The roll was called, the following Councilmen answer- ing present: Allen, Isbell, Robertson, Siler, Reed. The Mayor asked if any of the Councilmen or anyone In the audience wished the minutes of the previous meeting, or any part thereof read; no one responded and the reading of the minutes was dispensed with. On motion of Councilman Allen, seconded by Council- man Isbell and carried, the regular order of business was changed in order to hold the hearing advertised for this date In connection with the improvement of Central Avenue. IN THE MATTER OF THE PROPOSED GRADING, PAVING, CONSTRUCTION OF CURBS, SIDEWALKS, CROSS- GUTTERS, CATCH BASINS AND STORM DRAINS, SEWER PUMPING PLANT, SEWER MAINS AND APPURTENANT WORK IN CENTRAL AVENUE AND OTHER STREETS, SHOWN IN THE WRITTEN REPORT OF THE CITY ENGINEER OF THE CITY OF NEWPORT BEACH, CALIFORNIA. FILED FEBRUARY 9, 1948 HEARING ON PROTESTS UNDER THE "SPECIAL ASSESSMENT INVESTIGATION, 'LIMITATION AND MAJORITY PROTEST ACT OF 1931," DIVISION IV OF THE STREETS AND HIGHWAYS CODE. DATE: April 12, 1949. The City Clerk of the City of Newport Beach reported that this was the time and place fixed for the hearing on the written report heretofore filed by the City Engineer of the said City for certain street improvements in Central Avenue and other streets, and approved by the City Council of said City on the 9th day of February, 1948, in accordance with the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," of the Streets and Highways Code, to -wit: Monday the 12th day of April, 1948, being the day, and the Council 6hamber of the said City, being the place fixed for such hearing. The Clerk also reported that on the 25th day of February, 1948, he deposited, or caused to be deposited, in the United States mail, with postage prepaid, a Notice of the time and place of hear- ing upon said written report, all in the manner and form required by Sections 2851, 2852, and 2853 of the said Code, and that an affidavit in proof of said mailing is now on file in the office of the City Clerk and of the City Council of said City; and more than thirty (30) days having elapsed since the date of such mail- ing, the said City Council has acquired power to proceed with the hearing in said matter, pursuant to said Code. The Mayor of said City of Newport Beach, being the presiding officer of the City Council, then announced that the first order of the hearing would be the reading of the said written report, except as to the map, plat or diagram, and the assessed valuations and true valuations of, and the assessments and estimffied assessments upon the individual parcels of land, before protests would be considered. Thereupon the Clerk read said written report so defined by the Mayor. The Mayor then inquired of the Clerk whether any written Regular order of business changed for hearing on Central Avenue. protests or objections to the doing of the things proposed in said written report had been filed with him in said mentioned matter. The Clerk reported that certain written protests had been filed with him prior to the time set for the hearing, by the following persons: Mrs. Ida Gronsky and others. Reference is hereby made to all written protests on file with the Clerk. The Mayor then inquired if any persons who would be entitled to protest or object to the doing of the things proposed to be done, desired to make oral protestsor objections, and stated that such persons would now be heard. Each addressed the City Council on the matter of said written report and the doing of the things proposed in said written report and propounded many questions as to the amounts of various estimated assessments upon the individual parcels of land. Persons addressing the Council were: Ontario Investment and others. After a full and thorough hearing had been had in said matter and an opportunity having been.given to any and all persons desiring to be heard or to make objections to the tlAngs proposed to be done, and after having considered the wrl ten report filed by the Engineer in said matter, the City Council deemed it advisable that the hearing be continued for the purpose of checking the protests. Employment in Electrical Dept. Rating of Captain given to Walter Dyson, approved. Rating of Sergeant given to John L. Upson, approved. Probationary appointment of patrolmen, approved. Probationary appointment of Leo F. Smith, patrolman, approved. Employment of Rita Knowles, approved. Employment of Rita Knowles to be permanent. Thereupon the following motion was made by Councilman Robertson: That all written protests be referred to the Engineer for checking and report, and that further consideration of said matter be continued until the hour of 4:00 P.M. of April 20, 1948. Said motion being duly seconded by Councilman Siler, the same was carried by the following vote, to wit: AYES, COUNCILMEN: Allen, Siler, Isbell, Robertson, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None On motion of Councilman Allen, seconded by Councilman Silar and carried, the regular order of business was resumed. REPORTS OF SPECIAL COMMITTEES: None ' REPORTS OF STANDING COMMITTEES: None COMMUNICATIONS The application of F. C. Turner for a license to operate a Laundromat at 2817 villa Way was on motion of Councilman Isbell, seconded by Councilman Allen and carried, granted. The application of Walter R: Perkins for a license to ' sell, sandwiches, cold drinks and coffee at 7011 East Bay Front was on motion of Councilman Isbell, seconded by Councilman Robertson and carried, granted, subject to the approval of the Health Officer. The letter of J. L. Fisher calling attention to a hazard existing at 39th Street and Channel Place, Newport Island consisting of a drain pipe rusted off to a jagged edge. On motion of Councilman Allen, seconded by Councilman Siler and carried, the letter was referred to the City Engineer. The letter of D. D. Dunlap 011 Company requesting Information relative to leasing certain City owned land in the vicinity of the City's Pumping Plant was on motion of Councilman Isbell, seconded by Councilman Robertson and carried, referred to the City Adminis- trator. -'he request of City Electrician Woodmansee for the employ- ment of Bill Danyard at the rate of .88¢ per hour, effective March 11, 1948 and Joseph F. Bond at the rate of .88¢ per hour, effective, March 12, 1948 was on motion of Councilman Allen, seconded by Council- man Robertson approved by the following vote, to wit: AYES, COUNCILMEN: Alai, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The recommendation of Chief of Police Hodgkinson for the ' rating of.Acting Captain Walter Dyson to that of Captain was on motion of Councilman Robertson, seconded by Councilman Isbell and carried, approved.. The recommendation of Chief of Police Hodgkinson for the rating of Acting Sergeant John L. Upson to that of Sergeant was on motion of Councilman Isbell, seconded by Councilman Robertson and carried, approved. The request of Chief of Police Hodgkinson for the probationary appointment of Warren L. Cassel and Edward. S. Bates as patrolmen at a salary of $196.00 per month was on motion of Councilman Robertson, seconded by Councilman Isbell approved by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, SLer, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The recommendation of Chief of Police Hodgkinson for the probationary appointment of Leo F. Smith as patrolman at a salary of $196.00 per month to fill the vacancy on the department due to the separation of extra officer Cornecl who was unable to qualify as to residence was on motion of Councilman Robertson, seconded by Councilman Isbell approved by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None ; the recommendation of Chief of Police Hodgkinson for the employment.of Rita Knowles as Clerk-Typist, Grade I at a salary of $10.00 per month was on motion of Councilman Robertson, seconded by Councilman Siler approved by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Uhief of Police Hodgkinson also advised that the contem- plated move to the new City Hall will necessitate some changes in the method of handling business licenses and that the employment of Rita Knowles should be on a permanent basis. Finance Committee were on motion of Councilman Allen, seconded by Councilman Isbell, were allowed and Warrants ordered drawn by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Councilman Robertson moved the adoption of a resolution Res. No. 3552 being a resolution authorizing the Mayor and City Clerk to execute Quitclaim Deed to Lincoln on behalf of the City of Newport Beach, the following quitclaim H. Norman. deed to the following person and covering the following described property: Designated in Resolution No. 3552. Lincoln H. Norman Lot 21, Block 1, Tract 919 The motion was duly seconded by Councilman Isbell and the res- olution adopted by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The appointment of Lowell Dean Pollom as Merchant Patrolman w s on motion of Councilman Isbell, seconded by Councilman filer and carried, confirmed.. On motion of Councilman Allen, seconded by Councilman Robertson, the Mayor and City Clerk were authorized to execute on behalf of the City of Newport Beach a certain contract by and between the City of Newport Beach and Dual Parking Meter Company for the purchase of parking meters. The motion was carried by the following vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed . NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None bids were submitted for the furnishing of venetian blinds for the new City Hall by Del Mar Company of Long Beach and The Shade Shop of Newport Beach. On motion of Councilman Robertson, seconded by Councilman Isbell and carried, the bids were referred to City Administrator Sailors. Bids for the improvement of Villa Way were submitted by the following: George Mason Company, Griffith Company, O'Brien & Bell Construction Company, Cox Brothers Construction Company, and Sully Miller Construction Company which were re- ferred to the City Engineer for checking, whereupon the City Engineer advised that the bid of Sully - Miller Contracting Company was the lowest bid submitted and recommended that same be awarded to that firm. On motion of Councilman Isbell, seconded by Councilman Siler the contract was awarded to Sully - Miller Contracting Company, by the following vote, to .,pit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None On motion of Councilman Isbell, seconded by Council- man Siler and carried, the Mayor and City Clerk were authorized to execute on behalf of the "ity of Newport Beach the contract, by and between the City of Newport Beach and Sully - Miller Contracting Company for the surfacing of Villa Way and checks of unsuccessful bidders were ordered returned. Councilman Allen moved the adoption of a resolution, being a resolution appointing election officers and designating polling places for the Municipal election to be held in the City of Newport Beach on Monday, the 17th day of May, 1945, and providing for the opening and closing of the polls and the compensation of election officers. The resolution for adoption was duly seconded by Councilman Siler, designated Resolution No. 3553 and was passed by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed , NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Councilman Allen moved the adoption of a resolution, being a resolution executing a certain agreement of lease to the Newport Harbor Chamber of Commerce from the City. Said resolution was duly seconded by Councilman Siler, designated Resolution No. 3554 and was carried by the following roll call vote to wit: AYESe COUNCILMEN:. Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Appointment of Merchant Patrolman, confirmed. Authorization of certain contract with Dual Parking Meter Co. Bids for furnishing venettLn blinds for new City Hall referred to City Administra- tor. Bids for improvement of Villa Way submitted, Awarded to Sully - Miller Co. Contract authorized to Sully - Miller Co. Res. No. 3553 Appointing election officers for May 17, 1945. Res. No. 3554 Agreement of Lease with Chamber of Commerce. On motion of Councilman Allen, seconded by Council- Lease to Chamber of Commerce man Siler and carried, the lease from the City of Newport not to be delivered until Beach to the Chamber of Commerce was ordered not to be delivered plans are approved by City< until the plans and specifications have been approved by the City. Apkn of J. C. Axelson for The application of J. C. Axelson for a permit to extend permit to extend existing to the project line an existing pier fronting on Lots 302 and 303, pier, granted. Tract 907 was on motion of Councilman Isbell, seconded by Council- man Robertson and carried, granted subject to the approval by the War Department. The applicant to be informed regarding the extension of a boat beyond the project line. Res. No.. 3585 Pursuant to.instructions heretofore given by the City Improvement of certain Council, the City Engineer presented the written report for the streets in Newport Heigkts. proposed improvement of certain streets in Newport Heights, said report having been prepared pursuant to the provisions of the "Special Assessment Investigation Limitation and Majority Protest Act of 1931," being Part 2, Division IV of the Streets and Highways Code of the State of California, and after consideration of said report by the City Council, Councilman Robertson offered and moved the adoption of Resolution No. 3585 entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PUR- SUANT TO THE REQUIREMENTS OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931," BEING PART 2, DIVISION IV OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA." which motion was seconded by Councilman Siler and upon roll call said Resolution was adopted by the following vote, to wit: AYES, COUNCILMEN: Allen, Siler, Isbell, Robertson, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None ADJOURNMENT On motion of Councilman Robertson, seconded by Councilman Siler and carried, an adjournment was taken to 4 o'clock P.
