the Minutes were approved as written and ordered filed.
1. ,(Agenda Item E -1), Mayor Pro Tern Hart declared the
Hrg hearing open,. which had been continued from July 11,
Use 1960, regarding.the appeal of S. E. Locke and R.
Permit Bromhill from the decision of the Planning Commission
623 granting the Application of Rom and Cola, Incorporated,
CA -15 for Use Permit No. 623,. to. permit the construction of a'
hotel with a maximum height of 92' for the.main building,
plus. a height of 17' for mechanical appurtenances on the
roof; Lots 1 through 7, Block 529, Lancaster's Addition,
Zone C =2,• Lot 11: Tract No. 815, Zone C =2,- being 3102 -
04- 06- 08 -10 -12 Lafayette- Avenue.and 609. - 31st Street,

The findings of the Planning Commission were presented.l,
The letter of appeal, and. a letter from George Buccola
for Rom and Cola, Inc. , requesting that the application
be referred back to the Planning Commission, were pre-
sented. Letters from the following individuals opposing
high buildings in the City of Newport Beach and /or the
granting,of Use Permit No. 623 were presented: Balboa
Island Improvement Association, George V. McKinney,
Mr. and Mrs. Christian F. Schindler, Wesley C. and
Marian. J. Holler, Mrs. Velma LaVaute, Mrs. Ethel
Lindsey. Letters from the following individuals in favor
of high buildings in the City of Newport Beach and /or the
granting of Use Permit No.. 623 were presented: Dwan E.
Thompson, John Livingston, Newport Harbor -Costa Mesa
Board of Realtors, Balboa Improvement Association,
specifically in favor of tall buildings in the area from
"B" Street to Coronado Street.
Attorney Donald Harwood, representing Rom and Cola,
Inc;;, spoke from the audience advising the Council that
subject application was withdrawn.
Mr: Clarence Herbert, 243 Ocean View spoke from the
audience opposing tall buildings.
The hearing was closed, and the. applicant was allowed
to withdraw its application.
Mrs. Elsie Herbert spoke from the audience.

the recommendations of a Council Committee regarding
the approval of said Tentative Map, and a letter from Mr
E. D. Yeomans, General Attorney of the Pacific Electric
.Railway Company, appealing from the conditional approv-
al of the Planning Commission, were presented.
Mr. Yeomans. spoke from the audience.. The City Clerk
..read.the. recommendations of the Committee. Mr:
Yeomans stated that the Pacific Electric objections had
been - worked out with exception of the recommended.
requirement of a 45' right of way for Seashore Drive, fro

Mr.. Clarence Herbert; Mr. Robert G. Rove, Attorney
representing Port Orange; Mrs. Clarence. Herbert; and
:Mr. D. J. McLean spoke. from the audience.
The City Attorney explained. that if the ordinance were
adopted.as submitted,- the rezoning of the County Dock
,(Parcel B) property would be inconsistent with anagree-
ment which is now in effect between the County of Orange
and the City of Newport Beach.
