January 28th, 1952.
The City Council of the City of Newport Beach met in regular
session in the council chambers of the City Hall at the hour of 7:30 P.M.
The roll was called, the following members answering present:
Finch, Ramsey, Blue, Greeley, Isbell.
The Mayor asked if any of the councilmen or anyone in the au-
dience wished the minutes of the previous meeting or any part thereof, read.
No one responded, and the Mayor declared the minutes approved as written.
Certain demands, having been approved by the Finance Committee
and signed by the Mayor and City Clerk, were ordered paid on motion of
Councilman Finch, seconded by Councilman Ramsey, and the following roll
call vote:

NOES, COUNCILMEN: None

The Balboa Island Business Association requested that the Marine
Avenue approach to the Balboa Island Bridge from Bayside Drive be repaired,

Letters from B. N. Desenberg and Dr. Wilbur Bailey regarding the
flood water drainage situation on Bayside Drive in Carnation.Cove were read,

The Women's Civic League of Newport Harbor requested permission
to conduct a food sale during Easter week on the bluff above Little Corona
';doriens Civic L�;. ren. Beach. Councilman Finch pointed out that this was a residential zone, and
to sell food on CDt? therefore the Council had no authority to grant such a permit, thus the re-

ried.
A letter from Francis J. Horvath urging that broken sidewalks
be repaired with concrete instead of blacktop, and that the truckers damag-

to the City Engineer with instruction to attempt collection from the res-
ponsible parties for damages incurred in 35th and 36th Streets.
The application of Bay Motors to operate an automobile sales and

H. S. Mazet of Balboa Island complained about the low flying

airplanes over the area, and on motion of Councilman Ramsey, seconded by
Councilman Finch and carried, the complaint was referred to the City Manager.
The Lea =ue of Civic Associations urged that action be taken on
the removal of above- ground storage tanks on Balboa Blvd. in Newport Beach.

A petition bearing 91 signatures asking that the ordinance
adding $1.00 to monthly water charges be revoked, and that funds col-
lected by this means be refunded, was presented. Attorney Max Hurwitz,
speaking from the floor, stated that a test suit was being instituted
in Superior Court for the purpose of determining the legality of the
water charge, and on motion of Councilman Finch, seconded by Councilman
Greeley, the petition and the reply to the test suit were referred to
the City Attorney, by the following roll call vote:

The Park, Beach and Recreation Commission recommended that 24

in the 1952 -53 budget as a single departmental unit. On motion of Coun-
cilman Finch, seconded by Councilman Greeley and carried, the recommen-
dations were taken under advisement.

The Planning Commission recommended, in their Resolution No.
500, that the City Council undertake the regulating of incinerators with-
in the City of Newport Beach by a regulatory ordinance instead of through
the existing zoning ordinance, and asked amendment of the zoning ordinance
by removal of the word "incinerators" in the present Section 9103.73•
•
On motion of Councilman Finch, seconded by Councilman Ramsey and carried,
the recommendation was referred to the City Manager and the City Engineer
for investigation and report.
Planning Commission Resolution No. 501, being a resolution
granting a front yard variance from 25 feet to 20 feet in Lots 1 to 8
inclusive, Block 637, Canal Section, to Ralph Maskey, William Martin,
Louis Spielberger, Dr. John Wilson and Nicholas Wagner, was presented,
and on motion of Councilman Greeley, seconded by Councilman Ramsey, the
Council concurred with the Planning Commission in granting the variance
by the following roll call vote:

The City Clerk announced that this was the time and place
set for the opening of bids for the moving of houses at 39th Street and

The City Manager said that he had been recuested to designate

An agreement in the matter of rental of facilities of the Joint
Outfall Sewer to the City of Newport Beach was presented, and on motion of
Councilman Finch, seconded by Councilman Ramsey, Resolution No. 3934, being

The City Manager requested permission to attend the annual City
Cit, M,r. to atcenc. Managers' meeting at Riverside in February, and on motion of Councilman Blue,

The City Manager stated that informal bids for the supplying of
gasoline to the City for the ensuing year had been received, and that the
RZS. 3935. low bidder was Alan P. Craig for the Rio Grande Corporation, at a price of
A.P.Cra.i -- Ai %,(.. Gaso- 1764 per gallon for Ethyl -plus. On motion of Councilman Blue, seconded by

ply of tires and re- capping had been received, and that the low bidder had
not complied with specifications. On motion of Councilman Ramsey, seconded
