TITLE: Bayside Drive and Jamboree Road/Marine Avenue Improvements —
Increased Contingency Authority and Budget Amendment (16R12)
ABSTRACT:
On November 27, 2018, City Council awarded Contract No. 7224-1 to GMC Engineering
for $2,913,000 for Bayside Drive and Jamboree/Marine Avenue Improvements. As part
of the contract award, a 10 percent construction contingency was authorized to cover the
cost of potential unforeseen work. While the project was nearing completion, an 18 -inch
water main recently broke near the intersection of Bayside Drive and Jamboree Road
causing a substantial amount of damage to the roadway. Increased costs are required
to restore/reconstruct portions of the Jamboree Road pavement, curb/gutter and sidewalk
from the water main break. Additionally, the Orange County Sanitation District has
requested some special work within our project and will be reimbursing the City for the
added cost of this work. To accommodate these items, staff is requesting to increase the
contingency authority for this project to 23% and approving a Budget Amendment to
increase appropriations by $356,946 so necessary repairs can be made and the project
can be completed within the approved budget.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15060 c(2) (the activity will not result in a direct or reasonably
foreseeable indirect physical change in the environment) and 15060c(3) (the activity
is not a project as defined in Section 15378) of the CEQA Guidelines, because this
project has no potential to have a significant effect on the environment;
b) Establish a contingency amount up to $656,946 (approximately 23%) for Contract No.
7224-1 to cover the cost for unforeseen work not included in the original contract; and
c) Approve Budget Amendment No. 19BA — 039 appropriating $300,000 from the Water
Reserve Fund unappropriated fund balance to the Water System Rehabilitation
project (Account No. 70201932-980000-19W05); recognize $56,946 in new revenue
from Orange County Sanitation District (OCSD) (13501-431075-16R12) and
appropriate $56,946 in expenditures to the Bayside Drive improvement project
(Account No. 13501-980000-16R12).

FUNDING REQUIREMENTS:
The Budget Amendment increases revenue estimates by $56,946 in additional revenue
from OCSD and $56,946 in increased expenditure appropriations to reimburse the City
for requested special work in conjunction with the Bayside Drive improvement project.
The Budget Amendment also appropriates $300,000 in increased expenditure funding
from Water Reserve unappropriated fund balance to cover the cost of additional work
required to repair the damaged street, curb/gutter and sidewalk due to an unrelated water
transmission main break within the project limits.
This action will increase the project contingency from the current $300,000 (10%) to the
new amount of $656,946 (23%).

The Bayside Drive and Jamboree Road/Marine Avenue Improvement Project is currently
under construction and nearly completed through a contract awarded to GMC
Engineering. This project included pavement rehabilitation on Bayside Drive from East
Coast Highway to Marine Avenue/Jamboree Road, and on Jamboree Road & Marine
Avenue from East Coast Highway to North Bay Front. Additional project improvements
included new landscape medians on Bayside Drive and new retaining walls and sidewalk
along Bayside Drive and reconstructing a retaining wall along northbound Jamboree
Road. Landscaping along the Bayfront walk along Bayside Drive was refurbished with
new irrigation and California friendly planting.
The project originally was authorized with a 10 percent contingency. The project is now
nearing completion; however, has been drawing on the contingency throughout the
construction to address project change order items such as relocation of some water
meters, unforeseen but necessary storm drain repairs, upgrading King Palms in some of
the planned medians to Date Palms, and including additional concrete work related to
driveways and sidewalks. In addition to these changes, OCSD has requested the City
use a specific sub -contractor familiar with their specially lined truck sewer main for
adjusting and modifying their manholes, which came with an additional cost. OCSD has
agreed to reimburse the City for this added cost, and is included as part of this request to
increase the contract contingency allowance.
Lastly, on February 12, 2019, an 18 -inch city water transmission main on Jamboree Road
broke causing significant roadway damage. The water transmission main repairs itself
took approximately one week to address at a cost of approximately $125,000 (expensed
by the Utilities Department). Since the Bayside paving project was still under construction
and the break was within and near the construction limits, staff used the opportunity to
save time and cost by requesting our contractor (GMC) to complete the required sidewalk,
curb, gutter and roadway repairs as added work to their existing contract. The additional
meter relocation cost along with the necessary roadway repairs due to the water main is
estimated to cost $300,000, though the work has not been finalized.

Despite the unseasonably high levels of rainfall and this transmission water main break,
the project continues to move forward in a timely manner and is expected to meet the
substantially complete target date of April 18, 2019.
