The City Council of the City of Newport Beach met in Special Session
the Courdl Chambers of the City Hall at 11:00 a.m. January 16th,
1953, in response to a call for the purpose of considering the Consideration of
restrictions of the contemplated dump site against open burning Dump Site
and the deposit of animal, fruit, and vegetable refuse and offal.
The notice of special meeting having been duly given and the
councilmen having duly consented to the holding of the special
meeting and waived further notice thereof, the meeting was
called to order at 11:00 a.m. by the City Clerk in the absence
of Mayor Miller.
The roll was called, Councilmen Isbell, Bennett, and
Smith responding. Councilman Finch and Mayor Miller being ab- Roll Call
sent."
On motion of Councilman Isbell, seconded by Councilman
' Bennett, Councilman Smith was appointed Mayor -pro tem by the Smith declared Mayor
following roll call vote: pro tem
AYES, COUNCILMEN: Isbell, Bennett, and Smith.
NOES, COUNCILMEN: None
ABSENT COUNCILMEN: Finch and Miller.
• Resolutioni No. 4025, being a resolution restricting
the uses of the contemplated dump site as specified in the call, Restrictions on dump
was read by the City Attorney. Speaking from the floor, Attorney site, no burning, etc.
Harry Ashton, representing Republic Construction Company, stated
that the restrictions embodied in the resolution were satisfactory
and that action against the City now pending in the Superior
Court would be withdrawn immediately. This statement was con-
firmed by E. A. raulston. Also speaking from the floor,
Attorney Fred Dudley, representing the intervening committee of
the Costa Mesa Chamber of Commerce, stated that the organization
would take similar action. On motion of Councilman Isbell,
seconded by Councilman Bennett, Resolution No. 4025 was adopted Resolution No. 4025
by the following roll call vote, to -wit: Adopted
AYES, COUNCILMEN: ysbell, Bennett, and Smith.

ABSENT COUNCILMEN: Finch and Miller
On motion of Councilman Isbell, seconded by Councilman
Bennett and carried, the meeting was adjourned. Adjournment
