Staff received construction bids for the Facilities Painting Project as part of the Facilities
Maintenance Master Plan for 2018-2019 and requests City Council approval to award the
work to Tony Painting (Tony) of Garden Grove, California.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 Class 1 (maintenance of existing facilities involving no
expansion of an existing use) of the CEQA Guidelines because this project has no
potential to have a significant effect on the environment;
b) Approve the project drawings and specifications;
c) Award Contract No. 7499-1 to Tony Painting for the total bid price of $398,700.00, and
authorize the Mayor and City Clerk to execute the contract; and
d) Establish a $60,000.00 (approximately 15 percent) contingency amount to cover the
cost of unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this project. The following fund
will be expensed:

BACKGROUND:
As part of the Facilities Maintenance Master Plan (FMMP) eighty-seven (87) City
buildings were inspected in 2013. The FMMP evaluation included electrical panels,
ventilation, plumbing, electrical, interior/exterior finishes, weather protection, and site
work. Staff prioritized the various capital maintenance needs and completed a number
of projects since the FMMP was developed with an emphasis on items that kept the
facilities in service. They included replacing backup generators, air conditioning and
heating units, roofs, and damaged flooring; sealing leaky windows; painting facilities, and
refreshing and remodeling public restrooms.
DISCUSSION:
At 10:00 AM on March 12, 2019, the City Clerk opened and read the following bids for
this project:

A mandatory pre-bid job walk was held at Big Canyon Reservoir to familiarize contractors
with the scope of work expected at the secured facility. More than twenty contractors
attended. A photo appendix was provided as part of the specification for all other
locations. The bid amount submitted by Tony Painting is substantially less than the
advertised engineer's $850,000.00 estimate. This estimate was based on bid pricing
included in recent bids.
Staff met with the owner of Tony Painting (low bidder) several times to insure they
understood what is expected to be completed, verified that his bid is complete and they
are able to perform all the work at the price being proposed. Reference checks conducted
by staff indicate Tony has satisfactorily completed similar painting projects for school
districts and other local, state, and federal agencies.

Staff also took into consideration that Tony was the low bidder (substantially below the
Engineer's Estimate) and awarded a large facility painting project for the City in 2017 and
performed well and met expectations on that project. Tony also currently holds an
On -Call Maintenance/Repair Services Agreement with the City of Newport Beach for
as -needed painting services and has performed well on this service contract. Tony
possesses a California State Painting and Decorating C-33 Contractor License as
required by the contract documents.
Per contract, Tony is allotted 80 consecutive working days to complete the work.
Liquidated damages for $1,000 per calendar day will be assessed if all work is not
substantially completed in that time. In addition to the standard 1 -year warranty on public
works construction, the contract includes a 2 -year zero deductible 100 percent parts and
labor extended warranty that provides the City with the ability to call upon the contractor
to make repairs to the work completed under this contract.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 Class 1 (maintenance of
existing facilities involving no expansion of an existing use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
