They are now proposing Creeping Red Fescue- Festuca Rubra var. ruby in the street end area rather than Berkley

I would put it back to their LA to come up with a low growing ground cover in that area. I do not want to suggest
something that might not work in the future. The plan could remain the same and they would incur the costs to repair
it, per the EP, if the city damaged the plant material to maintain infrastructure.

The owner of 3812 River Avenue is proposing to modify the existing encroachment agreement for the street end. Please
review the attached exhibit and provide your comments. Both the proposed landscaping and existing Encroachment
Agreement are attached. One issue is the requirement to provide a 12-foot wide access to the bulkhead for
maintenance and emergency purposes. Can the proposed planting stand up to foot traffic and small equipment or
should something more resilient be proposed. Thanks

Below are my comments regarding the Bay Front Street end plans you submitted today. Also attached
is my mark ups of the drawing.
• The proposed raised planter adjacent to 3812 River Avenue is not consistent with City Council
Policy L-8. The planter shall be at grade and be constructed of redwood or concrete strips and shall
not be wider than 2 feet. The planting within this area shall be no more than 2 feet high.
• The sidewalk labeled as existing along the back of the paved portion of the street is not
existing. You will be required to install a 5' wide sidewalk in this area.
• A minimum 12 foot wide area from the street end to the bulkhead will be required per the City
Council Policy L-8 for emergency and maintenance. The sidewalk can be a portion of the 12 feet. This
area will need to be grass or other low growing ground cover (maintenance vehicles may be driving on
this area).
All existing trees shall be protected in place. No new trees shall be planted.
The remaining landscaping will require Municipal Operations Department review and approval.
• You will need to obtain approval from your neighbor at 3900 River Avenue. This was required as
part of the original encroachment agreement process.

I'd like to note the homeowner mentioned the tree's on the
property that we were petitioning to remove are not city
property, but added by previous owners (neighbors to him) and
not maintained by the city. If you could cross reference that
with previous records that would be great.
