Ltim Newport Beach, July 20, 1942. r, The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall at the hour of 7:30 o'clock p. m. on above date with Mayor Hall presiding. The roll was called, the following Councilmen answering present: Gordon, Roll Call Allen, Isbell, Reed, Hall. Absent, Councilmen, None. On motion of Councilman Allen, seconded by Councilman Gordon and carried, the reading of the minutes of the previous meeting was dispensed with. ' REPORTS OF SPECIAL COMMITTEES Councilman Isbell presented a written report from the Committee appointed Report on to investigate and report on the feasibility of entering into an oil drilling oil drilling contract with D. W. Elliott, which was read and after some discussion of the contract matter, it was moved by Councilman Allen, seconded by Councilman Gordon and carried, that the report be referred to the Planning Commission for consideration and recommendation, a former motion to file the report having been withdrawn. ' REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS A petition presented by the cannery operators and fish dealers complain- Petition ing of a boat being used as a fish buying station and moored in the entrance to boat for Newport Harbor, was read, and after some discussion of the question as to the fish buying City's jurisdiction in the matter, it was moved by Councilman Gordon, seconded by Councilman Allen and carried, that it be referred to the City Attorney and Harbor Master to investigate and take what action is necessary. The Council was addressed by Walter Longmore and Gregory Gorby regarding the matter. They stated that if the practice is once started it might induce others to come in thus working a hardship on the canning and fishing industry. They also stated that in their opinion police action would not be necessary but that an inter- view with the operators of the fish buying boat would relieve the situation. The request of Gordon B. Findlay for a refund of six dollars paid G.B.Findlay for a building permit which could not be used due to Federal restrictions, request for was on motion of Councilman Allen, seconded by Councilman Reed and carried, refund denied. The complaint of L. H. Johnson about private beach signs being posted L.H.Johnson between "A" and "B" Streets on the Bay Front in Balboa was read and after some 'signs on discussion as to the ownership of the frontage, it was moved by Councilman beach Reed, seconded by Councilman Allen and carried, that the matter be laid on the table for investigation. Councilman Gordon offered an amendment to the motion, which was seconded by Councilman Allen and carried, that the Mayor Appoint a Committee to look into the matter, whereupon Mayor Hall appointed Councilmen Isbell and Gordon and the City Engineer to investigate and,.report at the next meeting of the Coum11. Kent Hitchcon' The letter of Kent Hitchcock withdrawing the application of the withdrawal of Rendezvous Ball Room for permission to install a banner across Central Avenue, request was on motion of Councilman Isbell, seconded by Councilman Allen and carried, ordered filed. The letter of H. L. Sherman advising that Everett Gardiner had H.L.Sherman donated five dollars in return for the kit bag and other supplies furnished donation from Harbor Island, was presented together with the check for the amount, and on E.Gardiner motion of Councilman Gordon, seconded by Councilman Allen and carried, same was ordered filed and the money to be deposited with the City Treasurer. The letter of Jerome E. Barieau complaining of the treatment accorded J.E.Barieau him by an operator at the Strand Auto Park in Balboa, was presented and read, complaint of and on motion of Councilman Isbell, seconded by Councilman Allen and carried, auto park same was referred to the Police Committee and the City Clerk instructed to • write to Mr. Barieau explaining that the City has no jurisdiction as to rates charged but did not condone the practice. Mrs. G. Maxwell addressed the Council about over charges by taxi companies operating in the City. The complaint of the Newport- Balboa press regarding the publishing Newport- Balb °, of notices of Planning Commission hearings.in the Newport - Balboa News -Times Press- notice: when the contract for the City legal printing is'-.held by them and alleging by Planning that such publications are illegal, was presented and read, and on motion Commission of Councilman Reed, seconded by Councilman Gordon and carried, the matter ' was referred to the City Attorney for report at the next meeting of the Council. The letter of W. T. Jefferson of the Miracle Mile Association, W.Jefferson requesting the opening of a portion of San Bernardino Avenue leading to request to Newport Heights, was presented and read, and on motion of Councilman Reed, open portion seconded by Councilman Allen and carried, same was referred to the City SanBernardino Engineer. The request of Lt. Jos. K. Horton of the Coast Guard for a reduction Coast Guard of taxes on boats taken over by the Navy was presented and read, and after request for considerable discussion of the question, it was moved by Councilman Reed, reduction in seconded by Councilman Gordon and carried, that the City Attorney and City boat tax Clerk report on the matter at the next meeting of the Council. The reuqest of Rex Allbright for a leave of absence for the duration Rex Allbright of the war from his duties'as a police officer, was on motion of Councilman request for Allen, seconded by Councilman Gordon and carried, granted. leave of absence . r, ME Res. 2637 Resolution No. 2637 was presented, being a resolution authorizing lease of "N" St the Mayor and City Clerk to execute on behalf of the City of Newport Beach pier to Govt. a 1-ease with the United States of America granting exclusive use to the Coast Guard on the N Street pier for the period of one year. On motion of Councilman Allen, seconded by Councilman Gordon, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 2638 Resolution No. 2636 was presented, being a resolution authorizing agreement with the Mayor and City Clerk to execute on behalf of the City of Newport Beach Geo. C. Hiner a certain license agreement with George C. Hiner for the live bait concession on the Newport pier for a period of three years. On motion of Councilman Reed, seconded by Councilman Gordon the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. NEW BUSINESS Demands On motion of Councilman Reed, seconded by Councilman Isbell and carried, certain demands which had been duly audited by the Finance Committee, were allowed and warrants ordered drawn for same. Councilman Allen moved the adoption of a resolution; being a resolution Minute Resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport quitclaim deed to Beach a quitclaim deed to Ann L. Brown and covering Lot 6, Block 736, Corona Ann L. Brown del Mar. The motion was seconded by Councilman Gordon and the resolution adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES,•COUNCILMEN: None. ABSENT, COUNCILMEN: None. I, Frank L. Rinehart, City Clerk of the City of Newport Beach, hereby certify that the above and foregoing Resolution was passed and adopted by the City Council of the City of Newport Beach at an adjou d regular meeting thereof held on the 20th day of July, 1942 Res. 2639 & 2640 Resolutions No. 2639 and 2640 sale of City owned authorizing the Mayor and City Clerk to lots Newport Beach, grant deeds to the follo, property sold to them. Res. 2641 Resolution No. 2641 was presented, being a RESOLUTION OF "THE CITY gas tax COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING MEMORANDUM OF AGREEMENT FOR allocation EXPENDITURE OF 1/4 CENT GAS TAX ALLOCATED FOR STATE HIGHWAYS. On motion of Councilman Allen, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: • AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 2642 Resolution No. 2642 was presented, being a RESOLUTION OF THE CITY gas tax COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING MEMORANDUM OF AGREEMENT FOR allocation ACCUMULATION OF 1/4 CENT GAS TAX ALLOCATED FOR STREETS OF MAJOR IMPORTANCE. On motion of Councilman Allen, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. ' Dim-Out ° Councilman Isbell brought up the•matter of enforcing the 'Dim -Out' regulations regulations stating that the Police Department was without authority in the matter, and after some discussion in which the Council was addressed by Helen Grace as to conditions in Balboa, it was moved by Councilman Allen, seconded by Councilman ROed and carried, that the City Attorney prepare the necessary ordinance for the enforcement of same. Councilman Isbell suggested that additional policemen be employed to patrol Central Avenue on Saturday nights to enforce the Dim Out regulations. Chief of Police Hodgkinson addressed the Council regarding the matter. Councilman Gordon brought up the matter of an increase in the Question of minimum pay for City employees due to the rising cost of living and after increase in some discussion of the question 1h which it was moved by Councilman Gordon wages for City seconded by Councilman Allen and carried, that the Mayor appoint a Committee employees to investigate other cities and what they are doing about the matter, Mayor Hall appointed Councilman Reed, Councilman Allen and Councilman Gordon as a Committee for the purpose. The application of Jerry Forney for a permit to install a barge Jerry Forney and piling fronting on Lot 10, Block 536, Canal Section, having been approved barge & piling by the City Engineer subject to the approval of the Waft Department, was on permit motion of Councilman Gordon, seconded by Councilman Allen and carried, granted. City Engineer Patterson brought up the matter of the adoption of a Question of suitable 'Weed' ordinance, and on motion of Councilman Reed, seconded by adoption of Councilman Isbell and carried, the City Attorney was instructed to prepare 'Weed° ord. same. City Engineer Patterson brought up the matter of rental of quarters Rental of for the use of the Civilian Defense work and recommended the building at quarters for 110 McFadden Place at a rental of $15.00 per month; $10 for untilites and Civilian Defs. $100 for supplies, rental to be from month to month, and on motion of Council- man Isbell, seconded by Councilman Reed and carried, authority was granted to proceed with same. Minute Resoluti, The matter of the appointment of a successor to the office of Harbor R. L. Patterson Master was brought up for consideration, it being suggested that City Engineer appointment as Patterson be appointed as Harbor Manager with full authority to operate the Harbor Master Harbor. Some question arose as to whether the title of the office should be Harbor Manager 6r Harbor Master, but after some discussion of the question Councilman Reed moved the adoption of a resolution appointing R. L. Patterson as Harbor Master, the motion was duly seconded by Councilman Allen and the resolution adopted by the following vote, to -wit: AYES, COUNCILMEN: Allen, Isbell, Reed, Hall. NOES, COUNCILMAN: Gordon. ABSENT, COUNCILMEN: None. I, Frank L.
