On motion of Councilman Allen, seconded by Councilman Gordon and carried, The City Council of the City of Newport Beach met in adjourned regular Virgil Phebus session in the City Council Chambers at the City Hall at the hour of 4:00 o'clock employment p. m. on above date with Mayor Hall presiding. Roll Call The roll was called, the following Councilmen answering present: Gordon, Allen, Isbell, Reed, Hall. Absent, Councilmen, None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The special notice from Ray L. Riley, Coordinator of Transportation Defense of the Metropolitan area of Los Angeles, advising of a meeting to be held on Meeting September 23rd, was read, and Councilman Gordon advised that he would attend the meeting with Earl Stanley since Theodore Robins would be unable to be there. Whereupon it was moved by Councilman Reed that an emergency ordinance in respect to critical materials be passed to the second reading, the motion was duly seconded by Councilman Gordon and the ordinance passed to the second reading by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. Virgil Phebus The request of Chief of Police Hodgkinson for the temporary employment employment of Virgil Phebus as a police officer at a salary of $125 per month, was on motion of Councilman Isbell, seconded by Councilman Allen and carried, granted. The request of Fire Chief Crocker for a transfer of funds in the amount Request for of $1,092 to Fire Department account #460 -F to cover increase in salaries for transfer of night men at Stations #2 and #4, was on motion of Councilman Reed, seconded by funds in Fire Councilman Allen and carried, laid on the table as was the request of Chief of & Police Depts. Police Hodgkinson for a transfer of funds in the amount of $1,815 to account #400 -A to cover changes in the salary ordinance of that department. The request of Fire Chief Crocker for the employment of Phillip Hayden Phillip Hayden to succeed Andrew Gengler at the rate of $5.bO per day for a period of three employment months, was on motion of Councilman Allen, seconded by Councilman Gordon and carried, id-over until the ne t meetin R.Craig The recommendation of City Engineer Patterson that the salary of Russell Craig, as Deputy.Harbor Master be increased to $200 per month, was laid salary on the table until the next meeting of the Council. UNFINISHED BUSINESS City Engineer Patterson reporting on the petition presented by residents 36th Street in the vicinity of 36th Street and Clubhouse Avenue requesting the improvement of Improvement the streets, presented three estimates of the cost of the work, and on motion of Councilman Reed, seconded by Councilman Isbell and carried, the City Engineer was authorized to proceed with the work as he might recommend. San Bernardino City Engineer Patterson presented a detailed report of the cost of Ave. improvement improving the north fork of San Bernardino Avenue as requested by the Miracle Mile Association on several occasions. Two plans were submitted the cost being $5,250 and $6,320 respectively. The City not being in a position to make the Improvement from the General Fund, it was moved by Councilman Allen, seconded by Councilman Reed that the report be accepted and the City Engineer instructed to ascertain from the petitioners if they desired the improvement to be made an assessment district. The motion was carried by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. u lJ 0 L 0 NEW BUSINESS On motion of Councilman Reed, seconded by Councilman Isbell and carried, 'certain demdands which had been duly audited by the Finance Committee, were approved • and warrants ordered drawn for same. -. Resolution No. 2664 was presented, being a resolution cancelling a lease with S. M. Spalding for dock and garage rental, and on motion of Councilman Reed, seconded by Councilman Isbell, the resolution was adopted by the following vote, to -wit: 0 0 F_ 1 L n L AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. Councilman Allen moved the adoption of a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach quitclaim deeds to the following people and covering the following described property: Sabra Evelyn Blue Lots 9 and 10, Block 225, Section A A. R. Coffin et ux Lot 9 and SWly 10' of Lot 11, Block 135, Resub of Corona del Mar. The motion was seconded by Councilman Gordon and the resolution adopted by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res.'2667 was presented, being a resolution accepting the offer of Horace A. Hall for the purchase of the 26 foot speed boat Zephyr, nowowned by the City of Newport Beach, for the price of $500.00. On motion ofCouncilman Isbell, seconded by Councilman Reed, the resolution was adopted by the follow- ing vote, to -wit: AYES, COUNCILMEN: Gordon, Allen, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. City Attorney Thompson presented a written report in connection with Quiet Title suits together with a schedule of cost for handling same. The report was read and on motion of Councilman Isbell, seconded by Councilman Gordon and carried, was approved. City Attorney Thompson presented a written report in connection with the case of Williams vs. The Cit of Newport Beach, wherein the City had been sued for judgment in the 'sum of 41,070, the case being decided in favor of the City. On motion of Councilman Allen, seconded by Councilman Gordon and carried, the report was accepted and ordered filed. The application of P. R. McCoy for a permit to construct and install a barge and landing fronting on Lots 9 and 10, Block 441, Canal Section, was on motion of Councilman Allen, seconded by Councilman Gordon and carried, granted subject to the approval of the War Department. The request of the American Pipe and Construction Company for permission to barricade 28th Street on the Superior Oil Company property, was on motion of Councilman Gordon, seconded by Councilman Allen and carried, granted subject to them assuming all liability in connection therewith. The communication of the Department of Agriculture regarding rodent control in the City by the County, was presented, and on suggestion of Mayor. Hall it was moved by Councilman Allen, seconded by Councilman Gordon and carried, that the City Engineer be instructed to ascertain from the County what the cost of same would be. Mayor Hall brought up the matter of the appointment of a Citizens Committee to investigate and report on the water situation, and proceeded to appoint the following Committee: Balboa, Wm. A. Kirk: Newport Beach, Lew H. Wallace; East Newport, Mrs. V. 0. Wroolie; West Newport, Ralph P. Maskey; Newport Heights, C. B. Rudd; Lido Isle, Wesley Nutien, Jr.; Balboa Island Earl Stanley; Corona del Mar, Hubbard Howe. Elliott D.W. Elliott addressed the Council in reference to drilling for oil oil drilling in the west part of the City, the matter having been referred to the Planning Comission and he was awaiting their report, also suggesting that the property owners in that district might participate in the leases. On motion of Council- man Allen, seconded by Councilman Gordon and carried, the report of Mr. 'Elliott was accepted. • ADJOURNMENT On motion of Councilman Gordon, seconded by Councilman Reed and carried, an adjournment was taken Sine Die.
