Newport Beach, May 11, 1943-
On motion of Councilman Kirk, seconded by Councilman Isbell, the
action of the Planning Commission in connection with the application of
D. W. Elliott was sustained by the following roll call vote, to -wit:
AYES, COUNCILMEN: Kirk, Isbell, Reed, Hall.
NOES, COUNCILMEN: Allen.
ABSENT, COUNCILMEN: None.
First reading
of ordinance to City Attorney Thompson presented an ordinance amending Ordinance
amend Ord. 372 No. 372, which was read by the Clerk in full, and on motion of Councilman
Kirk, seconded by Councilman Isbell, the ordinance was passed to the
second reading by the following vote, to -wit:
AYES, COUNCILMEN: Kirk, Isbell, Reed, Hall.
NOES, COUNCILMAN: Allen.
ABSENT, COUNCILMEN: None.
First reading City Attorney Thompson presented and read in full an ordinance
of ordinance to amending Section 5 of Ordinance No. 440 relative to the drilling for oil
amend Ord. 440 in certain sections of the City, and on motion of Councilman Kirk, seconded
by Councilman Reed, the ordinance was passed to the second reading by the
following vote, to -wit:
AYES, COUNCILMEN: Kirk, Isbell, Reed, Hall.
NOES, COUNCILMAN: Allen.
ABSENT, COUNCILMEN: None.

The City Council of the City of Newport Beach met in adjourned regular
session in the City Council Chambers at the City Hall at the hour of 4 o'clock
p. m. on above date, with Mayor Hall presiding.
Roll Call
The roll was called, the following Councilmen answering present:
Allen, Isbell, Reed, Kirk, Hall. Absent, Councilmen None.
Mayor Hall asked of any member of the Council, or any one in the
audience wished the Minutes of the previous meeting of the Council, or any
part thereof, read, no one responded, and the reading of the Minutes was
dispensed with.

REPORTS OF STANDING COMMITTEES None.

A.J.Hayman
The letter of Andrew J. Hayman of the Selective Service Board,
invitation
inviting the members of the City Council to attend the entrainment of local
inductees at 6:30 p. m. May 17th, was presented and read, and on motion of
Councilman Allen, seconded by Councilman Isbell and carried, same was ordered
filed.
M.W.Burke
The letter of W. Maxwell Burke advising of a meeting of the Orange_ -
Housing Council
County Citizens Housing Council on May 13th and inviting attendance from the
City, was read, and on motion of Councilman Reed, seconded by Councilman
Isbell and carried, same was referred to the Housing Committee of the Chamber
of Commerce.

The letter of A. W. Hookway of Pasadena, making inquiries as to

Abusing
certain type of housing facilities in the City, was read, and on motion of
Councilman Reed, seconded by Councilman Isbell and carried, same was
referred to the Housing Committee of the Chamber of Commerce.
UNFINISHED BUSINESS
Hearing on
The City Clerk advised that this was the time for the hearing
oil drilling
advertised for in connection with the application of D. W. Elliott for
the privilege of slant drilling for oil in the westerly section of the City;
the affidavit of publication of the notice of the public hearing was presented
and all written protests received by the Clerk were read, which on motion of
Councilman Allen, seconded by Councilman Reed and carried, were ordered filed.
Mayor Hall then asked for verbal protests, whereupon Ralph Maskey proceeded
to address the Council in opposition to the oil project as did M. J. DuBarry
and others. Frank Riddle and Mr. Richards addressed the Council in favor of
granting the application of D. W. Elliott, stating that they were at first
opposed to the project, but after due investigation they believed it would
be an advantage to the community. Paul Palmer addressed the Council with a
suggestion that the Mayor appoint a committee consisting of oil men residing
here to investigate the proposition and make a report on the matter. D. W.
Elliott also addressed the Council explaining the manner in which the City
would benefit in the way of royalties from the oil development. Mrs. Betty
Lee presented several letter protesting the oil development, which were read
by the Clerk. After some further discussion of the question it was moved by
Councilman .Alle'n, seconaed._by Councilman Kirk and carried that the hearing
be closed.
At this juncture City Attorney Thompson explained certain matters
In connection with amending existing ordinances relating to oil drilling
within the City limits, whereupon it was moved by Councilman Kirk, seconded
by Councilman Reed, that the protests be overruled, the motion being carried
by the following roll call vote, to -wit:
AYES, COUNCILMEN: Kirk, Isbell, Reed, Hall.
NOES, COUNCILMAN: Allen.
ABSENT, COUNCILMEN: None.

Councilman Allen moved the adoption of a resolution, being a resolution
authorizing the Mayor and City Clerk to execute on behalf of the City of Newport
Beach "a quitclaim deed to Lillian L. Case and covering Lots 19 and 20, Block 634,
Corona del Mar. The motion was duly seconded by Councilman Isbell, and the
resolution adopted by the following vote, to -wit:
AYES, COUNCILMEN: Allen, Kirk, Isbell., Reed, Hall.
NOES, COUNCILMEN: None.
ABSENT, COUNCILMEN: None.
