this ordinance shall be deemed guilty of a misdemeanor and upon
conviction therrof shall be punishable by imprisonment in the City Jail of the
City of Newport Beach or the County Jail of Orange County, for a period not
exceeding three (3) months, or by a fine not,exceeding $200.00, or by both such
fine and imprisonment.
Section 3: All ordinances or parts of ordinances in conflict with
this ordinance are hereby specifically repealed.
Section 4: The City Council of the City of Newport Beach hereby declares
that this .ordinance is enacted in the exercise of its police powers. That there
is an emergency existing and that this ordinance is necessary for the immediate
preservation of the public peace, health and safety within the meaning of Section
1, of Article IV of the Constitution of the State of. California, and Subdivision
C of Section 1651 of the Election Code of the State of California, and shall
take effect immediately after its adoption. The facts constituting the emergency
are as follows:
The City of Newport Beach is situated on the diores of the Pacific Ocean
and in the very midst of an area which is of vital importance to the United
States of America; that a state of war now exists and it is not know exactly
what form our enemies may _ employ to attack us. There always exists the possibility
of nuisance raids by gun fire from enemy submarines on our shores and nearby
installations; that the setting off of fire crackers or fire works might guide
the enemy to our shores. It is therefore imperative that an ordinance be passed
at this time prohibiting fire works within the incorporated limits of the City
of Newport Beach.
Section 5. The City Clerk shall certify to the separate vote on the
urgency of this ordinance and its passage by the vote of five members of the
City Council of the City of Newport Beach, and cause the same to be published
once in the NEWPORT BALB OA PRESS a weekly newspaper printed and circulated in
the City of Newport Beach, and upon such publication this ordinance shall
become immediately operative and take full effect.
I hereby certify that the question of the urgency of the foregoing
ordinance was passed and the foregoing ordinance was adopted by a vote of five
members of the City Council of the City of Newport Beach at its meeting held
the 13th day of May, 1942.

The ordinance in connection with the Selective Training and Service
Act of 1940 was presented for the first reading, the ordinance was read in
full and on motion of Councilman Reed, seconded by Councilman Gordon was
passed to the second reading by the following vote, to -wit:

Resolution No. 2618 was presented, being a resolution authorizing the
Mayor and City Clerk to execute an agreement with the County of Orange leasing
to said County a certain Thordarson Model T- 17 -K -21 Transmitter. On motion of
Councilman Reed, seconded by Councilman Allen, the resolution was adopted by the
following vote, to -wit:

the City Attorney was authorized and instructed to start proceedings to remove the occupant of Cit,

City Attorney Thompson brought up the matter of protection of soldiers
