The. reading, of the Minutes. of April. 9, 1962,; was waived,
the Minutes, were approved as written and ordered. filed.
Mrs. Carl Corkett of the Daughters.of the American Revolu.
-lion, Flag of the 'United States of America Chairman,, pre-
sented a. flag. which has. flown over the United States Capitol.
Mayor Hart accepted.the gift with appreciation.
HEARINGS:
Councilman Marshall stated that in view of the.. fact that she
had served as,a.member of the Planning Commission when
the recommendations to the Council. were. made--in connec.tioi
.with the two appeal hearings on the Council Agenda, she
.desired to be excused from participating in the hearings.
Councilman Marshall left the rostrum.
1. (Agenda Item E -1) Mayor Hart opened the public hearing
,regarding, the appeal of James Clark.from the decision of
the Planning Commission denying the Application of Frar
C. Hubbard for Variance No. 687 for permission to have
a zero setback on the alley for. the purpose of construct -
ing a service station; Lots.56, 57, 58, Block B, Tract
No. 673, Zone C -1, 3926 -3934 East Coast Highway,
Corona del Mar.
The following communications, were presented: the
findings.of the Planning Commission; letter from Attorne
C. Arthur Nisson, Jr.,,; supporting, the. request of appli-
cant.for. subject Variance; letter. from James Ray, stat-
ing, that he is the. owner of Lot 4 in Tract No. 673, to
which an. undeveloped. alley adjoins on the south, and that
he has. no objection to. the granting, of Variance No. 687.
Mr. Nisson spoke from the audience -on behalf of the
applicant. Richard Lawrence, representing, his mother,
Mrs. Geraldine Phillips, owner of property, on Columbus
Circle_ overlooking, subject premises, and Harold Reems,
also owner of property overlooking, subject premises,
spoke from the audience, opposing Variance No. 687.
The hearing.was closed.
The findings of the Planning Commission: were over-
ruled, and Variance No. 687 was granted.
(Agenda Item E -2) Mayor Hart opened.the public hearing
regarding, the appeal of Michael Kay from the decision
of the Planning, Commission. conditionally granting.Appli-
cation for Use Permit No. 834 requesting permission to
construct two.dwelling units. above.a.commercial building

approved one dwelling unit. The. findings. of the Planning
Commission and a letter, dated March.20, 1962„ from
Michael Kay,. were presented. Mr. Kay and Planning
Director J. W. Drawdy spoke from the audience. The
hearing, was closed.
Councilman Cook.made a. motion. to overrule, the. findings
of the Planning Commission and.grant Use Permit No.
834. Said.motion. resulted. in a tie.vote. and failed to
carry.
Councilman Lorenz.made- a.motion to sustain the.findingi
of the Planning Commission. and conditionally grant. the
Use Permit. Said-motion resulted. in a.tie.vote and faile
to carry.
The City Attorney stated that in accordance with prece-
dent, where we have had a.tie:vote, the findings of the
Planning Commission stand„ in. this. instance the. appli-
cant would have. a Use Permit, but he would not have two
units, he would have only one, unless further Council
action. is. taken. No further action was: taken.
Councilman Marshall returned to the Council rostrum.
3. (Agenda Item E -3) Mayor Hart opened the public hearing
in accordance with Resolution No. 5560, being,a Resolu-
tion of the, City Council. of the City of Newport Beach de-
Glaring. its intention to annex:to the City certain property
known as Annexation No. 50 (East Upper Bay bluff area
to MacArthur Boulevard, including The Dunes) and giving
notice thereof and the, time and place for the Council. to
hear and pass, upon. all proteste,to subject annexation.
The City Clerk certified that a copy of subject resolution
..had been duly published in the News Press and in the
Daily Pilot. She stated. she.-.had received "Annexation -
Consent" .from The _Irvine Company„ the Irvine Coast
Country Club, the Board of Supervisors. of Orange Count}
and. the Newporter Hotel Corporation; consenting;to be
taxed_to pay. any indebtedness or liability of the City con-
tracted prior to or existing,at the time. of annexation in
accordance. with Section•35310.of the Government Code.
No..one.desired to speak from:, the. audience. The-hearing
was closed.
Resolution No. 5580,, finding, and declaring, whether a
majority protest has-been made by the property owners
at the hearing, on the annexation, was.adopted.

and. charges.. therefor, was ordered filed.
4. (Agenda Item K -5) A letter was presented from Don E.
Woodward, President of Resplan, Inc., regarding "Im-
provements" and a.water system conforming, to City re-
quirements. The City Attorney was - instructed to prepare
an.agreement to share the cost.of a 12.inch line on the
same basis as the City has used before, i. e. , the City to
provide the difference in. cost of the materials, between
an.8 inch. and a. 12 inch line only, Resplan, Inc., to do
all the installation.
5. (Agenda Item K -6) A letter from Mrs. Robert J. Marsh
submitting. her resignation. from the Planning Commissio
because. of her election to the City Council, was pre-
sented. Mrs. Marshall' s. resignation was.accepted with
the comment. that. the Planning Commission's, loss. was
the Council's gain; and it was. directed that a Certificate
of Appreciation be forwarded to her.

Chamber of Commerce upon the recommendations of
said Committee„ recommending approval and concurrex
in the State' s. so-called . "Red Line" depiction -for con-
struction of a "Route 60" freeway as. the best and most
practical and least damaging route and stating that said
recommendation, approval and concurrence. extends, to
those certain: adjustments, of alignment designated the
"Orange Line" on. a proposal of the City. of Newport Bea
7. (Agenda Item K -8) A report on Senate Resolution No. 101
;s.. by Senator John A. Murdy, relating to the. study of
Marine Reserves, -the. preservation and conservation of
the natural resources, was referred. to the City Manager
with. the request that he contact .the Corona del Mar
Chamber of Commerce to see if they have any, further
comments or recommendations. for action.
8. (Agenda ;Item K -9) A claim for damages, submitted by
Oscar E. Whitebook,. 2244 West Coast Highway„ in con -
nec.tion.with the landslide which occurred back of his. car
's wash. on February 9, 1962, resulting in alleged damages
in an estimated amount of $18, 209. 56, was presented.
Said.claim was denied, and the City Clerk's. referral of
the matter to the insurance carriers: was confirmed.
9. (Agenda Item K -10) A letter from Attorney Frank M.
Linnell, appealing from the decision of the Planning Co
