The City Arts Commission meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires
that the special meeting City Arts Commission agenda be posted at least seventy-two (72) hours in advance of the
meeting and that the public be allowed to comment on agenda items before the Commission and items not on the
agenda but are within the subject matter jurisdiction of the City Arts Commission. The Chair may limit public comments
to a reasonable amount of time, generally three (3) minutes per person.
The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an
attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will

enacted by one motion in the form listed below. City Arts Commissioners have received
detailed staff reports on each of the items recommending an action. There will be no separate
discussion of these items prior to the time the City Arts Commission votes on the motion
unless members of the City Arts Commission request specific items to be discussed and/or
removed from the Consent Calendar for separate action. Members of the public who wish to

Jim Mosher remarked that provisions prohibiting mass-produced pieces have been removed from Council Policy I-9. He asked when the City Arts Commission will
recommend siting for the new sculptures. If the City Arts Commission decides to eliminate one of the pieces, he recommended Hope Springs Eternal as its replacement because the public ranked it highly.
V. CURRENT BUSINESS
A. Items for Review and Possible Action
1. Reconsideration of Pieces for Sculpture in Civic Center Park Exhibition-Phase IV – Staff recommends that the City Arts Commission reconsider the pieces Delilah and Mule Deer in terms of practicality. The
Commission should also reconsider Pinnacle and Polished stainless steel
sculptures as new information concerning the pieces has emerged since their recommendation for approval at the special meeting on March 21,
2019.
Chair Greer reviewed the criteria used to evaluate submissions. Staff requests the City
Arts Commission reevaluate Delilah in relation to the appropriateness of it being viewed by all ages.
Commissioners felt Delilah is a beautiful piece with high artistic merit, but it could be considered risqué or inappropriate for children and could draw unwanted or undue
attention as the loin cloth is rather low and the bottom of one breast is exposed.

In reply to Jim Mosher's question, Library Services Director Hetherton advised that the criteria have been used for all phases of the Sculpture Garden. Mr. Mosher concurred with Commissioners' comments regarding Delilah.
Motion made by Vice Chair Bendetti, seconded by Chair Greer, and carried (4-0-0-2) to remove the sculpture Delilah from the list of sculptures recommended to the City Council
for Phase IV of the Sculpture Exhibition.

Chair Greer reported staff requests the City Arts Commission reevaluate the sculpture
Mule Deer as the antlers raise concerns about safety. Commissioners liked Mule Deer; however, the antler points are a safety concern.
Commissioner Kaufman believed the sculpture could be sited in a way that reduces the temptation and one's ability to climb on the piece. The sculpture would look really nice on an elevated site. Commissioners reviewed photos of the sculpture in an effort to determine
the sharpness of the antler points. Library Services Director Hetherton commented that people would be more likely to slip
and fall onto the sculpture if it is sited on a slope.
Jim Mosher indicated the safety issue is overstated because the obvious sharpness of the
antler points will deter people from climbing on it. The piece seems to be small and is not artistic.
Library Services Director Hetherton advised that the height of Mule Deer appears to be 5 feet 2 inches to the top of the antlers.
Motion made by Vice Chair Bendetti, seconded by Chair Greer, and carried (4-0-0-2) to remove the sculpture Mule Deer from the list of sculptures recommended to the City
Council for Phase IV of the Sculpture Exhibition. AYES: Greer, Bendetti, Kaufman, Little

Chair Greer noted the first and second alternate selections for the Sculpture Exhibition are
Contender and START Now. The correct dimensions for Pinnacle are 36 inches high, 42
inches wide, and 37 inches deep. Other sculptures selected for the Sculpture Exhibition are smaller, and Pinnacle has high artistic merit. Pinnacle tied for seventh in the public
survey, and the panel ranked it fifth.
Jim Mosher advised that he would not select Pinnacle, but the public ranked it highly.

Motion made by Commissioner Little, seconded by Commissioner Kaufman, and carried
(4-0-0-2) to retain the sculpture Pinnacle with the corrected dimensions as an alternate selection in the list of sculptures recommended to the City Council for Phase IV of the Sculpture Exhibition.

Chair Greer reported the artist has renamed Polished stainless steel to Wind Swept and will provide three figures rather than four. The City Arts Commission may reconsider its
selection of Wind Swept as an alternate because the number of figures has changed.
Rick Stein, Arts Orange County, believed the artist is not familiar with the submission
process and did not verify the information in his submission forms. The public ranked the sculpture second, and the panel ranked it tenth.
In response to Chair Greer's queries, Mr. Stein advised that the heights of the three pieces vary slightly. He will request the artist send the three tallest pieces for installation.
Commissioners preferred three figures over four figures. The sculptures are contemporary and interesting.
Motion made by Chair Greer, seconded by Commissioner Kaufman, and carried (4-0-0-2) to retain the sculpture Wind Swept f/k/a Polished stainless steel consisting of three figures
as an alternate selection in the list of sculptures recommended to the City Council for
Phase IV of the Sculpture Exhibition.

ABSENT: Glabman, Baker Mr. Stein indicated Contender was selected for Phase III but was not available when
installation began. Contender was replaced with a similar but taller sculpture entitled Be Still and Know.
Commissioners supported moving Contender from the list of alternates to the list of selections, stating Contender will add diversity to the Sculpture Garden, look imposing, and cast interesting and beautiful shadows. The sculpture is better suited to a lower area
of the Sculpture Garden.
Mr. Stein reported siting for the sculptures has not been determined.
In answer to Jim Mosher's inquiry, Chair Greer indicated the alternates are ranked as
Contender first, START Now second, Exposed third, and Fallen Sky fourth. Two
alternates will remain if the City Arts Commission moves two of the four alternates to the list of selections.

Motion made by Commissioner Little, seconded by Vice Chair Bendetti, and carried (4-0-
0-2) to replace Delilah with Contender in the list of sculptures recommended to the City Council for Phase IV of the Sculpture Exhibition.

Chair Greer noted START Now ranked ninth in the public survey and tied for 14th in the
panel voting.
Commissioners discussed siting for the sculpture, the rear of the sculpture, ensuring the
rear of the sculpture is visible, and ensuring light reflected from the sculpture is not a hazard. The sculpture will draw a strong response from millennials.
Jim Mosher suggested many people may wonder why the sculpture is there if they do not understand its artistic message.
Motion made by Chair Greer, seconded by Commissioner Little, and carried (4-0-0-2) to replace Mule Deer with START Now in the list of sculptures recommended to the City
Council for Phase IV of the Sculpture Exhibition. AYES: Greer, Bendetti, Kaufman, Little

Chair Greer noted the remaining alternates are Exposed and Fallen Sky.
Jim Mosher suggested the City Arts Commission select a third alternate. In the past, alternate sculptures were needed to replace sculptures withdrawn by the artist.
Chair Greer proposed adding R.M.A.B as a third alternate. Hope Springs Eternal needs to be illuminated, and the City Arts Commission is trying to avoid illuminated sculptures.
A Commissioner and Library Services Director Hetherton raised safety concerns in relation to R.M.A.B.
Vice Chair Bendetti asked about the possibility of displaying Hope Springs Eternal without illumination. The sculpture was popular with the public.
Mr. Stein reported Hope Springs Eternal was not intended to be illuminated necessarily.
Jim Mosher advised that the photo of Hope Springs Eternal in the public survey did not show it illuminated.
Motion made by Commissioner Kaufman, seconded by Commissioner Little, and carried (4-0-0-2) to add the unilluminated sculpture Hope Springs Eternal as the third alternate to

B. Consent Calendar Items
4. Financial Report – Review of financial information
Library Services Manager Basmaciyan reported the Programming balance of $26,485 did not change from March to April. The $10,291 grand total for Professional Services is correct; however, the exact amount may be different by a few cents due to the rounding
of amounts. The Professional Services balance decreased due to payments for Alan Scott's services and minute transcription for the month and a transfer of $19,711 to the Sculpture Garden budget. The balance of the Sculpture Garden budget is now $122,711.
The Cultural Arts Grants balance has not changed. In reply to Chair Greer's query, Library Services Manager Basmaciyan advised that
monies remaining in the Programming budget for the Newport Beach Art Exhibition near the end of the fiscal year can be reallocated to Concerts on the Green; however, staff will
need sufficient time to plan and execute another concert.
5. Cultural Arts Activities – Monthly review of cultural arts activities from the
Library Administrative Office for upcoming Library and City arts events and
services
Library Services Manager Basmaciyan indicated the Joe Cladis exhibit will remain on display in the Central Library Gallery until May 3. The pieces have received a great deal of positive attention. Festival Ballet Theatre offered two performances of Sleeping Beauty
on March 16 with a total attendance of 420 people. Vice Chair Bendetti related that the event was well organized and did not impede patrons'
use of the Library. Motion made by Chair Greer, seconded by Commissioner Glabman, and carried (5-0-0-
1) to approve the Consent Calendar.

6. Sculpture in Civic Center Park Exhibition-Extension of Phase III –
Extend the Sculpture in Civic Center Park Phase III sculptures, Balancing
Act, Burnt Matchstick, Cultural Pedestrians, Getting Your Bearings, and No Swimming up to the time when Phase V works are scheduled to be installed
but no longer than January 2020.
Library Services Manager Basmaciyan reported installation of Phase V sculptures is
scheduled for January 2020. Staff proposes Phase III sculptures Balancing Act, Burnt
Matchstick, Cultural Pedestrians, Getting Your Bearings, and No Swimming remain on display until Phase V sculptures are installed but no later than January 2020. Artists will
be offered $500 to allow the pieces to remain on display. Staff will work with Arts Orange
County (ArtsOC) to extend the contracts.
Jim Mosher was surprised to learn that Phase V is scheduled within a few months of Phase IV, which does not follow the original plan. Some of the Phase III sculptures proposed to remain appear to be near the locations proposed for Phase IV sculptures. He could not
find an online map or a brochure showing the locations of sculptures in the Sculpture Exhibition.
In response to questions, Library Services Manager Basmaciyan agreed to provide a map of the Sculpture Exhibition to Mr. Mosher. Now that the Council has approved the Phase
IV sculptures, a map can be placed online. A map of Phase III sculptures is contained in
a brochure available at all Library locations.

extend the display of Phase III sculptures Balancing Act, Burnt Matchstick, Cultural Pedestrians, Getting Your Bearings, and No Swimming until Phase V sculptures are
installed but no later than January 2020.

Chair Greer explained that Phase III sculptures are scheduled for de-installation in the fall of 2019. Phase IV sculptures will be installed on June 22. The selection of Phase IV
sculptures was moved forward so that 20 sculptures will be on display in the Sculpture Garden. The timeline for Phase V has not been approved and will depend on the budget
approved for the Sculpture Exhibition.
Commissioner Glabman noted Phase III and Phase IV sculptures will be in the Sculpture
Exhibition over the summer when the most tourists visit Newport Beach.
Chair Greer announced that the City Council approved Phase IV of the Sculpture
Exhibition on April 9, 2019. Phase IV sculptures are Pinnacle by Stephanie Bachiero, The

Tot by Richard Becker, Spy Boy by David Buckingham, Windswept by Lake Daffner,
Feathers in the Wind by Alex G., Slices of Heaven by Craig Gray, Hurricane by Ray Katz,
Chairman of the Board by Steven Rieman, Contender by John Merigian, and START Now by Scott Froschauer. Sculptures selected as alternates are Exposed by Kathy Taslitz,
Fallen Sky by Coral Lambert, and Hope Springs Eternal by Grant Bathke. Opening Day for Phase IV will be June 22, 2019. Chair Greer thanked the City Council, ArtsOC, Mr. Frisch, Mr. Barton, staff, and the community for their support. She congratulated the artists
on their work being selected.
S14. Laguna Playhouse Performances – The City Arts Commission
designated Cultural Arts Grants funds specifically for K-6 educational programming for Newport Beach students. The Cultural Arts Grants Ad
Hoc Subcommittee identified Laguna Playhouse as a viable option for
fulfilling this objective.
Library Services Manager Basmaciyan reported $14,500 in Cultural Arts Grants funding is available for educational programming for K-6 students in Newport Beach. Laguna Playhouse presents theatrical performances based on popular and critically acclaimed
works of fiction in local schools. The cost of Laguna Playhouse performances is $3,000 each. Performances are scheduled for April 24 at Newport Elementary School and for May 2 at Mariners Elementary School.
Chair Greer advised that actors will perform The Island of the Blue Dolphin with masks and puppets and will be accompanied by the Native American flute and percussion
instruments.

carried (5-0-0-1) to approve the use of Cultural Arts Grant funding for two performances by Laguna Playhouse at Newport Elementary School and Mariners Elementary School.

7. Performing Arts for Concerts on the Green Ad Hoc Subcommittee –

Vice Chair Bendetti announced the concert series will begin on Father's Day and conclude after Labor Day weekend.
In reply to Chair Greer's request, Administrative Support Technician Francine Jacome reviewed the performance schedule of Side Deal on June 16, The Smith Country Band on

8. Performing Arts for Balboa Peninsula Ad Hoc Subcommittee –

Chair Greer reported the subcommittee has received a list of potential dates for a concert. The subcommittee is considering Super Diamond for the concert. She asked staff to determine whether Super Diamond is available on any of the dates listed.
Commissioner Glabman noted Art in the Park is scheduled for the weekend of
September 28. She favored the October 6 date because the Concerts on the Green will
have concluded. The event could garner more publicity if it is held on October 6.
Chair Greer advised that Library Services Manager Basmaciyan has learned that
Peninsula Park is available on September 21, 22, 28, 29 and October 5, 6, 12, 13. Marina Park is a perfect location for concerts.
Commissioner Little and Chair Greer concurred with scheduling a concert on October 6.
Library Services Manager Basmaciyan indicated the Newport Beach Food and Wine Festival is scheduled for October 6.
Chair Greer related that Marina Park is available on September 29 and October 6. The City Arts Commission should not rule out two events in one weekend because the Newport Beach Arts Exhibition and the first Concert on the Green are scheduled for Father's Day
weekend.
Library Services Manager Basmaciyan recommended a concert begin no later than 7:00
p.m. because of the residential areas around Marina Park and Peninsula Park.
9. Art in Public Places Library Gallery Ad Hoc Subcommittee –
Commissioner Miriam Baker, Commissioner Arlene Greer
Chair Greer indicated third member of the subcommittee will be appointed. The subcommittee will review applications for exhibits in the Library Gallery.
Jim Mosher remarked that an exhibit of art from UCI students is located on the second floor of the Central Library.
In answer to Chair Greer's question, Library Services Manager Basmaciyan advised that Professor Lewis has completed the installation, and it is properly signed. Professor Lewis has invited the artists to view their work on Saturday morning. Artwork too large for the
display cases will be displayed on a table, and Professor Lewis will be present to protect the works.
10. Cultural Arts Grants Ad Hoc Subcommittee – Commissioner Barbara Glabman, Commissioner Wayan Kaufman, Commissioner Arlene Greer
Chair Greer noted the City Arts Commission has Cultural Arts Grants funding available for additional K-6 programming. She had requested Laguna Playhouse notify her if they have
other cancellations. Perhaps Commissioner Glabman could contact OC Opera as well.

Commissioner Glabman reported as of two weeks ago OC Opera had no openings for performances.
Chair Greer advised that the subcommittee is considering a festival for all K-6 students in Newport Beach. 11. Publicity Liaison Ad Hoc Subcommittee – Commissioner Michelle Bendetti, Commissioner Arlene Greer, Commissioner Wayan Kaufman
Chair Greer announced that the Corona del Mar Residents Association has invited the City Arts Commission to attend its annual open house and meeting scheduled for the
following Wednesday. This is an opportunity for the City Arts Commission to raise
awareness of its programming. She asked staff to invite the Newport Beach Arts Foundation to the meeting.
Commissioner Glabman suggested a flyer or an announcement of the opening of the Sculpture Exhibition Phase IV be distributed at the Corona del Mar meeting. Chair Greer
added that information about the Concerts on the Green and the Newport Beach Art Exhibition can be distributed at the meeting. 12. Newport Beach Arts Foundation Liaison Ad Hoc Subcommittee –
Commissioner Wayan Kaufman
Chair Greer understood the Newport Beach Arts Foundation has funding of approximately $28,000. The City Arts Commission will request the Arts Foundation use the funds to
support Phase V of the Sculpture Exhibition. The City Arts Commission will ask the Arts
Foundation to host the Phase IV Sculpture Exhibition Opening Day luncheon. The Newport Beach Arts Foundation will support the Newport Beach Art Exhibition with
volunteers and by handling the sale of art.
13. Sculpture in Civic Center Park Exhibition Development Ad Hoc
Subcommittee – Commissioner Arlene Greer, Commissioner Marie Little,
Commissioner Barbara Glabman
Chair Greer reported the subcommittee has discussed Burnt Matchstick. The subcommittee is drafting a naming program for local sponsorship. The subcommittee feels a naming program can be implemented more quickly and involve more people than
a donor wall. Jim Mosher suggested the City Arts Commission clarify the ending date in its motion
regarding Phase III sculptures given that Phase V sculptures may not be installed in January 2020.
Library Services Manager Basmaciyan related that Phase III sculptures will remain on display until the proposed January 2020 date for installation of Phase V.
In reply to Commissioner Glabman's query, Library Services Manager Basmaciyan clarified that Phase III sculptures will remain on display until January 2020 at which time
Phase V sculptures will be installed.

Mr. Mosher asked if Phase III sculptures will remain on display should the installation of Phase V be delayed beyond January 2020.
Chair Greer indicated more information will be forthcoming. VII. CITY ARTS COMMISSION ANNOUNCEMENTS OR MATTERS WHICH MEMBERS WOULD LIKE PLACED ON A FUTURE AGENDA FOR DISCUSSION, ACTION OR REPORT (NON-DISCUSSION ITEM)
Chair Greer requested agenda items for the Fake or Fortune exhibit, the Balboa Peninsula concert, the naming program for the Sculpture Garden, the Sculpture Garden Opening
Day, retaining Burnt Matchstick, and Cultural Arts Grants remaining funding for K-6
programming.
VIII. PUBLIC COMMENTS ON NON-AGENDA ITEMS
Jim Mosher recommended the website for the Sculpture Exhibition be updated and include
more information and graphics. The City Charter tasks the City Arts Commission with making recommendations to the City Council regarding ordinances, rules, and regulations.
Chair Greer requested staff update the website to include current sculptures. Library Services Manager Basmaciyan reported the current sculptures can be found on
the Newport Beach Public Library website under Cultural Arts. The City website will redirect a user to the Library website. The MyNB app is a walking tour of the Sculpture Exhibition.
Commissioner Glabman suggested access be simplified. Most people are not aware that
the City Arts Commission falls under the purview of the Library.
Chair Greer acknowledged Ritch LeGrand who has been appointed to the City Arts
Commission.

TITLE: Cultural Arts Activities for April 2019
Art at the Library
"OC Coast Print Series" art prints by Joe Cladis
March 4 - May 3, 2019, Central Library Gallery
The Newport Beach City Arts Commission presents an
exhibition of art prints depicting the Orange County Coast by
artist Joe Cladis, on display at the Newport Beach Central
Library gallery.
As long as he can remember, Joe Cladis has loved to draw. That
love led him to Art Center College of Design in Pasadena where
he majored in Advertising with a minor in Illustration. Since that
time he has spent his life working in the visual arts as a fine
artist, graphic designer and illustrator. Having lived in Orange
County for over 35 years, Joe has come to love the uniqueness
of each of its coastal towns and communities. This passion led
him to create the OC Coast print series.
“The Orange County coast has so many iconic communities,
each with their own personality and style. Capturing the essence
of each one is a fun, artistic challenge for me.” - Joe
The exhibition will be on display during library operating hours, March 4 through May 3, 2019.

TITLE:
Consideration of Fake or Fortune Exhibition and Lecture at the Library
RECOMMENDATION:
Under the recommendation of the Art in Public Places Ad Hoc Subcommittee, staff requests that the City
Arts Commission approve the exhibit and panel discussion of Fake or Fortune: Provenance and
Attribution by Professor Joe Lewis of UCI Claire Trevor School of the Arts.
FUNDING REQUIREMENTS:
No funding requirement.
DISCUSSION:
Professor Joe Lewis has completed the Application for Review and Consideration of Art for the exhibit
Fake or Fortune: Provenance and Attribution. Professor Lewis proposes to feature artworks from the
Sandy Weiss and Family collection of unauthenticated works. Professor Lewis also proposes a panel
discussion about the artworks for the public to attend.
The Library Services Director manages the gallery space. The City Arts Commission’s Art in Public Places
Ad Hoc Subcommittee meets periodically to review artist's submissions and notifies artists by mail of
acceptance. Staff arranges the hanging of the art. The library gallery space is currently booked through
November 2020.

Proposal for Super Diamond Concert at Marina Park
RECOMMENDATION:
Based on the fees and specific needs of Super Diamond, staff recommends the Performing Arts on the
Balboa Peninsula Ad Hoc Subcommittee identify and recommend an alternate Neil Diamond tribute
band for the September 29, 2019, peninsula concert at Marina Park.
FUNDING REQUIREMENTS:
Performance fees and sound engineering for the proposed concert will be expensed from the City Arts
Commission 2019/20 programming budget. The band manager indicated that Super Diamond would
perform for $7,500, plus expenses. Expenses include seven hotel rooms, and specific food and beverage
requirements. The staging and sound engineering requirements cost a minimum of $3,000 in addition
to the band’s fee.
DISCUSSION:
The City Arts Commission hosted Southland Sings in September 2018 at Peninsula Park, with
approximately 300 people in attendance. Marina Park has been reserved for this year’s peninsula
concert due to more visibility to residents and visitors. The Performing Arts on the Balboa Peninsula Ad
Hoc Subcommittee recommends performers to the City Arts Commission for approval. The band
selected for this year’s concert is Super Diamond, a Neil Diamond tribute band.
Super Diamond, based in San Francisco, CA, has a detailed and specific rider requiring the City Arts
Commission pay for hotel rooms and other expenses. The band’s performance fee is $7,500.00. Staff
negotiates a fee with the performers, and coordinates the use of Marina Park. Additional funds are used
to publicize the event and to hire a sound engineering contractor for the performance.
The sound engineering firm, Triskelion Event Services, Inc., provides the sound equipment and speakers
for a minimum of $3,000 per concert. Super Diamond’s detailed rider specifies equipment beyond the
normal services Triskelion provides for the other concerts that the City Arts Commission hosts. Staff is
awaiting a quote from Triskelion based on Super Diamond’s specific requirements.
Based on the fees and specific needs of Super Diamond, staff recommends the Performing Arts on the
Balboa Peninsula Ad Hoc Subcommittee identify and recommend an alternate Neil Diamond tribute
band for the September 29, 2019, peninsula concert at Marina Park.
