Committee appointed to Investigate. February 24, 1948 The City Council of the City of NeiV ort Beach met in regular session in the City Council Chambers at the City Hall at' the hour of 4 o'clock p.m. on.above date with Mayor Reed presiding. The roll was called, the following Councilmen answering present: Allen, Isbell, Robertson., Siler, Reed. The Mayor asked if any of the Councilmen or anyone in the audience wished the minutes of the previous meeting or any part thereof read; no one responded and the reading of the minutes was dispensed with. REPORTS OF SPECIAL COMMITTEES The report of City Engineer Webb on the improvement of 31st Street was presented and on motion of Councilman Isbell, seconded by Councilman Allen and carried, the report was accepted, whereupon a letter was read from Rheta Goff ui.ng that some action be taken toward the surfacing of 32nd Street and that the property owners contacted would agree to pay one -half the cost of the improvement. On motion.of Councilman Robertson, seconded by Councilman Siler and carried, the letter was referred to the City Engineer for inves- tigation.' REPORTS OF STANDING COMMITTEES: None the application of Van Fleet Fish Market for a license to operate ,a fish market at 111 - 21st Place, Newport, having been approved by the Health Officer, was on motion of Councilman Allen, seconed by Councilman Isbell and carried, granted. The request of Gordon S. Wevill for the removal of certain pool and billiard tables from the Balboa pavilion to 702 East Bay Avenue and for a license to conduct a pool and billiard parlor at that location was on motion of Councilman Allen, seconded by Councilman Robertson and carried, granted, Chief of Police Hodgkinson advised the Council that there were no objections to the application. The letter of Beatrice E. Shaw of 7402 West Ocean Front urging that some action be taken toward relieving the blocking of the alley which prevented the use of their garage wasOresented and read and on advice of the City Attorney it was moved by Council- man Robertson, seconded by Councilman Allen-and carried, that Instructions be given to the proper department to clear the alley of any obstructions infringing on City property. The reauest of Rev. Samuel C. Knapp for permission to solicit funds in the City for home and missionary work and for the distribution of bibles and other Christian literature in hospitals, jaws and homes was on advice of the City Attorney that a City ordinance prohibited same denied and ordered referred to the local Community Chest on motion of Councilman Allen, seconded by Council- man Siler and carried. The recommendation of the Orange County Traffic Committee for the erection of signs to indicate approach to school property on Irvine Avenue and on 15th Street in the vicinity of the NeTort Harbor Union High School was approved on motion of Councilman Isbell, seconded by Councilman Robertson and a sign ordered placed on that portion of Fifteenth Street approaching Irvine Avenue. The motion was carried by the following vote, to wit: AYES, COUNCILMEN: Allen,.Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The request of the Newport Beach School District for the annexation to the City of Newport Beach of Lot 1 of Tract 1220 recorded in Pages 49 and 50 of Miscellaneous Maps, Records of Orange County, California. On motion.of Councilman Isbell seconded by Councilman Siler, the request was referred to t'.e City ingineer. The letter of Thanks from the Newport Harbor Teen Canteen, Inc. was on motion of Councilman Allen, seconded by Councilman Isbell and carried, ordered filed. The Balboa renninsula Point Community Association petitioned the Council for the erection of boulevard stop signs for the inter- section of Ocean Boulevard and Central Avenue and Miramar Drive and Central Avenue. On motion of Councilman Isbell, seconded by Councilman Robertson and carried, same was referred to the Chief of Police who spoke to the Council on the Matter. Street Superintendent Covert presented a survey showing the location of proposed Stop signs on Balboa Island consisting of 70 signs and estimating the cost at$9.69 per sign. Chief of Police Hodgkinson brought up the idea of alternating the traffic on the Island as a means of facilitffiing traffic. Mayor Reed appointed a committee consisting of Councilmen ,A llen and Siler and City Engineer Webb to look into the matter, the appointments being confirmed on motion of Councilman Robertson, seconded by Councilman Isbell and carried, the installation of the signs was approved on motion of Councilman Isbell, seconded by Councilman Allen and carried by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Plumbing Inspector Charles Y. Dyer presented his resigna- tion in a letter to the Council and expressed his appreciation in having been given the opportunity to serve the City in that capacity. On motion of Councilman sbell, seconded by Councilman Robertson and carried, the resignation was accepted and a letter of thanks ordered sent to Mr.JDyer for hisservices while in the employ of the City. UNFINISHED BUSINESS Two letter from Attorney John Martell in connection with the application of S. B. MacA'levy for a license to display, sell and rent Bendix washing machines at 417 - 31st Street were read, whereupon Attorney Martell addressed the Council concerning the matter. Considerable discussion iias had on the subject by the Council and City Attorney who advised that the zoning restrictions forbid the operation of the business applied for although the consensus of the Council was that in the particular locatSon proposed for the business was not objectionable it would establish a precedent where others might Ash to operate similar businesses in locations where it would prove objectionable. On motion of Councilman Robertson, seconded by Councilman Allen the application was Laid on the Table pending a report from the Planning Commission to which the application has been referred. The motion was carried by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The bid submitted for the furnishing of gasoline for the ensuing year by R. L. Callis of General Petroleum Corporation laid over from the previous meeting was presented and on motion of Councilman Allen, seconded by Councilman Isbell the bid was accepted and the Mayor and City Clerk authorized to execute same on behalf of the City of Newport Beach by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None NEW BUSINESS Resolution No. 331 of the Planning Commission denying the application of The Irvine Company for the zoning of certain property consisting of a portion of Lots 171 and 166 in Block 54 of Irvine's Subdivision to a C -2 classification and recommending that a new application be filed for C -1 classification was presented and on motion of Councilman Allen, seconded by Council- man Siler and carried, the action of the Planning Commission was approved. Resolution No. 332 of the Planning Commission granting a 50% front yard setback and denying a 50% rear yard setback to 0. N. Beeman,.° and Jenner Inman for Lot 19, Block 4, Section 5 Balboa Island was on motion of Councilman Allen, seconded by Councilman sbell, and carried, approved. City Attorney Thompson presented a communication from the State Compensation Insurance Fund with an offer of settlement of the claim of Ray Johnston member of the Newport Beach Police Department injured in a motorcycle accident while on duty. The offer of the insurance company was discussed, it appearing to the Council as being inequitable from the City's standpoint and on motion of Councilman Robertson, seconded by Councilman Allen the offer was rejected by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The matter of placing on the Vity election ballot an amendment to the Civil Ordinance which would eliminate the requirement of a years residence in the City as a qualification for appointment as a police officer. It was ruled by the City Attorney that inasmuch as the notice of e](ption had already been published it would not be possible to place the amendment on the ballot but at the next election held in.the City the proposition could be voted upon by a separate ballot, and on motion of Council- man Robertson, seconded by Councilman Isbell and carried, the measure was ordered placed before the voters at the first election to be held in the City. City administrator Sailors brought up the question of the City's responsibility in connection with the operation of the proposed State Park at Corona del Mar and on motion of Councilman Robertson, seconded by Councilman Allen and carried, a committee was ordered appointed to investigate and report on the matter. City Administrator Sailors presented the matter of a street lighting survey and on motion of Councilman Robertson, seconded by Councilman Allen and carried, a committee was ordered appointed to study the matter. The question of a City Manager was brought up for dis- cussion whereupon Mayor Reed appointed a committee consisting of City Administrator Sailors, City Attorney Thompson, a citizen of the community and the City Council to investigate the matter and on motion of Councilman Isbell, seconded by Councilman Robert- son and carried, the City Attorney was instructed to prepare the necessary form of ordinance for the creation of a City Manager for presentation at thenext meeting of the Council. ! } Resignation of Charles Y. Uniform wage scale adopted On motion of Councilman Robertson, seconded by Councilman for construction of curbs Siler the uniform wage scale in connection with.the installation and sidewalks, new City Hall. of curbs and sidewalks at the new City Hall site was adopted by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Clerk to advertise for bids On motion of Councilman Robertson, seconded by Councilman for curbs and sidewalks, new Siler and carried, the City Clerk was directed to advertise for bids City Hall. for the installation of curbs, and sidewalks at the new City Hall site. City Engineer Webb presented plans and specifications for Peas and specifications for the installation of 700 feet, 24 inch water pipe across the Upper installation of 700 ft. 240° Bay bridge which on motion of Councilman Robertson, seconded by water pipe, approved. Councilman Siler and carried, were approved. On motion of Councilman Robertson, seconded by Councilman Uniform wage scale adopted. Siler the uniform wage scale in connection with the laying of 24 inch water pipe across the Upper Bay Bridge was adopted by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed. NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Clerk to advertise for bids On motion of Councilman Robertson, seconded by Councilman for installation of 241, water Siler and carried, the City Clerk was directed to advertise for bids pipe aaross,Upper Bay Bridge. for the installation of 24 inch water pipe across the Upper Bay Bridge. Kate McCann addressed Council Kate McCann spoke to the Council regarding the breaking on breaking of curbs on Bal up of curbs on Balboa Island for entrances to garages, alleging that Isl for entrances to garages. in many cases entrance could be had from alleys. Attention was called to instructions given to the Building.Inspector by the City Council which according to the speaker have not been complied with. The matter of buildings being erected across the rear of three lots at Collins and.Park Avenues said to be in violation of the R -2 zoning restrictions.
