Adjourned regular session, The City Council of the City of Newport Beach met in adjourned
regular session in the Council Chambers of the City Hall at the hour
of 8:30 A.M.
Roll call, The roll was called, the following members being present:
Councilmen Hart, MacKay, Stoddard, Higbie, Ridderho£ and Hill; Council-
man Wilder being absent.
Canvass of election The Mayor announced that this was the time and place for the
returns. canvass of returns and absentee voter's ballots for the General
Municipal Election and the Special Bond Election held April 8, 1958.
The Council canvassed the votes cast in the General Municipal Election
and the Special Bond Election.
Absentee voter's ballots The absentee voter's ballots were then canvassed. The Clerk
canvassed. announced that 124 absent voter's ballots had been issued, one had
been spoiled, 2 were not returned, and 121 were returned and accounted
for. The result of the canvass of the absentee votes is as follows:

GENERAL MUNICIPAL ELECTION, APRIL 82-1958
Is MARGERY SCHROUDER, City Clerk of the City of Newport Beach, in
Orange County, California -do hereby certify and declare that a general
municipal election was dufr and regularly held in the City of Newport
Beach on April 8, 1958, and that the result of said election so held
was as follows:
(a) That the whole number of votes cast in said City was 6,084.
(b) That.the names of the persons voted for, the office for
which they were voted, the number of votes given in each
voting precinct to each of said persons, together with
the whole number of votes which they received in the
entire City, were as follows..

granted with the understanding that, among other things, the property
would be acquired by the City under threat of condemnation fora cash
consideration of $80,850, and conditioned that the City take the
property subject to Condit -ions of a preliminary report of title, dated
March 20, 1958, furnished by Title. Insurance and Trust Company.: It
was explained by the City Manager and the City Attorney.that .said title
report indicated a cloud on the property by reason of a Deed of Trust,
to the Chase National Bank of New York, granted by Pacific Electric
Company, to secure an indebtedness evidenced, by-bonds to be issued.
Information had been received by the City Attorney and the City Manager
that the Deed of Trust might not apply to- - -the subject property since
the subject property "was thought to have been released as a security
to.the bonds mentioned. The "City ;Attorney was of the opinion that the
City should have this information in writing and--that the City should
not proceed to award " -the contract. Mr. Lewis had suggested a Hold
Harmless Agreement from Pacific Electric Railway - Company, >but.the City
Attorney thought that this would not b ' sufficient-protection'-for the
City in view of the amount of money the City is spending to acquire
the property. On motion of.Councilman Lorenz, seconded by Councilman
,
Higbie and carried, the_City- Attorney and the City Manager were directed
to bend every effort to bring this matter to an early conclusion.
Councilman Lorenz suggested that the City Manager do everything in his
power to alleviate the traffic problem in the area involved, pending the
installation of improvements.
