Mayor Stoddard called the,mee.ting to. order and the: City
Clerk read the Notice. of Special Meeting, wherein. it was
statedthat the, meeting, was called. for .the. purpose. of
considering,the. application -for reconsideration of the
City Council's action granting Variance No. 615:to -Mrs.
Patricia.McCook, 111 "G" Street, Balboa.
The City Clerk stated that all. members. of .the Council
had signed,the Waiver. of Notice. and Consent to holding
,of said,meeting.
Mayor Stoddard op'ened.the, meeting for. discussion and
read a letter: from L. K..Hegewald. received, by.the City
Clerk on September 29,, 1960, directed,to,.the Mayor and
City: Council,. which states- as follows:. "In referance. to
Variance No.. 615,, by Patricia. McCook,. which was. denied
bythe, Planning Commission and.appealed before..the
Council Sept.- 26, 1960, and approved,, it was stated at
.the, hearing that I did. not object. This, is, an-incorrect
statement. because. I do. object. Our view of,the. ocean
will be. lost which would devaluate our property. I wish
...to.ask:the, Council . for reconsideration, "'
Mr. Hegewald and Mr. Evans T. Evans were in.the. aud141

Mayor Stoddard stated,.that. he had. called., the meeting
because he. felt that .time .was. of the essence. The City
Attorney stated that he was. of .the. opinion that. the Council
had the power to reconsider its, action taken in granting
_.the, variance as- long.as- no-one, has been prejudiced, by any
action. taken. Mayor Stoddard inquired,of Mr. Evans
whether or not any action had. been taken. by Mr. Evans. or
Mrs. McCook,

Mr.. Evans., stated that their architect had.prepared
drawings. The- City Attorney asked Mr. E_ vans. whether
or not-they had secured a building permit for construction
or. whether or not they had purchased any supplies,, build -
ing,materials„ et cetera. Mr. Evans. replied.that_ they
had not,, but stated:.that subsequentto.the Council decision
they had had. an appointment with their architect, and that
drawings, had, been produced. The City Attorney .felt that
the. action taken would, not constitute; use of the variance
which would preclude :.the Council from reconsidering, the
;variance. appeal.
Councilman Somers, made a,motion.that. the. request for

reconsideration•of the applicationfor. variance, which is
the - letter:.from L. K.,Hegewald,. be granted and,that the
appeal from the, Planning Commission' s, decision. denying
Variance. No.. 615,. be. reconsidered. A further discussio
was.had. A vote. was taken on Councilman Somer s, motion
which carried unammoy�ly.
