TITLE: Resolution No. 2019-36: Authorizing the Submittal of an Application
for the WaterSMART: Water and Energy Efficiency Grant for 2019
ABSTRACT:
The Utilities Department (Utilities) submitted a grant application with the Federal Bureau
of Reclamation WaterSMART: Water and Energy Efficiency Grant Program for 2019 to
support the Advanced Meter Infrastructure (AMI) Project. A supporting resolution by the
City Council is required to complete the City's grant application.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2019-36, A Resolution of the City Council of the City of Newport
Beach, California, Authorizing the Submittal of an Application for the WaterSMART:
Water and Energy Efficiency Grants for 2019 to Fund the City's Advanced Meter
Infrastructure Project.
FUNDING REQUIREMENTS:
The adopted FY2018-19 Capital Improvement Program (CIP) budget includes the
multi-year Advanced Meter Infrastructure (AMI) project with an initial appropriation of
$3.3 million funded by the reserve fund balance of the Water Fund. The project would be
budgeted over three fiscal years with a similar $3 million appropriation each year. The
Utilities Department is seeking $1.5 million in Federal grant funds to offset the City's net
costs on the AMI project. The total project cost is an estimated $9.2 million.

DISCUSSION:
During the City Council study session on November 28, 2017, Utilities presented a
comprehensive overview of the proposed Advanced Metering Infrastructure (AMI) project.
With the general support of the City Council for this project, Utilities staff moved forward
with the selected vendor and began the process of drafting a contract agreement for the
AMI project. On January 22, 2019, the City Council approved the Initial Proof of
Performance and Installation Agreement between the City and the selected vendor,
Mueller Systems, LLC.
The Utilities Department previously submitted a grant application with City Council
approval on May 22, 2018 and the City's project was not selected. Utilities Staff and our
contract professional grant writer received a debrief from the Bureau regarding the City's
application. Staff also received information regarding the scoring categories and types of
projects that were funded by the Bureau. Staff and the City's grant writer have made
adjustments to the application to make it more competitive and believe resubmitting
another grant application is a worthwhile endeavor.
On January 31, 2019, the Federal Bureau of Reclamation released funding opportunities
for fiscal year 2019, including one for Water and Energy Efficiency Projects as part of the
Department of Interior's WaterSMART program initiative. The Water and Energy
Efficiency Grant is awarded to projects that result in quantifiable water savings and those
which support broader water reliability benefits. The grant program lists municipal
metering projects that install meters resulting in measurable water savings, such as our
proposed AMI project, as an eligible project. Applicants must be capable of cost sharing
50 percent or more of the total project costs. The City of Newport Beach is eligible to
apply for this grant as a water delivery authority in the Western United States. The grant
required all applicants to submit their Water and Energy Efficiency grant by March 19,
2019.
With the assistance of the professional grant -writing firm, the City submitted the grant
application on March 19, 2019 and pursued the maximum $1.5 million in grant funds from
the Water and Energy Efficiency program for the AMI project. One component of the grant
application is to provide a supporting resolution from the City Council within 30 days of
the application submittal. Upon adoption of the Resolution, the City will forward it to the
Bureau of Reclamation to complete the application package.
Announcements of the grant recipients are expected in the fall of 2019. Project awards
will be made through grants or cooperative agreements as applicable to each project.
Should the City be awarded grant funds, the City has three years to complete the AMI
project. This three-year timeline mirrors Utilities' proposed three-year phased -in approach
of completing this project over multiple Capital Improvement Program fiscal year budgets.

ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
THE SUBMITTAL OF AN APPLICATION FOR THE
WATERSMART: WATER AND ENERGY EFFICIENCY
GRANTS FOR FISCAL YEAR 2019 TO FUND THE CITY'S
ADVANCED METER INFRASTRUCTURE PROJECT
WHEREAS, the City of Newport Beach ("City") Capital Improvement Program
("CIP") includes a multi-year Advanced Meter Infrastructure project to replace existing
water meters throughout the City with automated meters that would eliminate the need
for manual meter reading and provide better data on water consumption and use
("Project"),
WHEREAS, the Project is eligible for funding under the United States Bureau of
Reclamation WaterSMART: Water and Energy Efficiency Grants for Fiscal Year 2019
("Grant Program for FY 2019"), a cost -shared program emphasizing water and energy
efficiency;
WHEREAS, under the Grant Program for FY 2019, the United States Bureau of
Reclamation may award up to one million five hundred thousand dollars and 00/100
($1,500,000.00) to offset the total cost and the City would fund the difference in cost of
the Project. Currently, the FY2018-19 CIP budget includes an initial appropriation for the
Project with the total Project budgeted over 3 years;
WHEREAS, for all grants of thirty thousand dollars ($30,000) or more, City Council
Policy F-3 and F-25 generally require that, prior to the acceptance of a grant, the City
Council and City Manager approve the terms and conditions of the grant, approve budget
appropriations for the grant expenditures and City matching expenditures unless
previously appropriated through the budget adoption process, and approve and execute
the grant contracts;
WHEREAS, the City submitted a proposal under the Grant Program for FY 2019
that requires written authorization by the City Council for submittal of the application along
with certain assurances by the City including, but not limited to: 1) the right examine all
records or documents related to the Grant Program for FY 2019, 2) furnishing progress
reports and such other information required, 3) initiating and completing the work within
the applicable time frame after receipt of approval, 4) complying with applicable
environmental standards; and 5) general compliance with the assurances applicable to
the specific project as set forth in "Assurances -Construction Programs" ("Standard
Assurances") attached hereto as Exhibit A; and

WHEREAS, the purpose of this resolution is for the City Council to provide written
authorization of the City's submittal of the application for the Grant Program for FY 2019
and assent to the Standard Assurances.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council hereby authorizes the submission of an application
to the United States Bureau of Reclamation for the Grant Program for FY 2019 for the
Project and authorizes the City Manager or her designee to take all actions necessary to
complete the Grant Program for FY 2019 application including, but not limited to, agreeing
to comply with the Standard Assurances, attached hereto as Exhibit A.
Section 2: In the event grant funding is provided by the United States Bureau of
Reclamation, the City Council does hereby authorize the City Manager or her designee
to accept the grant and sign any contract for administration of the grant funds. The City
Council does hereby delegate the City's Finance Director to act as a fiscal agent for any
grant funding received.
Section 3: The recitals provided in this resolution are true and correct and
incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council
hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) ( the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)( 3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 6: This resolution shall take effect immediately upon its adoption by the
City Council and the City Clerk shall certify the vote adopting the resolution.

11. Will comply, or has already complied, with the
requirements of Titles II and III of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of

Section 102(a) of the Flood Disaster Protection Act of 1973

flood insurance if the total cost of insurable construction
and acquisition is $10,000 or more.
15. Will comply with environmental standards which may be
prescribed pursuant to the following: (a) institution of
environmental quality control measures under the National
Environmental Policy Act of 1969 (P.L. 91-
190) and Executive Order (EO) 11514; (b) notification
of violating facilities pursuant to EO 11738; (c)
protection of wetlands pursuant to EO 11990; (d)
evaluation of flood hazards in floodplains in accordance
with EO 11988; (e) assurance of project consistency
with the approved State management program
developed under the Coastal Zone Management Act of
1972 (16 U.S.C. §§1451 et seq.); (f) conformity of
Federal actions to State (Clean Air) implementation
Plans under Section 176(c) of the Clean Air Act of
1955, as amended (42 U.S.C. §§7401 et seq.); (g)
protection of underground sources of drinking water
under the Safe Drinking Water Act of 1974, as
amended (P.L. 93-523); and, (h) protection of
endangered species under the Endangered Species
Act of 1973, as amended (P.L. 93-205).
16. Will comply with the Wild and Scenic Rivers Act of
1968 (16 U.S.C. §§1271 et seq.) related to protecting
components or potential components of the national
wild and scenic rivers system.
17. Will assist the awarding agency in assuring compliance
with Section 106 of the National Historic Preservation
Act of 1966, as amended (16 U.S.C. §470), EO 11593
(identification and protection of historic properties), and
the Archaeological and Historic Preservation Act of
