ing in connection with .the appeal of L. C. Minium from
the decision of the Planning Commission denying Appli-
nation for Variance No. 596. In view of the fact that a
- letter had been received from Mr. Minium requesting a
continuance .of the: hearing to July 25,. '1960, the hearing

denda to the Agenda Items 1 (a), (b), (c), (d), (e), (f))
(a) The appeal of S. '.E. Locke. and R. Bromhill from the de-
cision of the Planning Commission granting the Applica-
tion of George P. Carver for Use Permit No. 622 for the
construction of a building 110' in height, plus mechanical
appurtenances above the topmost point of the roof, and
parking to 'conform to the "Z" District parking formula;
portion of Lot "L," Tract No. 919; Zone C -2; Orange

The City Clerk stated that letters had been received from
the following persons opposing Use Permits for tall build-

Una B. Simons; petition from "Property Owners Group,"
243 Ocean View Avenue, Newport Beach; Robert L.
Andrews, stating that a decision by the vote of the people
should be obtained; petition bearing signatures of thirty-
three property owners on Kings Road and one person in
Beacon Bay; Mr. and Mrs. Walter J. Koch ..and .Mr. and
Mrs. E: H. Conway of Harbor Highlands; Mr. and Mrs.
Burt Dorris of Balboa; Mr, and Mrs. William P. Boland
of Balboa; petition bearing seventy -nine signatures, whit
.was .submitted to the Planning Commission on July 7, and
directed to the City Council; Mr, and Mrs. Sheldon F.
Craddock, Corona del Mar, suggesting that the question
be put to a vote of the people; and D. J. MacLean, re-
questing, that the. matter be put to a vote of the people.
Mayor Pro Tern Hart opened the hearing regarding Use
Permit No.. 622. Mr. George P. Carver spoke from the
audience citing,: among the reasons for the Application,
that the most profitable and.best use of the property ne-
cessitated an application for additional height, further
stating that the design of the building had won an A.I.A.
award.

Mr. Gerald Sparks, 25.Balboa Coves, spoke in favor of
the construction of well - planned high.buildings.
Mr. Carver'a proposed plot plan, was submitted to the
Council for examination. During the discussion, inquir-
ies were made of Mr. Carver and Planning. Director J. y
Drawdy.
The hearing was closed.
Use Permit No. 622 was denied, the findings of the Plan-
ning Commission.were. not sustained since,, in the opinion
of the Council, the granting of the Use Permit would be
.detrimental and.injurious to property and improvements
in the,. neighborhood'.
Mayor Pro Tem Hart opened the hearing in connection
with the appeal of S. E. Locke and R. Bromhill from the
decision of the Planning Commission granting the Appli-
cation of Rom and Cola, Incorporated, for Use Permit No
623, to permit the construction of a hotel with a maximurr
height of 92' for the main building,. plus a height of 17'
for. mechanical appurtenances on the roof; Lots 1 through
7, Block.529, Lancaster's Addition, Zone C -2; Lot 1,
Tract No. 815, Zone C-2, being 3102- 04- 06- 08 -10 -12
Lafayette Avenue and 609 31st Street, Newport Beach.
Attorney Donald.Harwood stated that at the request of the
applicant for Use Permit No.. 623, "The Application is
hereby withdrawn.", He further stated that "this motion
or request is made. without. prejudice."
The City Attorney - requested time to consider whether or
not the Council would still have to make a finding in con-
nection -with the appeal. Attorney Harwood said he would
then request that the.matter be postponed.until the next
regular. meeting of the Council, or "lacking such a reso-
lution that the same request stand. "
Mayor Pro Tern Hart requested that the Council continue
with.other matters pending the decision of the City
