The letter from the Beverly National Company requesting a refund of taxes
assessed against the boat 'Dolphin' owned by Frank Morgan, due to the same Having
been taken over by the United States Government, was presented and read, and on
motion of Councilman Allen, seconded by Councilman Reed and carried, was re ferred
to the City Attorney to prepare the necessary resolution authorizing the customary
refund.
The communication of F. D. LeBold of the Citizens National Bank of Los
Angeles, protesting the adoption of the proposed Zoning Ordinance respecting certain
properties in the Corona del Mar district, was presented and read, and on motion of
Councilman Allen, seconded by Councilman Reed and carried, was laid on the table
to be considered along with the Zoning Ordinance.
UNFINISHED BUSINESS None.
NEW BUSINESS
Resolution No. 205 of the City Planning Commission recommending the
proposed slant drilling for oil in the area westerly of 53rd Street and noting
certain conditions whereby a portion of any revenue derived from the same are
to be expended in that section of the City, was presented and read, and after
considerable discussion of the question in which the Council was addressed by
George H. DuBarry and Ralph Maskey in opposition of the project, it was moved
by Councilman Allen that the City Clerk be instructed to advertise for a hearing
to be held on Tuesday, May 11, 1943, as prescribed by law, to consider the
recommendation of the Planning Commission together with any protests in the
matter. The motion was carried by the following vote, to -wit:
AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall.
NOES, COUNCILMEN: None.
ABSENT, COUNCILMEN: None.
Resolution No. 206 of the City Planning Commission, presenting a
revised Zoning Ordinance and recommending the adoption thereof, was presented
and read in full, and on motion of Councilman Allen, seconded by Councilman
Reed and carried, same was laid on the table for further study.
Councilman Allen moved the adoption of a resolution, being a resolution
authorizing the Mayor and City Clerk to execute on behalf of the City of Newport
Beach the following quitclaim deeds to the following people and covering the
following described property:

Frank Martin
May Brooks

The City Council of the City of Newport Beach met in adjourned regular
session in the City Council Chambers at the City Hall at the hour of 4 o'clock,
p. m. on above date,•with Mayor Hall presiding.
The roll was called, the following Councilmen answering present: Allen,
Isbell, Reed, Kirk, Hall.. Absent, Councilmen None.
Mayor Hall asked if =any member of the Council, or any one in the
audience wished the Minutes of the previous meeting of the Council, or any
part thereof, read, no one responded, and the reading of the Minutes was dispensed
with.
REPORTS OF SPECIAL COMMITTEES None.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS.
The request of George C. Hiner for a reduction in the rental for the
'
live bait concession on the Newport pier due to'the occupancy of a portion of
the pier by the United States Army, was presented and read. Whereupon Council-
man Reed moved the adoption of a resolution amending the lease on the pier and
reducing the rental from 4,100 to $50 per month for the months of June, July,
August and September. The motion was duly seconded by Councilman Isbell, the
resolution designated Reeolution No. 2761 -A and same was adopted by the following
vote, to -wit:

The City Attorney presented lease with the Custodian of the Cadet Mess
Proposed
Funds, Santa Ana Army Air Base, for certain city property to be used for cadet's
lease with
swimming instruction and recreation. The City Attorney advised that the city

could not enter into the lease with the Custodian'of the Cadet Mess Funds and
that the lease should be made with the United States Army. The terms of the
lease were otherwise satisfactory.
Councilman Kirk moved that the Cadets from the Santa Ana Army Air Base
be permitted to use certain city property fronting on Newport Bay, located
southerly of the State Highway, for the purpose of cadet instruction and
recreation, under the terms of the proposed lease commencing May let on a month
to month basis at a rental of $125.00 per month, payable in advance, aril that
the City Attorney consult with the United States Army officials as to the proper
party to enter into the lease with the city, which motion was duly seconded by
Councilman Reed and carried by the following vote:
