Councilman Higbie was of the opinion that the City should take advantage of a lower premium with the $10,000 deductible clause. Mayor Stoddard opened the meeting for a g public hearing regarding the conditioned Conditionecl Business Licenses of Lennis Newcomb, 4401 Business West Coast Highway, and ,Arthur H. Soekland, Licenses og 4323 West Coast Highway, for the presentation L. Newcomb; of evidence to determine if subject licenses & A. H. 1 are being used in contravention of the Soekland 1 Municipal Code, or an ordinance of the City, CA -63 ; or any law of the State, and whether said licenses should be suspended or revoked. I At the request of Councilman Higbie, the City Clerk read a letter from Mrs. Lennis Newcomb requesting that the hearing be continued for a period of one month as she had plans being 1 perfected by Mr. Morgan Noble to rearrange the boat slips in a more favorable way,and to combine the two operations into one to be presented to the Planning Commission at their 1 next meeting. , I 1 The City Attorney inquired whether or not the 1 licensees were in the audience. Mrs. Newcomb was present. The City Attorney asked whether 1 or not anyone was present on behalf of Mr. 1 Soekland. There was no response. The City Clerk stated that notice of the hearing had been published and that notices had been sent by mail to Mrs. Lennis Newcomb, Mr. Arthur H. Soekland, Mr. Earl Stanley, Mr. William L. Kennedy, President of Balboa Coves Association, and Mr. George F. Sherrill, President of Newport Island, Inc. The City Attorney stated that the City Manager also pointed out that investigations had been ; made of the premises and that it a -)peared that the licensees are probably in violation and the Council was requested to set the matter for hearing. 11 1 1 1 The City Attorney requested that Harold Young be ; sworn in as a witness. Mayor Stoddard swore in I 1 Harold Young, who stated that he was the License Inspector for the City of Newport Beach. Mr. ; Young stated that he had inspected the Newcomb premises and had observed the following: On ; October 10 and 17, there were five boats at the 1 1 dock five boats on shore moorings and fifteen mooring posts; on November 5, 14, 18, 20 and 21, there were five boats at the dock, four boats on shore moorings and fifteen mooring posts. Mr. Young stated that he had inspected the Soekland premises and had observed the following: On October 10 and 17, and November 5, there were ten . boats in the slips; on November 14, 18, 20 and 21, there were eleven boats in the slips. Mr. Young presented sip: photographs, four taken on November 24, 1958, and two taken on December 3, 1958, illustrating what he had observed. Mayor Stoddard swore in Mr. R. A. Glenn, who stated that he was the Director of Building and Safety for the City of Newport Beach. Mr. Glenn ; stated that A:.pplications for Building Permits are; submitted to his Department, that no Application ; for a Building Permit had been submitted for the ; construction of restroom facilities on the ; subject premises, and inspection had revealed ; that there had been no activity on the premises for construction of restrooms. The City Clerk read a letter and a report from ; Edward Lee Russell, M.D., Health Officer of ; Orange County, dated December 8, 1958, wherein it; is stated that an inspection of the premises ; located at 4401 and 4323 West Coast Highway had been made and at the present time there are no ; sanitary facilities provided exclusively for the ; boat owners. The Application for License of Arthur H. Soekland was revoked for noncompliance with the conditions of the license. Councilman Hart made a motion that Mrs. Newcomb °s license be amended to enable her to operate eighteen boat slip rentals, only eight of which may be located on her side of the property involved, the other ten of which could be located on the premises previously occupied by Mr. Soeklandy conditioned that she construct toilet facilities for women and men (two toilets for women ,and two toilets and one urinal for men), properly signed and properly lighted, and that she complete the construction within sixty .days. There was no second to Councilman Hart's motion. Mayor Stoddard declared a five minute recess The Council reconvened with all members present. The Application for License of Mrs. Lennis Newcomb was revoked for noncompliance with the conditions under which the license was issued, and it was directed that the boats be removed not later than January 12, 1959, from both the Soekland location and the Newcomb location. The hearing was continued regarding con- sideration of the proposed sale of the City - owned 88 acre parcel of land located at .Adams and Wright, and the 4.8 acre parcel of land located southerly of Hamilton and easterly of Bushard.
