Joint Harbor Committee has adopted a .policy whereby it
will not recommend for approval to the Council permits
for new piers on Balboa.Island.in any area.suitable for
beach or swimming purposes.
"The :field check revealed that the, only areas.on Balboa
Island that are, not suitable for beach or swimming pur-
poses and where, there are no piers - existing at the
present time are:
1. On East Bay Front near .the southeast corner of
Little Island between the existing pier on Lot 9 and
the, existing pier on Lot 7 of Block.4, Section 5.
2. On South Bay Front between the, existing pier on Lo
3, Block..4:to the southeast corner of Little Island.
3. On. -the South Bay Front in front of Lot 2, Block 4.
4, On the South Bay Front between the existing piers
.,between Emerald and Garnet Streets.
The Committee further. recommends that the - following
notice.be sent to all Balboa Island owners of property

to be sent by the Joint Harbor Committee prior to the submission of the matter to

9. (Agenda..Item G -11) A letter was presented from Braden
Finch, Executive Secretary of :the. Corona del Mar Cham-
ber. of Commerce, stating. "May our directors. call your
attention to -the, uncontrolled destruction. of marine..life. in
the rare. tidepools, along the Corona del Mar beach front,'
stating further that cooperation has been requested.from
various. agencies and State officials; but. requesting that
the Council "take- the :lead.in investigating and.protecting
the rapidly dwindling, natural resource -- not only along
the .tideland,. but in certain areas of the Upper Bay;" re-
questing protective. rules or regulations. .
Mayor Stoddard was authorized to, transmit the Corona
del Mar Chamber of Commerce letter to Senator John
Murdy and Assemblyman Bruce Sumner- asking their
recommendations.
10. (Agenda. Item G -12) A Summons and Complaint to Quiet
Title, for I*nction and for Declaratory Relief in Orange
County Superior Court Action No. 93416, Joe B. Hollomc
et al., Plaintiffs,. vs. Frank Richmond, et. al., (including
City of Newport Beach), Defendants, served on -the. City
Clerk.on February 3, 1961, being.a suit concerned With
possession and use of a certain pier and float lying equal]
on either side. of .the bayward prolongation of the common
lot line. between Lots, 19 and 20, Block 5, Section 5,
Balboa. Island; alleging that said float and. pier are affixed
by pilings to certain submerged lands, tidelands. and up-
lands, belonging,to the City of Newport Beach, .were pre-
sented.
The City Attorney was authorized and directed to appear
in-the Superior Court Action, "Hollomon v. Richmond,
et al..," on behalf of the City of Newport Beach.
ll.(Agenda.Item G -13) The. alieged.claim of Motors:Insuranc
Corporation, subrogee of "James Gary & E. V. Popejoy, "
(City's. records, James Gary Popejoy) for damages, in the
amount of $203.46, re claim apparently arising out of an
.accident between a Park Department ladder truck being
driven by Jack Hertwick, Sr., and. a car being driven. by
-James Gary Popejoy, a City employee, on November 22,
was presented.
Said. claim was denied and the City Clerk's action, in
referring..the matter to the insurance carriers,. was
confirmed.
12. (Agenda Item G -14) The claim against the; City of Newp
Beach Fire Department for alleged damages. in the. amc
of $210, 448 for. fire damage to structure. and contents,
sustained by Griffith Co. and Vincents Drug's #4, Inc.
alleging, negligence. in.the.fighting,of the fire,, was pre-
sented.
Said claim was denied and the City Clerk's action,: in -re-
ferring.the matter to the insurance carriers. and the City
Attorney, was confirmed. A

City Librarian, dated February 10, 1961, regarding
' . "Mariners Area Branch Library - Feasibility Report,"
was presented.
A Council Committee, comprised of Councilmen King
and Atkinson, was appointed to meet with. the Library
Board for discussion and report back to the Council.
13.(Agenda Item J -12), Resolution No. 5362,: limiting the
parking of vehicles on certain streets, establishing one
hour parking on the, south side of Park Avenue from
Marine Avenue westerly approximately seventy -five feet
to the. alley, was adopted.
14.,(Agenda Item J -13) Resolution No. 5363, authorizing the
Mayor and City Clerk.to execute .a License Agreement
between.the City of Newport Beach. and Newport -Costa
Mesa Broadcasting, Inc. , whereby the City grants to the
licensee. permission to construct and maintain a radio
transmitter with a building to house same. and a radio
tower on City -owned land on .the- south, side of 16th Street
westerly of Monrovia Avenue, was adopted.
