The reading of the minutes of February 24, 1959,
was waived, and the minutes were approved as
written and ordered filed.

Pub.Hearir{g The Mayor announced that the hour of 7:30
re- Margarat o'clock P.M. having arrived, this was the time

Avenue ; of Newport Beach, California, for the hearing on
CA -29 ; the report filed under Division 4 of. the Streets
and Highways Code of the State of California for
the improvement of Margaret Drive and Irvine
Avenue. Attorney William MacKenzie Brown ex-
plained the legal procedure to be taken.
The Mayor asked the Clerk if notices of the
i hearing had been mailed as required. The Clerk
reported that notice of the hearing was given
by mail, as provided in Division 4 of the
f Streets and Highways Code, and that all of the
notices were mailed more than 30 days prior to
the date fixed for this hearing.
The Mayor announced that prior to the consider-
ation of the protests it would be necessary
that the report prepared and filed under said
Division 4 be read to the Council. Whereupon
the report (except as to the map, plat or
diagram and the assessed valuations and true
valuations of, and assessments and estimated
assessments upon, each parcel) was read to the
Council.
The Mayor then inquired of the Clerk if any
written protests had been filed with her prior
to the time set for hearing.

The Clerk reported that five written protests
or objections had been filed with her prior to
the time set for hearing. She read the letters;
received from the following named protesters:
Evans G. Parker, John F. Vogel, Louise A. ;
Senger, Mrs. Virginia Cavanaugh. ;
The Mayor then announced that this was the time;
and place set for the hearing and asked if any
person desired to orally protest or to speak in
support of any written protest filed.
Attorney Robert Powell, appearing on behalf of
Mr. John Vogel and Miss Louise A. Senger, ;
stated that if the Assessment District passed, ;
there would be litigation, which would be in ;
practicality "inverse condemnation" against the;
City. Dr. W. R. Leverton spoke from the ;
audience. ;
A discussion ensued as to the City's title to
certain properties.

Mayor Stoddard excused Attorney William
MacKenzie Brown and City Attorney Walter W.
Charamza from the meeting to confer and to
report back to the Council at 8°05 .M, as to ;
the next steps to be to en. ;

The report from the City Manager and the Public

Works Director regarding the receipt of bids in

the construction of the Corona del Mar Library,
was presented. Said report sets forth receipt
of ten.bids, the low bidder being 0, Z.
Robertson Construction Company, which bid was
in the amount of $22,975.
Councilman Lorenz made a motion to defer the

award of the contract for the construction of
the Corona del Mar Library until March 23, 1959.'

It was stated that consideration was being given:
to the locating of the proposed Corona del Mar

Library in Irvine Terrace Park instead of on
Marigold as contemplated in the plans and speci

fications. A vote was taken on Councilman
Lorenz' motion, which carried unanimously.
